Can you get denied Washington ESD unemployment for being fired?

My supervisor terminated me last Friday for what they called 'performance issues' but I think it was really just personality conflicts. I've been working there for 18 months with no prior write-ups or warnings. Now I'm worried about filing for unemployment because I keep hearing mixed things about whether you can get benefits if you're fired. Does Washington ESD automatically deny claims when you're terminated versus laid off? I really need these benefits to keep up with rent while I job search.

It depends on WHY you were fired. Washington ESD distinguishes between being fired for misconduct versus being fired for reasons beyond your control like performance or not being a good fit. If it was truly performance-related and not willful misconduct, you should still qualify for UI benefits.

That's reassuring. There was no stealing or anything like that - just disagreements about how to handle certain tasks. Should I mention the personality conflicts when I file?

0 coins

Be honest but stick to facts. Focus on the performance aspect rather than personal conflicts. Washington ESD will likely contact your employer anyway during adjudication.

You should definitely apply! I got fired from my retail job last year for being late too many times (honestly deserved it) and Washington ESD still approved my claim after adjudication. The key is that it wasn't gross misconduct like theft or violence.

How long did the adjudication process take for you? I'm in a similar situation and stressed about the wait time.

0 coins

About 3 weeks for me, but this was during the busy season. Could be faster now.

I had such a hard time getting through to Washington ESD when my claim went into adjudication after being fired. Spent hours on hold every day for weeks. Finally found this service called Claimyr (claimyr.com) that got me connected to an actual agent in like 10 minutes. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ. Saved my sanity!

0 coins

Never heard of that but sounds too good to be true? How much does it cost?

0 coins

I was skeptical too but it actually worked. They don't charge upfront - you only pay if they get you connected. Way better than listening to that busy signal for hours.

The important thing to understand is that Washington ESD uses a 'misconduct' standard. Simple poor performance, personality conflicts, or not being the right fit typically don't qualify as misconduct. However, things like insubordination, policy violations, or attendance issues after warnings might.

0 coins

This is exactly what I needed to hear. I was never written up or given any formal warnings about my performance.

0 coins

But what if your employer lies about the reason? My boss told Washington ESD I was fired for misconduct when it was really just budget cuts.

0 coins

That's what the adjudication process is for - Washington ESD investigates both sides. You can provide documentation and your version of events.

0 coins

ugh the whole system is so stressful. got fired 6 months ago and still having nightmares about the adjudication process. at least i eventually got approved but man what a headache

0 coins

That's what I'm afraid of! How did you handle the stress while waiting?

0 coins

honestly just tried to stay busy with job applications and kept telling myself it would work out eventually

0 coins

One thing to keep in mind - even if your employer contests your claim, that doesn't mean you'll be denied. Washington ESD makes the final decision based on their investigation, not just what your former employer says.

0 coins

This! My employer tried to claim I was fired for cause but Washington ESD saw right through it when they couldn't provide any documentation of warnings or progressive discipline.

0 coins

Good to know they actually investigate rather than just taking the employer's word for it.

File ASAP regardless! Even if there's a question about eligibility, you want to get your claim started. The adjudication process can take time and you don't want to lose potential benefit weeks while you're waiting to decide whether to apply.

0 coins

You're right - I'll file this weekend. Better to have it processing than to wait and potentially miss out.

0 coins

Exactly! And make sure you keep doing your weekly claims even during adjudication or you'll lose those weeks.

I'm dealing with something similar right now. Got 'laid off' but pretty sure it was really because they didn't like me. Washington ESD is taking forever to make a decision and I can't get anyone on the phone to check status.

0 coins

This is exactly why I used Claimyr! The regular Washington ESD phone lines are impossible. Definitely check out their service if you need to actually talk to someone.

0 coins

Might have to try that. This waiting game is killing me financially.

For what it's worth, I've seen people get approved even after being fired for pretty legitimate reasons. Washington ESD seems to err on the side of approving claims unless there's clear evidence of serious misconduct.

0 coins

That's been my experience too. They really seem to focus on whether it was willful misconduct rather than just any reason for termination.

0 coins

This thread is making me feel so much better about my situation. Thank you everyone!

Make sure you document everything from your employment - any emails, performance reviews, communications about the termination. Even if you think it might not matter, keep it all in case Washington ESD needs more information during adjudication.

0 coins

Great advice! I still have access to my work email for a few more days so I'll save anything relevant.

0 coins

Yes! I wish someone had told me this. I lost access to everything right away and had nothing to back up my side of the story.

0 coins

Been through this twice unfortunately lol. First time I was denied because I actually did something stupid (missed too many shifts without calling in). Second time approved because it was a personality conflict with management. Washington ESD definitely looks at the specific circumstances.

0 coins

What was the difference in how you presented the two cases to Washington ESD?

0 coins

First time I had to admit I messed up. Second time I focused on how I was meeting job requirements but management had unrealistic expectations and communication issues.

0 coins

Don't let them intimidate you into not filing! Some employers will try to scare you by saying you won't qualify, but that's not their decision to make. Let Washington ESD decide.

0 coins

My former supervisor did hint that I probably wouldn't qualify for unemployment. Now I'm wondering if that was just to discourage me from applying.

0 coins

Definitely sounds like intimidation tactics. Employers sometimes don't want to deal with the unemployment claim process so they try to discourage people from filing.

0 coins

Quick question - if I get approved after being fired, do I still have to do the job search requirements like everyone else?

0 coins

Yes, the job search requirements are the same regardless of why you became unemployed. You'll need to log your job search activities weekly.

0 coins

Thanks! Just wanted to make sure I understood all the requirements upfront.

0 coins

The whole adjudication thing is nerve-wracking but try not to stress too much. I know easier said than done when you need the money, but most people I know who were fired for non-misconduct reasons eventually got approved.

0 coins

Thank you for the encouragement! I'm going to file my claim tomorrow and try to stay positive.

0 coins

Good luck! Remember to be completely honest in your application - it's better than having inconsistencies come up later.

If you do get stuck in adjudication hell like I did, that Claimyr service someone mentioned earlier is legit. Used it last month when I couldn't get through to check on my claim status. Finally got to talk to a real person at Washington ESD instead of just sitting on hold forever.

0 coins

How long were you in adjudication before using their service?

0 coins

About 5 weeks with no updates. Called using Claimyr and found out they just needed one more piece of documentation from me. Got it resolved within a few days after that.

Bottom line - being fired doesn't automatically disqualify you from unemployment benefits in Washington. The key question is whether it was for misconduct or not. Performance issues, personality conflicts, not being the right fit - those typically don't count as misconduct.

0 coins

This has been so helpful. I feel much more confident about filing now. Thank you to everyone who shared their experiences!

Good luck with your claim! Hope it goes smoothly for you.
