Can I receive Washington ESD unemployment if fired from my job?
I got terminated from my warehouse job last Friday and I'm trying to figure out if I can even apply for unemployment benefits. My supervisor said I was let go for performance issues but I think it was really because I reported safety violations to OSHA. I've been working there for 2 years with no prior write-ups. Does Washington ESD approve claims when you're fired or do they automatically deny them? I'm really stressed about paying rent next month.

You can absolutely apply for unemployment even if you were fired! Washington ESD looks at the reason for termination. If it wasn't for 'misconduct' you should be eligible. Performance issues alone usually don't disqualify you unless it was willful misconduct.

Since you mentioned reporting safety violations, that could actually help your case. Washington has protections for whistleblowers. If you can show you were fired in retaliation for reporting safety issues, that would definitely not be misconduct.

The whole system is ridiculous. I was fired for being 5 minutes late THREE TIMES and they denied my claim. Meanwhile my coworker who got fired for sleeping on the job got approved. Makes no sense.

I'm a former Washington ESD worker and I can tell you that most terminations don't rise to the level of misconduct. The bar is pretty high - has to be intentional violation of known rules or gross negligence. Poor performance alone usually doesn't cut it.

Update on my situation - I finally got through to Washington ESD using that Claimyr service someone mentioned earlier. Turns out my claim was approved but there was a system glitch showing it as still pending. Super frustrating but at least it's resolved now.

One last thing - if you do get benefits approved, make sure you understand the weekly claim process. You have to file every week even if you don't get paid that week due to working part-time or whatever.

For anyone else reading this thread, I had success using Claimyr when I needed to speak with Washington ESD about my fired-for-cause claim. Sometimes you really need to talk to a human to explain your situation properly, and their phone system is impossible otherwise.
