Social Security reclaimed deceased husband's final payment - seeking help with 1099 discrepancy

My husband passed away on Feb 15th, 2025. His final SS retirement payment was deposited into our joint checking account on March 3rd but then SSA withdrew it about a week later without any notification. Today I received his 1099-SSA form which shows that February payment was paid and included in his annual benefits total, even though they took it back! I've been trying to call the Social Security office for 3 days straight to fix this discrepancy but can't get through to anyone. The automated system keeps disconnecting me after 20+ minutes on hold. Would it be better to just go to my local SSA office in person for this kind of issue? Has anyone dealt with something similar after losing a spouse? I'm worried about tax implications since the 1099 shows income he didn't actually receive. Any advice would be appreciated. This whole process has been overwhelming.

I'm so sorry for your loss. Yes, going to your local office in person is definitely your best option for this situation. SSA has a rule that benefits are not payable for the month of death, so they were correct to reclaim that payment, but the 1099 should absolutely NOT include money that was taken back. Bring the 1099, your husband's death certificate, bank statements showing the deposit and withdrawal, and your photo ID. They can issue a corrected 1099-SSA. Make sure to get there at least 30 minutes before they open to avoid a long wait.

same thing happened when my wife died!! they took back her last check but the 1099 showed it anyway. RIDICULOUS SYSTEM! i went to the local office and waited 4 HOURS only to be told i needed an appt. total waste of time!!!

yeah eventually but took 3 months and they sent a corrected 1099. still had to file taxes late because of THEIR mistake!

Dealing with this stuff after losing ur husband is so unfair!! The government should make this easier on grieving people!!!! I think its so wrong they take back the check for the whole month even if someone dies at the end!! My uncle passed on the 29th and they still took his full check back!!!

It does seem harsh, but unfortunately that's the law as written. Congress would need to change it. The rule has been in place since the 1960s - a person (or their estate) is not entitled to benefits for the month of death, regardless of when in the month they died. They just asked for my late husband's SSN, my SSN as his widow, and some basic verification questions (address, DOB, etc). Once I was verified as having the right to discuss his record, they were able to help immediately. They even sent me an email confirmation of the request for my records.
