Social Security finally processing WEP/GPO Fairness Act applications for retired teachers!

Finally some good news! Wanted to share that SSA is actually processing applications for those affected by the WEP/GPO Fairness Act. I retired from Arizona teaching in 2019 and submitted my spousal benefit application online on January 15th after the new law passed. I was expecting a long wait but got a call yesterday from an SSA rep who finalized my application over the phone! They told me I'll be getting backpay from August 2024 through February 2025, with my first regular payment hitting in March. For those still waiting - they ARE working through the applications! Anyone else had their WEP/GPO application processed yet? Feeling relieved after 5 years of reduced benefits.

They just verified my teaching pension amount and made sure they had my correct direct deposit info. Also confirmed I was still married to my husband (sounds obvious but they checked). The rep mentioned they're prioritizing applications filed in early January first, so you should hear something soon!

This gives me hope!!! I'm a retired Ohio teacher (30 years) and filed January 12th but haven't heard a THING. Been calling SSA every week but can never get through to a real person. So frustrating when they just disconnect you after waiting for 2+ hours!!! Did they tell you how many applications they're processing or how long the backlog is? My financial advisor estimated I'm owed around $950/month that I've been missing out on for YEARS because of that unfair GPO reduction.

The backpay is calculated based on your application date, not a fixed date for everyone. The law took effect in January, but benefits are only paid from the month after you apply (with a possible 6-month retroactive period in some cases, though that typically doesn't apply to these WEP/GPO situations). If your cousin applied in August, then September would be the first month she'd be eligible for payment.

I'm so confused about all this WEP/GPO stuff. I worked as a California teacher for 22 years but also have enough credits for my own SS benefit. Does this new law mean I can get both my full teacher pension AND my full Social Security? Or just the spousal benefit? My husband's benefit is bigger than mine would be.

The GPO Fairness Act specifically addresses the Government Pension Offset, which previously reduced spousal/survivor benefits for those with government pensions. The Windfall Elimination Provision (WEP) that affects your own Social Security benefit remains in place, though it was modified. If your husband's SS benefit is larger than your own would be, you should definitely apply for the spousal benefit now. Before this law, your teacher pension would have reduced your spousal benefit by 2/3 of your pension amount, often eliminating it entirely. Now, you can receive your full spousal benefit (up to 50% of your husband's PIA) regardless of your teacher pension. The law is complex with phase-in periods, so I'd recommend applying right away and letting SSA calculate your specific situation.

Yes, the GPO Fairness Act absolutely applies to survivor benefits as well as spousal benefits. You should contact Social Security immediately to file for recalculation of your widow's benefit. Under the new law, your teacher pension will no longer reduce your survivor benefit. As a widow, you could be eligible for up to 100% of your late husband's benefit amount (depending on your age and when you claim).

For those waiting on calls, I'd recommend having all your paperwork ready. They'll likely ask for: 1. Verification of your government pension amount 2. Your marriage certificate (for spousal benefits) 3. Your spouse's Social Security number 4. Direct deposit information 5. Any months you've been receiving reduced benefits Having this information ready when they call will help process your claim faster. I'm so confused...I went to SSA office yesterday and the person told me they aren't processing these yet and to come back in April. But you all are saying you've gotten calls? Are different offices handling this differently?

The main processing is being handled by specialized units rather than local offices, which may explain why you got different information. I would recommend filing your application online immediately rather than waiting until April. Once it's in the system, it will be routed to the appropriate processing unit regardless of what your local office advised.

This is why I tell EVERYONE to file as early as possible when new benefits become available! My mother-in-law waited 3 months after the POMS update for GPO and now she's at the back of the line. The early bird gets the worm with SSA. Always file right away and let them sort it out.
