Can my boyfriend claim TWC benefits after being laid off then having short-term job that didn't work out?
My boyfriend got laid off from his construction job after they lost a major contract back in January. He immediately found a job at another construction company, but after only 3 weeks they let him go because they said he wasn't meeting their expectations (no write-ups or warnings though). He's been looking everywhere but hasn't found anything stable in 6 weeks now.\n\nCan he still file an unemployment claim based on the first job where he got laid off? Or does that short 3-week job mess everything up? I'm trying to help him figure this out because our savings are getting really low and his car payment is due next week. He worked at the first place for over 2 years if that matters.

Yes, he can still qualify for UI benefits! This is what's called a \

Thank you so much for explaining! That's a huge relief. I was worried that short job would disqualify him completely. I'll have him file the claim tonight when he gets home from job hunting.

My cousin had something similar happn and he got denied cuz they said he got fired from the 2nd job. Be careful how he answers the questions online!!

That's an important distinction. If TWC determines he was fired for misconduct from the second job, it could affect eligibility. However, since OP mentioned there were no write-ups or warnings, it sounds more like a \

I went through almost this EXACT situation last year! First tell him to gather all his paperwork from both jobs - paystubs, offer letters, and especially anything about the layoff from the first job. He should apply immediately and make sure to clearly explain that he was LAID OFF from the first job and that the second job just didn't work out after a short trial period.\n\nBUT be prepared for a phone interview. TWC will almost definitely want to talk to him about why the second job ended since it was so short. They'll also contact both employers. When I went through this, my claim was \

That's super helpful! Did you have trouble getting through to TWC during the pending period? He's not great with dealing with government stuff and I'm worried he'll get frustrated if he can't get answers.

Tell your boyfriend to focus on explaining why the second job ended without using negative language. If he says they \

This is really good advice about the wording. He tends to be pretty blunt so I'll make sure he phrases it carefully. Do you know if there's a way to see what the benefit amount might be before actually filing?

When i filed my claim they kept asking me for more info and it took FOREVER to get my first payment. Get ready to wait like a month before seeing any $$

Yeah, unfortunately that's pretty common these days... especially with cases that have multiple employers involved. Having clear documentation ready definitely helps though!

I had a similar situation trying to get through to TWC when my claim had multiple employers. The online system kept showing

Thanks for the suggestion! I'll keep this as a backup if he has trouble getting through. Fingers crossed it goes smoothly, but based on everyone's comments it sounds like he might need some help getting an actual person.

tell ur bf to make SURE he does his work search activities every week!!!! I got my benefits cut off because I only did 2 job searches in one week instead of 3. even if his claim is still pending he should start documenting them right away

This is excellent advice! Even while the claim is pending, he should complete and document at least 3 work search activities each week. If approved, TWC may request this information retroactively, and failing to meet the requirement could result in benefit denial for those weeks.

One more thing - make sure he requests payment exactly when scheduled, even if his claim is still pending. My boyfriend missed his first payment request date because he thought he needed to wait until the claim was approved, and he lost out on 2 weeks of benefits because of it. TWC is REALLY strict about those payment request schedules!

Oh wow I didn't even think about that! So he should request payment on the assigned dates even if the claim isn't approved yet? That's so confusing but thank you for mentioning it!

Just as an update, my claim with multiple jobs did eventually get approved and they based it on my primary employer where I'd worked longer, not the short job. But it took about 5 weeks total and I did have a phone interview. The agent was actually really understanding about the short job situation.

That's encouraging to hear. I'm hoping his case goes similarly. Did they backpay you for all the weeks once it was approved?

One final tip: If TWC schedules a phone interview about the job separation (which is likely with multiple employers), make sure your boyfriend is prepared with specific dates and details:\n\n1. The exact date he was laid off from the first job and the reason given\n2. The start and end dates at the second job\n3. The specific explanation given for why the second job ended\n4. Names and titles of supervisors at both companies if possible\n\nHaving this information readily available makes the interview go much smoother and helps the TWC agent make a quicker determination on the claim. Good luck!

Thank you so much! I'll help him put together all this information tonight. You all have been incredibly helpful - this was way more complicated than I thought but I feel like he has a good chance now.
