PA UC appeal hearing completed but employer no-showed - payment timeline questions

Had my PA unemployment appeal hearing this morning after waiting for nearly 2 months. My former employer didn't even bother to show up to the hearing! The referee still went through all my evidence and asked questions, but seemed pretty relaxed about everything. Now I'm wondering: 1) Does the employer no-show basically guarantee I'll win my appeal? 2) How long does it typically take to get the decision letter after the hearing? 3) If I win, how quickly will they release my backpay? I've got about $4,700 pending from all these weeks waiting for the hearing and I'm getting desperate at this point. Anyone been through this recently?

The employer not showing up definitely improves your chances, but it's not a 100% guarantee. The referee still has to determine if you were eligible based on PA UC regulations regardless of who shows up. That said, without anyone there to contradict your testimony, your version of events will likely be accepted. For your timeline questions: 1. You should receive the referee's decision by mail within 7-14 days 2. If the decision is in your favor, payments are typically released 3-5 business days after the decision is entered into the system 3. If you provided direct deposit info, the money arrives faster than waiting for the Money Network card Hope this helps and good luck!

Thank you so much! Does the 7-14 days include weekends? I'm literally counting the days at this point. Really hoping it doesn't take the full two weeks since I've already been waiting so long.

That's good to hear! I have direct deposit set up too, so hopefully it'll be quick. Did he get all his backpay at once or did they release it in chunks?

I wouldn't count on winning just because they didn't show up!!! My employer didn't show either and I STILL LOST MY APPEAL in December!!! The referee said some BS about me not meeting the burden of proof even though nobody was there to contradict me! THE SYSTEM IS RIGGED! Make sure you followed up with documentation even if they didn't show!!!

I was "let go" but they tried to say I violated company policy when I DIDN'T. I thought it would be easy to win since they didn't show but the referee said I didn't provide enough documentation to prove my side. RIDICULOUS!!!

I went through this exact situation in January 2025. Here's what I can tell you based on my experience: 1. The employer no-show significantly improves your chances, but the referee still needs to determine that you meet PA UC eligibility requirements. They'll review the employer's written statements if any were submitted. 2. Decision timeline: I received my decision letter exactly 9 business days after my hearing. The system updated online before I got the physical letter. 3. Payment timeline: My backpay hit my account 4 business days after the decision showed as "approved" in the system. One tip: Keep filing your weekly claims during this waiting period! Some people stop filing while waiting for an appeal decision, but you need to keep certifying to get paid for those weeks if you win. Also, if you're struggling to get updates by phone after your hearing, I found a service called Claimyr (claimyr.com) that got me through to a UC rep right away to check my claim status. They have a video demo at https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 showing how it works. Saved me hours of busy signals when I needed to verify my payment was processing.

Thank you for the detailed response! I've definitely been keeping up with my weekly claims even though it feels pointless sometimes. I'll check out that Claimyr service if I don't hear anything by the end of next week - the busy signals are driving me crazy.

Does anyone know if the appeal decision comes through the dashboard messages or just by mail? I'm worried about missing something important in my mailbox.

The official decision always comes by postal mail, but you'll also see your claim status change in the dashboard from "appeal pending" to either "eligible" or "ineligible" before the letter arrives. The dashboard won't show the detailed reasoning though - only the letter has that.

I'm in a similar situation waiting for an appeal decision and it's been 12 days already with no update... should I be worried? The stress is killing me.

12 days is still within the normal timeframe, especially if there were holidays or weekends in between. If you're approaching 15 business days with no decision, that's when I'd recommend calling to check on status. The appeal referees handle many cases, and sometimes there's a backlog depending on your region.

WATCH OUT FOR TAX WITHHOLDING on that backpay!!! If you get $4,700 at once, they'll take out a HUGE CHUNK for taxes unless you already selected your withholding preference!!! I got hit with this last year and only got about 70% of what I expected!!!

OMG I didn't even think about that! I'm pretty sure I selected to have taxes withheld when I first applied, but now I'm second-guessing myself. Is there a way to check my withholding selection before the payment goes through?

Yes, you can check your tax withholding preference by logging into your PA UC account, going to "Benefit Plan" and then "Update Personal Information." You'll see your current withholding selection there. You can change it before your payment processes if needed.

One more thing to keep in mind - if your appeal is successful, sometimes they don't automatically release all weeks at once. When I won my appeal, I had to call to get them to release all my back weeks because only the most recent two processed automatically. Just a heads up in case you don't see the full amount right away.

That's really good to know. If that happens, did you have to talk to a specific department to get the back weeks released? I'm taking notes on all this advice so I'm prepared.

Yes, ask specifically for the "Benefits Determination" department when you call. Regular reps sometimes can't help with appeal payment issues. And be prepared that you might need to call multiple times to get through - the phone lines are still terrible in 2025.
