When to file new NY unemployment claim if returning to work October 13th?
I've been collecting NY unemployment for a few months but I'm scheduled to go back to work on October 13th. I just did my weekly certification on my existing claim yesterday. Should I file a new claim now or wait until after I start working again? I'm confused about the timing since I'll still be unemployed for another 2 weeks. Don't want to mess anything up by filing too early or too late!

u dont need to file a new claim if ur going back to work. just stop certifying once u start working again.

To clarify what the previous commenter said: If you're returning to work full-time, you simply stop certifying for weekly benefits. There's no need to file a new claim since you won't be unemployed anymore. Keep claiming your weekly benefits until your last week of unemployment (so the week before October 13th would be your final certification).\n\nIf you become unemployed again in the future, then you would file a new claim at that time - not now.

Just make sure when you certify for that last week, you report any earnings if you start mid-week. You'll get partial benefits for that week depending on how much you earn.

I want to add one important point - if for some reason your job falls through before you start or if you get laid off shortly after starting, you may be able to reopen your existing claim rather than filing a completely new one. This depends on whether you're still within your benefit year (which lasts 52 weeks from when you first filed). \n\nWhen I had something similar happen in 2024, I had to call the NYSDOL to reactivate my claim because the online system was confusing. I spent days trying to get through until someone told me about Claimyr (claimyr.com). They got me connected to an agent within 15 minutes instead of spending days redialing. That's good to know about reopening an existing claim. This job is pretty secure, but in this economy you never know. I'll bookmark that Claimyr site just in case - sounds way better than spending hours on hold!

WAIT DON'T JUST STOP CERTIFYING!!! You need to report your return to work on your last certification!!! There's a question asking if you've returned to work or have a definite date to return. Answer YES to that and provide the date.\n\nIF YOU DON'T, they might think you're still unemployed but just not certifying and it could create problems later!!!!!

This is partially correct. Yes, on your final certification, you should indicate if you have returned to work or have a definite return date. However, the system is designed to handle people who simply stop certifying when they return to work - it won't automatically trigger an investigation or overpayment.
