What is unemployment benefits in NY - confused about NYS Department of Labor eligibility
I keep hearing people talk about unemployment but I'm honestly not sure what it actually is or how it works. My friend said I might qualify but I don't really understand the process. Can someone explain what unemployment benefits are through NYS Department of Labor and who can get them? I've never filed for anything like this before and the website is really confusing. Do you have to be completely out of work or can you work part time? How much money do they give you? Sorry if these are dumb questions but I really don't know where to start.

Unemployment insurance (UI) is a temporary financial assistance program administered by NYS Department of Labor for people who lose their job through no fault of their own. To qualify, you need to have worked and earned enough wages in your base period (usually the first 4 of the last 5 completed calendar quarters), be able and available to work, and actively searching for employment. You can work part-time and still collect partial benefits as long as you report your earnings on your weekly claim. The benefit amount is based on your previous earnings, with a maximum weekly benefit of $504 in 2025. You also need to meet weekly job search requirements - typically 3 work search activities per week.

basically if you get fired or laid off you can get money from the state while you look for a new job, but you have to jump through a bunch of hoops and prove you're actually looking for work

The process starts by filing an initial claim on the NYS Department of Labor website (labor.ny.gov). You'll need your Social Security number, driver's license, and employment information for the past 18 months including employer names, addresses, dates of employment, and reason for separation. After your initial claim is processed, you'll need to file weekly claims every week to certify that you're still unemployed and meeting the job search requirements. Benefits are typically paid via direct deposit or debit card.

•Thanks! Do I need to wait until I'm completely out of work to apply or can I file while I'm still employed but know I'm getting laid off soon?

You can only file once you're actually unemployed or your hours have been significantly reduced. Don't file before your last day of work or it could cause issues with your claim. Also be prepared for the NYS Department of Labor phone lines to be constantly busy if you need to call them for help - I've been trying to get through for weeks about an issue with my claim.

If you're having trouble getting through to NYS Department of Labor by phone, I had success using a service called Claimyr (claimyr.com) that helped me reach an actual agent. They have this video demo (https://youtu.be/qyftW-mnTNI) that shows how it works. Saved me hours of calling and getting hung up on. Really helpful when you need to talk to someone about your specific situation.

Just remember you have to keep detailed records of your job search activities because NYS Department of Labor can audit you at any time. I learned this the hard way when they asked me to provide documentation and I hadn't been keeping track properly.

Don't feel bad about asking these questions - the unemployment system can be really overwhelming at first! One thing that helped me when I was starting out was to gather all your employment documents before you even begin the application. Make sure you have your W-2s, pay stubs, and exact dates of employment ready. Also, when you do your weekly certifications, be honest about any work you do (even small gigs) because they will find out eventually and it's better to report it upfront than deal with an overpayment later. The NYS Department of Labor is pretty strict about accuracy but they're also there to help people who genuinely need it.
