Is unemployment public record in NYS - worried about privacy

I'm thinking about filing for unemployment benefits but I'm really concerned about privacy. Is unemployment public record that anyone can look up? I work in a small industry and I'm worried potential employers might find out I collected benefits. Does NYS Department of Labor share this information publicly or with employers? I've been putting off filing because I'm scared it will hurt my job prospects later.

No, your unemployment claim information is not public record. NYS Department of Labor keeps your UI claim details confidential under state privacy laws. The only entities that can access your unemployment records are you, authorized NYS Department of Labor staff, and in very limited circumstances, other government agencies for program integrity purposes. Employers cannot look up whether you received benefits unless you voluntarily disclose it.

That's such a relief! So even if I put my previous employer on applications, they can't find out I collected after they laid me off?

Your UI records are protected by federal and state privacy laws. The only way an employer would know is if you tell them or if they were the employer who laid you off (they get notified about claims against their account). NYS Department of Labor doesn't publish names or create searchable databases of claimants. Don't let privacy fears stop you from filing - you earned those benefits.

Yes, employers get notified when someone files against their account so they can respond if they want to contest the claim. But that's very different from it being public information.

I had the same worry when I got laid off last year. Filed anyway and never had any issues with background checks or new employers finding out. The NYS Department of Labor system is pretty secure about keeping that stuff private. Only thing that shows up publicly is if you commit unemployment fraud and get prosecuted, but that's completely different from normal claims.

I've been trying to get through to NYS Department of Labor for weeks to ask similar questions about my claim privacy but their phone lines are impossible!! Does anyone know if there's another way to reach an actual person there?

I actually found this service called Claimyr (claimyr.com) that helped me get through to NYS Department of Labor agents when I couldn't reach them myself. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Made it so much easier to get answers about my claim status without sitting on hold forever.

Thanks! I'll check that out because this is driving me crazy not being able to talk to anyone.

definitely not public record but honestly the whole system feels so invasive anyway with all the job search requirements and verification stuff they make you do

Just wanted to add that I work in HR and can confirm - we absolutely cannot access unemployment records during background checks or hiring processes. The only time we'd know is if an applicant voluntarily mentions it or if we're the company that laid them off originally. Your unemployment history is protected information, so don't let privacy concerns prevent you from getting benefits you're entitled to. The stigma around unemployment is outdated anyway - most employers understand that layoffs happen and it doesn't reflect poorly on you as a candidate.
