Does NYS Department of Labor unemployment cover maternity leave benefits?

I'm currently 7 months pregnant and trying to figure out what benefits I might be eligible for when my baby arrives. My employer doesn't offer paid maternity leave and I'm worried about how I'll manage financially during recovery time. I keep reading conflicting information online about whether unemployment benefits can cover maternity leave in New York. Does anyone know if NYS Department of Labor unemployment insurance covers time off for having a baby? I'm so confused about what programs are available and what I need to apply for.

Unfortunately, regular unemployment insurance through NYS Department of Labor doesn't cover maternity leave. UI benefits are specifically for people who are able and available to work but can't find employment. During maternity leave, you're not considered available for work. However, New York has Paid Family Leave (PFL) which is separate from unemployment and specifically designed for bonding with a new child. You should also look into Temporary Disability Insurance if you have complications during pregnancy or recovery.

Thank you! I had no idea these were separate programs. Where do I apply for Paid Family Leave? Is it through the same my.ny.gov website as unemployment?

my sister went through this last year and it was so confusing! she thought she could get unemployment too but found out the hard way that UI and maternity benefits are totally different things. the paid family leave only covers like 12 weeks though so plan accordingly

Actually, PFL in New York covers up to 12 weeks at 67% of your average weekly wage, with a cap. It's not administered through NYS Department of Labor unemployment system - it goes through your employer's insurance carrier or the state if you're self-employed.

Wait I'm confused - if I quit my job to have a baby, can I get unemployment benefits after my maternity leave is over? Or does quitting disqualify me completely from NYS Department of Labor benefits?

If you voluntarily quit your job, you're generally disqualified from unemployment benefits unless you can prove you had good cause related to the work itself. Quitting for maternity leave wouldn't typically qualify. However, if you're laid off or terminated after returning from leave, you could potentially be eligible for UI benefits.

That's what I was afraid of. The whole system seems designed to make it as hard as possible for new parents.

I had such a hard time reaching anyone at NYS Department of Labor when I was trying to figure out benefit eligibility during my pregnancy. Spent hours on hold just to be told I needed to call a different department. If you need to actually talk to someone about your specific situation, I found this service called Claimyr (claimyr.com) that helped me get through to an agent quickly. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me so much frustration when I needed answers about my claim status.

Thanks for the tip! I'll definitely check that out if I can't get through on my own. The phone system is already driving me crazy and I haven't even applied for anything yet.

just had my baby 3 months ago - definitely apply for the paid family leave as soon as possible after birth! there's paperwork your doctor needs to fill out and it takes forever to process. also keep all your medical records organized because they might ask for additional documentation

Congratulations on your pregnancy! I went through this same confusion when I was expecting my first child. Just to clarify what others have mentioned - you're absolutely right that regular NYS unemployment insurance won't cover maternity leave since you need to be "able and available" for work to qualify. However, New York does have great programs specifically for new parents. Paid Family Leave gives you up to 12 weeks at 67% pay for bonding time, and if you have pregnancy complications, Temporary Disability Insurance can help with recovery time. The key is understanding these are completely separate from the Department of Labor's unemployment system - they're administered through different channels. Start gathering your paperwork now and talk to your HR department about the process. Don't let the bureaucracy stress you out during this special time!

This is such helpful advice! I'm also expecting my first and had no idea these programs were separate from regular unemployment. Quick question - you mentioned talking to HR about the process. What if my employer is really small and doesn't have an HR department? Do I need to go through them for Paid Family Leave applications or can I apply directly somewhere? I'm worried my boss might not know much about these programs either.
