Company suddenly shut down - how long will NY unemployment take to process my claim?
My employer unexpectedly closed their doors last month due to financial problems. They gathered everyone in a meeting on a Friday afternoon and announced the company was folding due to insolvency. We were all handed our final checks and the company's tax ID number, then basically told to file for unemployment. I submitted my claim online about 3 weeks ago and it shows I'm in my waiting week currently. Does anyone know the current timeline for NY unemployment to actually approve claims and start paying benefits? Back during the pandemic it was taking people 8-12 weeks to get a decision. Has this improved at all? I've got rent coming up and savings are getting tight. This is my first time applying for benefits so I'm not sure what to expect.

Im really sorry this happened to you. The timeline is so unpredictable these days. Mine took about 4 weeks to go from 'waiting week' to actually receiving benefits. Make sure your checking your emails and mail for any requests for additional docs or info. If they need anything else and you dont respond, the whole process starts over!!

•Thanks for the reply. Did you have to do anything special during this waiting period? I'm checking my mail everyday and my email spam folder too.

•No problem! Just make sure to keep doing your weekly certifications even if you havent been approved yet. They'll backpay you for those weeks if/when you get approved.

•this is important advice 👆 I missed a certification week thinking "why bother if I'm not approved" and it messed everything up

After dealing with endless busy signals and never getting through to anyone at unemployment, I finally found this service called Claimyr that got me connected to a real person at NY unemployment. Totally worth it - got my case resolved in one phone call when I'd been stuck for weeks. They basically wait on hold for you then connect you when a rep picks up. Here's a video about how it works: https://youtu.be/Rdqa1gKtxuE

•Sounds like an ad. Does this actually work? I've been trying to get through for almost a month now.

•Yeah i was skeptical too but it honestly worked. I was going crazy trying to get through the regular way. Talking to someone directly got my payments released in 2 days after being stuck for weeks. Best money I ever spent considering how much back pay I got.

•wait so this thing just calls for you? I don't get it

•It keeps dialing and stays on hold so you don't have to. When a real person answers, it calls your phone. I wasted like 20+ hours trying to get through myself before using this.

•I mean, they solved my problem when nobody else could so... 🤷♀️ After 6 weeks of no benefits I was desperate. One call with an actual agent fixed everything.

Took me 5 weeks to get approved last summer from when I submitted, and another 2 weeks to get the money. So 7 weeks total. The system is still slow but better than covid times. Hang in there!

Since your company went bankrupt that actually might speed up your case. They'll be able to verify the closure easier than if it was some dispute with an active employer. I'd guess 3-4 weeks from your waiting week. But if you need to talk to someone try claimyr.com - only way I could ever get through.

•That's good to know! I'll give it another week before I start panicking then. Do you know if they're good about providing backpay for the weeks during processing?

•Yes, they'll backdate to when you first applied (minus the waiting week). Just make sure you're doing your weekly certifications!

Was in almost identical situation in February. The whole process took 6 weeks from application to first payment. Make sure you're still doing your weekly certifications even during the waiting period!!! I missed one week and it caused a huge headache.

The current average wait time in New York is 4-6 weeks for straightforward claims where everything checks out. In cases where the employer went out of business, there can be additional verification steps needed, but since you have the FEIN that should help. Here's what you should be doing while waiting: 1. Keep filing your weekly certifications without fail, even if you haven't been approved yet 2. Check your online account for any messages or requests for additional information 3. Lookout for letters in the mail 4. If it goes beyond 6 weeks, you need to speak with someone Getting through on the phone is nearly impossible through normal channels. I recommend using claimyr.com to connect with an agent - they handle the hold times and get you through. In my experience as a career counselor, I've seen many clients get their issues resolved in one call once they actually reach a human. Also, document everything. Keep a record of when you filed, any confirmation numbers, and any communication received. If you need to escalate later, this documentation will be crucial.

•Thank you for such a detailed answer! This is super helpful. I'll keep certifying weekly.

•This is spot on advice. The FEIN definitely helps speed things up - my claim took forever because my employer disputed it, but with a bankruptcy situation it should be more straightforward.

Hot tip: call your state assemblyperson or state senator's office! My claim was stuck for 7 weeks, called my assemblyman's office, and they have special contacts at unemployment. Got my benefits 3 days later.

•This! 💯 The regular customer service people have no power. Your elected officials can actually get things done.

•how do you find out who your state assembly person is? sorry if thats a dumb question

•Not dumb at all! Go to nyassembly.gov and enter your address in the 'find my representative' tool. Same for nysenate.gov if you want to try your senator instead.

If you can prove your employer went bankrupt your chances of approval are very high, like 95%+ as long as you were a W2 employee and not a contractor. The timeline is still bad but not COVID-era bad. I'd expect 3-6 weeks total.

Make sure ur answering all the questions about job search correctly when u certify! They denied me bcuz I said I wasn't looking for work one week (I was sick). Had to appeal and it took 3 extra months to get paid.

•THIS!!! They are super strict about the work search requirements now!

•Good to know - I've been applying to jobs but wasn't sure how strict they are about that now.

•You need to document at least 3 work search activities each week. Keep a record of every job you apply for, networking event, resume update, etc.

If your bank account is getting low while waiting, apply for SNAP benefits too! Many people don't realize they can get food assistance while waiting for unemployment to come through.

•Thank you, I hadn't thought of that. Will look into it tomorrow.

My sister works for NY DOL (not unemployment specifically). She says they're currently processing claims from about 4-5 weeks ago on average. So if you just applied 3 weeks ago, you probably have another 1-2 weeks minimum before someone looks at your claim.

everybody saying 4-6 weeks must have easy cases. i had a slightly complicated situation (worked 2 jobs, got laid off from the full-time one) and it took 11 weeks to get approved. and when they finally paid, they shorted me like $1800 that i'm still fighting for 2 months later.

•Same! My situation wasn't even that complicated and still took 10 weeks. The system is broken.

Yo check if ur eligible for partial unemployment while you wait! If you do ANY work, even like a one-day gig, you can report it and potentially get some money while waiting for full approval. Just be honest about the hours/money earned.

I used to work for the DOL (quit last year). The inside scoop: bankruptcy cases actually get prioritized somewhat because they're easier to verify and less likely to be contested. If you have all your ducks in a row, you should see movement within 4-5 weeks. If it goes longer, something is flagged in your account and you NEED to speak with someone. The call center reps can see what's holding things up.

Alfredo Lugo
•That's really good to know, thank you! Is there any way to check if something is flagged in my account?

Serene Snow
•Not really - the online system is terrible. You need to talk to a rep. Since you're at 3 weeks, I'd give it one more week then try to get through on the phone. Use claimyr.com if you can't get through the normal way.

Anybody know if they're still making people wait an extra 10 business days after approval before releasing the first payment? That happened to my roommate back in January.

•They did that to me too in March! Approved then still had to wait almost 2 more weeks for $$ to hit my account 😤

•i think they do that for first-time claimants as an extra fraud check. if you've collected before it's faster.

the system is completely clogged rn because of all the tech layoffs hitting NY. my friend who works in the UI office said they're getting 3x the normal applications since april.

I was in the EXACT same situation! Company went under with no warning. If you have the FEIN that's HUGE - they can verify your claim much faster. Mine took 5 weeks from application to first payment once I got someone on the phone. I couldn't get through for weeks until I tried claimyr.com - totally worth it, got my backpay released in one call.
