Can you apply for unemployment after disability benefits end in NYS?

My disability benefits through Social Security ended last month because my condition improved enough that I'm cleared to work again. I've been out of the workforce for about 18 months and I'm job searching but haven't found anything yet. Can I apply for NYS Department of Labor unemployment benefits even though I was on disability? I'm worried they'll say I wasn't working before so I don't qualify. Has anyone been in this situation before?

You might be able to qualify but it depends on your work history before the disability period. NYS Department of Labor looks at your earnings in the base period which is usually the first 4 of the last 5 completed quarters before you file. If you worked enough before going on disability, you could still have qualifying wages.

That's helpful! I was working full time for about 3 years before I went on disability, so hopefully that counts for something.

yeah i think you can but you have to prove youre able and available to work now. since you were on disability they might question that part

The base period calculation is what matters, not the length of disability. If you have qualifying wages in your base period, the length of time since working shouldn't disqualify you as long as you're now able and available.

They wanted the letter from Social Security about my benefits ending and a clearance note from my doctor. Wasn't too bad once I actually got to talk to someone who understood the situation.

Just make sure you file as soon as possible if you're eligible. The waiting week and all that starts from when you file, not when you figure out if you qualify.
