Can ny unemployment forfeit penalties be resolved by phone call instead of appeal?
Got hit with a forfeit penalty back in November after they said I underreported some income from my part-time gig in August. Now they want me to forfeit 7 weeks of future benefits! Called the regular number and waited 3 hours just to be told I might need to appeal. Has anyone actually resolved a forfeit by just talking to someone on the 209 number instead of going through the whole appeal process? The deadline for appealing is coming up next week and I'm stressing about whether to bother with the appeal paperwork or just keep trying to call. Any advice would be really helpful right now.

I had to deal with a forfeit penalty last spring - they said I didnt report a freelance job I did. From my experience you HAVE to file the appeal. Calling the 209 number is useless, they just tell you to appeal anyway. When I finally spoke to an agent they literally said "I see the issue but I cant do anything about it over the phone" 🙄

•Yeah I won but it took like 3.5 months 😩 Make sure you include any evidence you have - payslips, screenshots, whatever. The more proof the better!

The 209 number is TRASH. I spent 5 hours on hold last month and when I finally got through the agent said forfeit days can only be adressed thru formal appeal. such a waste of time. My advice: just file the appeal now especially since ur deadline is coming up soon. Dont wait.

Here's what you need to know about forfeits: 1) Technically agents CAN fix some forfeit issues by phone if it's a clear system error, but most won't because they're afraid of getting in trouble 2) Always file the appeal before the deadline - you can always withdraw it later if you resolve by phone 3) If your forfeiture is under 8 weeks, sometimes it's faster to just accept it than fight through the appeal process which can take 4+ months 4) If you do call, ask specifically for a "forfeit day specialist" - regular agents often don't know how to handle these 5) Document EVERYTHING - note who you spoke to and when Good luck!

I had a 10-week forfeit for "misreporting income" (i actually reported everything correctly but whatever). Filed appeal AND kept calling. Eventually got someone on the phone who reviewed my case and removed the forfeit penalty RIGHT THERE on the call. So yes, it CAN be done by phone if you get the right person who knows what theyre doing. Keep trying both routes!

NY unemployment system is so broken its not even funny. I had 4 forfeit weeks and spent literally 45+ hours on the phone trying to fix it. Ended up just taking the hit and waiting it out cause the appeal process moves at glacial speeds. If ur only looking at 7 weeks honestly might be easier to just accept it and move on with ur life. 🤡 system

protip for these forfeit situations: call early in the morning right when they open (like 7:59am) and you have better chance of getting thru. Also try the claimyr.com service if ur desperate - worked for me when i needed to fix my claim fast

ALWAYS FILE THE APPEAL!!!!! even if u think u can resolve by phone. The appeal deadline is strict and if u miss it ur completely screwed. You can always cancel the appeal later if u fix it another way.

i had a similar situation and tried EVERYTHING. called the 209 number like 50 times, got hung up on constantly, finally got someone after 3 days of trying and they told me they couldnt help with forfeits over the phone. the NEXT day i called again and got someone else who fixed it in 5 minutes. so its totally random if you'll get someone who can/will help. its like gambling lol

Been there done that. heres the 3 things u need to know about NY unemployment forfeit days: 1. Most phone agents will say they cant help with forfeits over the phone EVEN THO THEY CAN 2. Appeals take forever but have higher success rate than phone 3. If you absolutely need someone on the phone fast use claimyr.com - costs $ but they got me to an agent in under an hour and saved my sanity The system is designed to wear you down so don't give up! 💯

Don't forget to check your online message center! I had a similar forfeit problem and they actually sent me a form through the portal that I had to fill out. Never got an email notification about it and almost missed the deadline. They hide stuff in there sometimes.

The whole NY unemployment forfeit system is messed up. They're hitting everyone with these penalties for tiny mistakes that are often their system's fault. Calling the 209 number is like trying to win the lottery - possible but unlikely. File the appeal for sure, but also try calling. Just my experience but a month ago I had a forfeit issue and managed to get it resolved over the phone. The trick was I kept calling different days until I found an agent who actually knew what they were doing (took me 6 attempts). So yes it CAN be done by phone but you might have to be persistent and get lucky with who answers.
