Can I still claim NY unemployment back pay in 2025 if I never received it before?

I filed for ny unemployment last November and got approved but never received any back pay from the weeks I was eligible before my application was processed. It's been 3 months now and I'm wondering if I can still get that money? I never got any notification about it and wasn't sure if I needed to do something special to claim it. Has anyone successfully gotten back pay after this long? Should I try calling the claims center or is it too late now?

Yes! You can definitely still get your back pay, but you'll need to specifically request it. NY unemployment back pay doesn't automatically process in many cases, especially if there was any issue with your initial claim. Call the claims center and explain your situation - make sure to have your claim information ready including the exact weeks you're missing payments for.

Thanks for the quick response! Do you know if there's a specific department I should ask for when I call? I've tried calling the main unemployment number a few times but I can never get through to a real person.

You're entitled to any benefits you were eligible for, even if it's been 3 months. Back pay (or 'retroactive benefits' as they're officially called) can be requested anytime within a year of your claim date. You NEED to speak with an agent though - this isn't something you can do through the website. Make sure to mention 'retroactive benefits' specifically when you call.

That's such a relief! I was worried there was some 60-day rule or something. I'll definitely use that term 'retroactive benefits' when I call. Thanks!

Ugh, that's what I'm afraid of... I tried last week and gave up after being on hold for 45 minutes.

I just went through this exact same situation! Waited 4 months thinking they'd eventually send the backpay automatically but nope. Finally managed to get through to someone last week and they're processing my backpay now - should be about $2,870 for the three weeks I was owed. But yeah, phone system is absolute nightmare...

That's awesome you finally got it! Did they give you any hassle about waiting so long to call about it?

I had this same issue back in January. After trying to call for weeks with no luck, I finally used Claimyr (claimyr.com) to get through to an agent. They basically call for you and connect you once they get through. Saved me hours of frustration. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE When I finally got through, the agent processed my back pay for the 4 weeks I was owed. Took about 3 business days to hit my account after that.

does that service actually work? seems sketchy to me

0 coins

Yeah it's legit. I was skeptical too but was desperate after trying for 3 weeks to get through. They don't access your unemployment account or anything - they just connect the call once they get through to NYSDOL.

I work in HR and deal with this ALL THE TIME with our laid-off employees. Here's the official deal with NY back pay in 2025: 1. You are entitled to retroactive benefits for any weeks you were eligible and certified for 2. There is a 1-year limit from your initial claim date to request these payments 3. You MUST speak with an agent - the online system cannot process retroactive payments 4. You need documentation showing you were eligible during those weeks 5. If approved, payment usually comes within 5-7 business days Call first thing Monday morning (7:59am) for your best chance of getting through without waiting for hours.

This is really helpful info! When you say documentation, what exactly would I need? I have my approval letter but not sure what else to gather before calling.

Your approval letter is good. Also have ready: - The exact dates of the weeks you're claiming - Any confirmation emails/texts from when you certified those weeks - Your income documentation from that period (to verify you were unemployed) - Your claim confirmation number Basically anything that proves you were eligible during those specific weeks. The more documentation you have, the smoother it will go.

This happens ALL THE TIME. The system is BROKEN!!! I had to fight for 4 months to get my back pay and even then they shorted me $780!!! You have to call and call and call until you get someone who actually knows what they're doing because half of them will tell you wrong information. The worst part is they never tell you that you need to specifically request retroactive benefits - they just assume everyone knows this???

Oh no, that's frustrating they shorted you! Did you end up getting the full amount eventually?

I did but it took filing an appeal and waiting ANOTHER 6 weeks. Make sure when you call you get confirmation numbers for EVERYTHING and write down the name of who you talk to. Trust me on this.

Just be prepared when you call - I got through after like 2hrs on hold but then got disconnected when they transferred me to a specialist. Had to start all over the next day! So frustrating!

That's encouraging! I'm only owed for about 4 weeks but that's still a decent amount of money I could really use right now.

Just an update - the current NY unemployment system actually has improved a bit in 2025. If you request back pay now, they're processing most claims within 7-10 business days. Much better than the 3-4 weeks it was taking last year. Just make sure when you call to specifically request to speak with a Retroactive Payment Specialist, not just any agent.

Thanks for this tip! I'll definitely ask for a Retroactive Payment Specialist specifically.

UPDATE: I finally got through today! Used that Claimyr service someone mentioned and got connected to an agent in about 20 minutes. The specialist confirmed I'm owed for 4 weeks of back pay, totaling about $2,180. She said I should receive the payment within 5-7 business days. Thanks everyone for your help and advice! For anyone else in this situation - definitely call and specifically ask about retroactive benefits, they don't process automatically!

Congrats! Glad it worked out for you! Let us know when you actually get the money.

Great news! That's exactly how the process is supposed to work. The payments should hit your account the same way your regular benefits did - either direct deposit or the debit card depending on what you set up.

That's awesome Paolo! Thanks for updating us - this gives me hope for my own situation. I'm dealing with something similar and was getting discouraged by all the phone horror stories. Definitely going to try that Claimyr service now.

@Paolo Conti That s'fantastic news! Really happy it worked out for you. Your story is super encouraging for those of us who are still fighting the system. I ve'been dealing with a similar back pay issue for about 6 weeks now and was starting to lose hope. Definitely going to try that Claimyr service - 20 minutes sounds like a miracle compared to the 3+ hour waits I ve'been experiencing. Thanks for keeping us updated and proving that persistence pays off!

@Paolo Conti Congratulations on finally getting this resolved! Your persistence really paid off. I m'curious - when you spoke with the Retroactive Payment Specialist, did they mention anything about interest or penalties for the delay? I m'in a similar boat and wondering if NY adds any compensation for their processing delays. Also, did they give you a specific timeline for when the funds would actually hit your account?

This is such a helpful thread! I'm in a similar boat - filed for NY unemployment in January and have been missing back pay for about 3 weeks. Reading through everyone's experiences, it sounds like the key things are: 1) Call and specifically ask for a "Retroactive Payment Specialist", 2) Use the term "retroactive benefits" when explaining the issue, and 3) Have all your documentation ready including exact dates and confirmation numbers. Really encouraging to see @Paolo Conti got it resolved! Going to try calling first thing Monday morning at 7:59am like Emma suggested. Thanks everyone for sharing your experiences - this community is so valuable for navigating these confusing systems!

This thread has been so helpful! I'm bookmarking it for reference. One thing I'd add for anyone calling - make sure you have a pen and paper ready to write down confirmation numbers and the agent's name/ID number. I learned this the hard way with other government agencies. Also, if you get disconnected or transferred, don't hang up immediately - sometimes they can call you back if you stay on the line for a minute or two. Good luck to everyone dealing with this - it's frustrating but clearly possible to resolve with persistence!

Just want to add that if you're still having trouble getting through by phone, you can also try contacting your local state assembly member's office. I know it sounds weird but they actually have dedicated liaisons who can help with unemployment issues. I did this last year when I was stuck in appeals hell and they got my case moving within a week. Most people don't know this is an option but elected officials' offices deal with NYSDOL problems all the time. You can find your assembly member on the NY State Assembly website - just search by your zip code. Worth trying if the phone system keeps failing you!

That's such a great tip @Cedric Chung! I had no idea that assembly members could help with unemployment issues. I've been struggling with the phone system for weeks and this could be a game changer. Do you remember roughly how long it took for them to respond when you first reached out? And did you need to provide any specific documentation when you contacted them? This seems like it could be especially helpful for people who've been trying the phone route unsuccessfully for months. Thanks for sharing this - definitely going to look up my assembly member as a backup plan!
