Can I sell stuff while on unemployment - NYS Department of Labor rules?

I've been collecting unemployment for about 6 weeks now and things are getting tight financially. I have a bunch of old electronics, furniture, and clothes I could sell on Facebook Marketplace or eBay. Does anyone know if this counts as income that I need to report to NYS Department of Labor? I don't want to mess up my benefits but I really need the extra money. Some of this stuff has been sitting in my garage for years so it's not like I'm running a business or anything.

Generally speaking, selling your personal belongings that you already owned before filing for unemployment shouldn't count as earnings you need to report. NYS Department of Labor considers this liquidating assets, not generating income. However, if you're buying items specifically to resell for profit, that would be considered self-employment income and must be reported on your weekly claim certification.

Thanks! So my old Xbox and some furniture should be fine? I'm definitely not buying anything new to flip.

yeah i sold my bike and some other random stuff last year while on UI and never had any issues, just dont start a whole business lol

Be careful though - if you sell a lot of items regularly, NYS Department of Labor might consider it self-employment even if it's your own stuff. The key is whether it looks like a business activity. One-time sales of personal property are usually fine, but if you're posting stuff for sale every week it could be problematic. Also keep records of what you sell and for how much, just in case.

This is good advice. I had a friend who got in trouble because he was selling stuff on eBay almost daily and they said it counted as work. Better to be safe and maybe space out the sales.

I was in a similar situation last year and couldn't get through to anyone at NYS Department of Labor to ask about this. Spent hours on hold just to get disconnected. Finally found this service called Claimyr (claimyr.com) that helped me reach an actual person at the unemployment office. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Honestly saved me so much stress being able to get real answers about what I could and couldn't do while collecting benefits.

Oh interesting, I've been trying to call them for weeks about another issue. How long did it take?

Way faster than trying on my own. They handle the calling part so you don't have to sit there hitting redial all day.

The unemployment system is so confusing about this stuff! Like why can't they just give clear guidelines about what counts as income? I'm scared to do anything that might affect my benefits but I also need money for groceries. This whole process makes me so anxious.

Just to clarify the main rule: if you owned the items before becoming unemployed and you're selling them at or below what you originally paid, it's not considered income. It only becomes reportable income if you're making a profit through regular sales activity or if it constitutes self-employment. Keep it simple and occasional and you should be fine.

I'm in a similar boat and was worried about this too. From what I've researched, the NYS Department of Labor website actually has a section on "other income" that mentions selling personal property usually doesn't count as wages if it's stuff you already owned. The tricky part is they want you to report ANY income over $405 per week, but selling your own belongings typically falls under "liquidating assets" not "earning income." I'd suggest keeping receipts showing what you originally paid for items if you have them, just to prove you're not making a profit. Also maybe don't sell everything at once - spread it out over a few weeks to avoid any red flags.

That's really helpful advice about keeping receipts! I never thought about proving I'm not making a profit. Do you happen to know if there's a specific dollar amount that would raise red flags with the department? I'm probably looking at maybe $200-300 total from selling my old stuff but want to make sure I'm staying under any thresholds.

I went through this exact situation a few months ago! Sold my old gaming console, some books, and kitchen appliances I wasn't using. The key thing I learned is that NYS considers it "liquidating personal assets" rather than income as long as you're selling items you already owned before filing for unemployment. I kept a simple list of what I sold and roughly what I originally paid for each item (didn't need exact receipts for everything). The $200-300 range you're talking about shouldn't be an issue at all - I sold about $400 worth of stuff over 2 months with no problems. Just avoid making it look like a regular business activity and you should be fine. The stress of worrying about it was way worse than actually doing it!

This is really reassuring to hear from someone who actually went through it! I've been so stressed about potentially messing up my benefits. The idea of keeping a simple list is smart - I can definitely do that. Did you report any of those sales on your weekly certification, or did you just keep the records for your own documentation? I'm probably overthinking this but I'd rather be safe than sorry with the Department of Labor.
