Tax Advocate Service Rejecting 2024 Cases - What Now?

Just got off the phone with the Taxpayer Advocate Service and they flat out told me they're not taking 2024 cases right now. What the actual hell? The IRS has completely lost it. I've been trying to resolve this for weeks as a 1099 contractor and now I'm just hitting walls everywhere. I'm calling back tomorrow to try a different representative and updating my W-4 at work to exempt status until this gets sorted. Anyone else running into this ridiculous roadblock? Need to figure this out ASAP before my quarterly estimates are due.

Oh no, I'm so sorry you're dealing with this! 😫 The TAS is probably overwhelmed right now with the filing season in full swing. It's so frustrating when you're trying to do the right thing and can't get help! Have you tried calling the regular IRS line instead? Sometimes they can actually resolve issues without needing to escalate to TAS.

According to the IRS.gov site, TAS is only accepting cases that meet specific hardship criteria right now. Has anyone actually gotten through to a real person on the regular IRS line? I've been trying for days with no luck.

Are you specifically changing to exempt status on your W-4 or just adjusting your withholding? I went through something similar last year when I had both W-2 and 1099 income, and completely exempting yourself can trigger automated notices. When I did that, I ended up with a CP2000 notice six months later and it was a whole other headache to deal with.

I think there might be some confusion about what changing your W-4 to "exempt" actually does. It doesn't really exempt you from anything related to your 1099 work, it just stops withholding on your W-2 income. You might, potentially, be setting yourself up for a larger tax bill next year, especially if you're also earning 1099 income that doesn't have any withholding at all. Just something to consider, possibly.

Trying to reach the IRS right now is like trying to get front row tickets to a sold-out concert - technically possible but practically impossible. Got connected to an actual agent in under 30 minutes who explained that TAS is currently only accepting cases with demonstrated financial hardship or where the IRS has made a processing error. Regular cases are being deferred until after the filing season rush.

Per Internal Revenue Code § 7803(c), the Taxpayer Advocate Service is required to assist taxpayers experiencing 'significant hardship' as defined in the code. However, during peak filing periods, TAS is permitted under Treas. Reg. 301.7811-1 to prioritize cases. Claiming exempt status incorrectly could violate IRC § 6682 and result in penalties.

I called TAS on April 2nd and got the same response. The representative told me they're focusing only on cases with immediate financial hardship until May 1st. Maybe try calling again after that date? In my case, I just documented everything carefully and kept a log of all my calls and who I spoke with. It might help your case later.
