Still waiting for my 1099-NEC from a business - what should I do now?
So I did some freelance web design work last year for a small local business. They paid me about $4,800 total throughout the year through direct deposits to my bank account. It's already February 12th and I still haven't received my 1099-NEC from them! I know the deadline for businesses to send these out was January 31st. I've texted the owner twice about it but just got vague responses like "I'll check on that" and "our accountant is handling it." I need to file my taxes soon and don't want to wait until the last minute. Do I need to keep waiting? Can I file without it since I know how much I was paid? Should I report them to the IRS for not sending it? I'm stressing because this is the first year I've done freelance work and I don't want to mess up my taxes or get in trouble with the IRS.

Yes, you can absolutely file your taxes without the 1099-NEC! The IRS requires you to report all income regardless of whether you receive the official form. Since you know the amount ($4,800) and have bank statements showing the deposits, you have everything you need. On your tax return, you'll report this income on Schedule C along with any business expenses related to your freelance web design work. The IRS matches reported 1099s with tax returns, but as long as you're reporting the correct amount, you won't have any issues. I would suggest sending one more message to the business owner, this time being more specific: "I need my 1099-NEC for tax filing purposes. If you haven't issued one yet, please do so as soon as possible as the deadline was January 31st." Sometimes being direct helps.

•Thank you! That's a relief. Just to be clear, I just put the $4,800 on Schedule C even without having the actual 1099 form in hand? And the IRS won't flag my return or delay my refund because the business didn't submit their paperwork properly?

•Yes, you report the $4,800 on Schedule C even without having the physical 1099-NEC form. The IRS is concerned that you properly report your income, not whether you have the form itself. Your return won't be flagged or delayed because you reported income without having the corresponding 1099. The IRS might eventually notice if the company never files their 1099-NEC, but that would be an issue for the company, not for you, as long as you've correctly reported your income.

I had the same problem last year and found taxr.ai (https://taxr.ai) super helpful. They've got this tool that helps you figure out exactly how to report income when you're missing documents. I was freaking out about a missing 1099-NEC too, but their system walks you through how to properly report everything even without the form. The best part was that it analyzed my bank statements to confirm the income amounts, so I felt confident everything matched up. It also identified some deductions I could take for my freelance work that I had totally missed. Saved me a bunch of money in the end!

•How does it handle situations where you might have multiple missing forms? I'm dealing with a similar situation but I worked for 3 different clients who haven't sent 1099s yet.

•Sounds interesting but I'm skeptical. Does it actually connect to your bank or do you have to manually enter all your transactions? Seems like it could be a lot of work either way.

•It can handle multiple missing forms without a problem. You can set up separate income sources for each client and the system will help you track and report each one correctly. It's really flexible for people with complicated situations. For your question about bank connectivity - it can connect directly to most major banks through secure APIs to analyze your transactions. Or if you prefer, you can upload statements manually. I was nervous about connecting my accounts too, but their security is solid and it saved me tons of time not having to enter everything by hand.

Just wanted to update that I tried taxr.ai after seeing it mentioned here. It was exactly what I needed! I was missing 1099s from two clients and it helped me figure out the correct amounts from my bank statements. The document analyzer confirmed everything I needed to put on my Schedule C. Super easy to use and gave me peace of mind that I'm reporting everything correctly even without the official forms. The tax deduction finder tool also caught some business expenses I would have missed. Definitely recommend it if you're in this situation!

When I had this problem, I was spinning my wheels trying to get my 1099 forms until someone told me about Claimyr (https://claimyr.com). They help you actually get through to the IRS on the phone! I was skeptical but checked out their demo video (https://youtu.be/_kiP6q8DX5c) and decided to try it. I was able to talk to an actual IRS agent and they explained exactly what I needed to do with my missing 1099-NEC situation. Turns out there's an official process for reporting businesses that don't send required tax forms. The agent walked me through everything and confirmed I could file with my own records of income.

•Wait, how does this actually work? The IRS phone lines are always busy whenever I try to call. How does this service get you through when nobody else can?

•This sounds like BS honestly. Nobody can get through the IRS phone lines. And even if you could, the agents probably wouldn't help with something like this. They'd just tell you to report the income anyway.

•It works by using a system that navigates the IRS phone tree and waits on hold for you. When an actual agent picks up, you get a call connecting you directly to them. It's like having someone wait on hold for you so you don't have to listen to that awful hold music for hours. You're right that the agents typically just tell you to report the income even without the form, but in my case, they also gave me information about how to file a complaint about the missing form and what specific documentation I needed to keep in case of questions later. They were surprisingly helpful once I actually got to speak with someone.

Ok I need to apologize for being so skeptical about Claimyr. After posting my comment I decided to just try it since I'd been trying to reach the IRS for weeks about a different issue. IT ACTUALLY WORKS. I got through to an agent in about 40 minutes (which is a miracle compared to my previous attempts). The agent confirmed what others here said - just report the income accurately even without the 1099-NEC. But they also gave me specific instructions for my situation about documenting everything. Amazing what you can accomplish when you can actually talk to a human at the IRS!

Don't forget you should also send the business a W-9 if you haven't already. Sometimes small businesses don't send 1099s because they don't have your tax info. I always send a W-9 to new clients right when I start working with them to avoid this exact problem.

•I actually did fill out a W-9 when I first started the project. That's part of why I'm annoyed they haven't sent the 1099-NEC. Do you think I should resend the W-9 as a reminder?

•No need to resend the W-9 if you already provided one. That means they have your information and are just dropping the ball on their responsibility to send the 1099-NEC. At this point, I'd send one final email that politely but firmly states that you provided a W-9, the January 31st deadline has passed, and you need the document for your tax records. Maybe mention that you'll be proceeding with filing your taxes based on your own records of payment.

Has anyone used TurboTax for reporting income without a 1099? Does it ask for the form specifically or can you just enter the income amount?

•I use TurboTax every year and it's fine for this situation. When you go through the self-employment section, it'll ask if you received any 1099s, but you can just enter the income manually without entering any 1099 information. Just select "I'll enter my income without a 1099" when prompted.
