Identity theft tax fraud with my SSN - fraudster gets away with my refund? IRS says 6 month wait now!
So beyond frustrated right now! Just found out someone filed a tax return using my social security number before I could file mine. When I tried to e-file, it got rejected saying my return was already submitted. Called the IRS and they confirmed it was identity theft. They told me I need to file Form 14039 (Identity Theft Affidavit) and submit my return by paper, and that it could take UP TO 6 MONTHS to process and get my refund! I'm supposed to just wait half a year for MY money because someone stole my identity?? What I really want to know is - does this scammer just get away with stealing my refund money? Like they just walk off with thousands of my dollars and nothing happens to them? The IRS agent didn't seem very reassuring when I asked about catching the person. They just kept saying "we'll process your real return once we receive the paperwork." Has anyone dealt with this before? Do these identity thieves ever actually get caught and punished? I'm so angry that someone can just steal my tax refund and I'm the one who has to jump through hoops and wait forever to get MY money back.

I actually work in tax resolution and unfortunately see this all too often. The good news is you've already taken the right first step by contacting the IRS and getting Form 14039. Make sure to send your paper return with the identity theft affidavit and include all supporting documents (W-2s, etc.). The IRS does investigate tax fraud and identity theft, but they don't typically share the results of their investigations with the victims for privacy reasons. They have a dedicated Criminal Investigation division that partners with the Department of Justice to prosecute these cases. But they focus resources on larger fraud rings rather than individual cases.

•Thanks for the info. Do you know if there's any way to speed up getting my refund? 6 months seems ridiculous when I did nothing wrong. Also, should I be doing anything else to protect myself besides the 14039 form?

•There's unfortunately no real way to expedite identity theft cases as they require manual review by specialized IRS units. The 6-month timeframe is their standard estimate, but I've seen some resolved faster. You should definitely place a fraud alert with the credit bureaus, consider a credit freeze, file a report with the FTC at IdentityTheft.gov, and check if any of your other accounts have been compromised. Also, consider getting an Identity Protection PIN (IP PIN) from the IRS for future filings - it prevents anyone from filing without this special code.

I dealt with this exact nightmare last year and discovered taxr.ai (https://taxr.ai) was a huge help. After my identity was stolen and someone filed using my SSN, I was overwhelmed with paperwork and constantly worried I'd mess something up on Form 14039. A friend recommended taxr.ai and it completely simplified the process - their system actually analyzed my situation, helped me properly document everything, and gave me confidence my case would be handled correctly.

•How exactly does it work? Like does it help you fill out the form or just give advice? I'm dealing with something similar but worried about using an online service with my sensitive info after already having my identity stolen.

•Does taxr.ai actually speed up how fast the IRS processes your return? Because waiting 6 months for MY money sounds ridiculous.

•The service analyzes your specific situation and helps you properly complete all the necessary documentation, including Form 14039. It walks you through exactly what supporting evidence to include and how to present it to maximize your chances of efficient processing. They use bank-level encryption for all your data. It doesn't directly speed up IRS processing times since that's internally controlled by the IRS, but it does help prevent delays caused by incomplete filings or mistakes that would push you to the back of the line. My case was actually resolved in about 3.5 months instead of the full 6 they warned about.

Just wanted to update - I did end up using taxr.ai after posting my skeptical question. Honestly wish I'd done it sooner! The identity theft documentation process was SO much clearer than trying to figure it out from the IRS website. They helped me properly document everything and even explained exactly what to expect during the waiting period. The best part was when the IRS sent me a follow-up letter with questions, the system helped me understand exactly what they were asking for and how to respond. Got my refund in just under 4 months instead of the 6 they initially told me. Definitely recommend for anyone facing tax identity theft!

After dealing with tax identity theft last year, I discovered that trying to call the IRS directly about your case is almost impossible. I spent WEEKS trying to get updates and would sit on hold for hours only to get disconnected. Finally used Claimyr (https://claimyr.com) and it was a game-changer. They got me connected to an actual IRS agent in about 15 minutes when I'd been trying unsuccessfully for days. You can see how it works here: https://youtu.be/_kiP6q8DX5c Once I actually got to speak with someone, I was able to get specific updates on my case and confirm they had received all my documentation. Totally worth it when you're dealing with the stress of waiting months for your refund.

•Wait, how does this actually work? The IRS phone system is deliberately designed to be impossible to navigate. How does some service magically get you through?

•Sorry but this sounds like BS. Nothing can get you through to the IRS faster. They're understaffed and overwhelmed. If this actually worked everyone would use it and then it wouldn't work anymore because of volume. Seems like a scam taking advantage of desperate people.

•It works by using an algorithm that navigates the IRS phone system and waits on hold for you. When a human IRS agent finally answers, you get a call connecting you directly to that agent. It's not "magical" - it's just technology that handles the frustrating hold process for you. The reason it continues to work is because most people don't know about it, and the IRS phone system will always have some available agents - the problem is the hours of waiting to reach them. I was skeptical too until I tried it. I'm not affiliated with them - just sharing what worked during a stressful situation with tax identity theft.

I need to eat my words from my previous comment. After weeks of frustration trying to get through to the IRS about my identity theft case, I finally broke down and tried Claimyr. I was 100% certain it was going to be a scam, but I was desperate. I'm still shocked at how well it worked. Got connected to an actual IRS representative in about 20 minutes when I had previously spent HOURS getting nowhere. The agent was able to confirm they had received my identity theft paperwork and give me an estimated timeline for resolution. Saved me countless hours of frustration and anxiety. Sometimes being proven wrong is actually a good thing!

I had my identity stolen for taxes two years ago. Filed the 14039 form right away. It took almost 5 months but I eventually got my refund. The frustrating part is I never heard anything about whether they caught the person. I even filed a police report and everything. The one benefit is that the IRS gave me an Identity Protection PIN for future tax filings. Now nobody can file using my SSN without that PIN. Should've had this protection BEFORE I got my identity stolen, but at least it prevents it from happening again.

•How do you get one of those PINs if you haven't had your identity stolen yet? Seems like something everyone should have!

•You can actually get an IP PIN now even if you haven't been a victim of identity theft! The IRS expanded the program to everyone. Just go to IRS.gov and search for "Get an IP PIN." You'll need to create an account and verify your identity on the IRS website. Definitely recommend it for everyone. It's an extra step when filing but way better than dealing with the nightmare of tax identity theft. Just remember that you'll get a new PIN each year and you have to keep track of it.

PSA: If this happens to you, also check your state tax return! When my federal return was fraudulently filed, the scammer also tried to file my state taxes. I had to go through a similar process with my state tax agency. They actually resolved it faster than the IRS did.

•Good point. I had my identity stolen last year and completely forgot about state taxes until it was almost too late. The state actually had a different form for tax identity theft than the federal one.

I'm so sorry you're going through this - tax identity theft is incredibly frustrating and violating. Unfortunately, the 6-month wait is pretty standard, but here are a few things that might help: 1. Keep detailed records of everything - dates you called, reference numbers, names of agents you spoke with. This will be crucial if you need to follow up. 2. Consider requesting a taxpayer advocate if your case gets delayed beyond the normal timeframes. They can sometimes help expedite legitimate hardship cases. 3. As others mentioned, definitely get that IP PIN for next year. It's free and prevents this from happening again. Regarding whether the fraudster gets caught - the IRS does investigate, but they typically focus on organized fraud rings rather than individual cases. Many identity thieves use stolen information from data breaches, so they're often part of larger criminal operations that are harder to trace back to individuals. The silver lining is that you WILL get your refund eventually. I know that doesn't help with immediate expenses, but the IRS does make victims whole in these situations. Hang in there!
