How far back can you claim unemployment with California EDD?
So I've been dealing with a situation where I lost my job back in March but kept putting off filing because I honestly thought I'd find something new within a few weeks. Well, here I am almost two months later and still nothing. My question is how far back can you claim unemployment through California EDD? Like, does it go back to when I actually lost my job or only to when I file? I've been reading conflicting stuff online and I'm really confused. I don't want to lose out on weeks I was already eligible for. My former employer laid off our entire department so there's no dispute about why I was let go, it should be a clean separation. But I'm worried that waiting so long to file means I just threw away thousands of dollars in benefits I qualified for. Can anyone who's gone through this explain how the backdating process works with EDD?

Okay so this is actually a really important thing to understand about how California EDD works. When you file your claim, EDD establishes what's called a "benefit year" which starts on the Sunday of the week you actually submit your application. That's your claim start date going forward. The problem is that EDD does NOT automatically backdate your claim to your last day of work. So those weeks between when you got laid off and when you finally filed? You would need to separately request backdating for those weeks. You have to certify for each of those weeks individually AND provide a valid reason why you didn't file sooner. The most commonly accepted reasons are things like: you were ill or incapacitated, you didn't know you were eligible, you received incorrect information from someone (like your employer telling you benefits weren't available), or there was some kind of emergency situation. Being busy job hunting generally won't cut it on its own. You'll want to call EDD and ask specifically about backdating your claim start date.

AuthorWait so I have to actually call them to get the backdating done? Is there any way to do it online through UI Online or do I have to talk to a live person?

Unfortunately you almost always need to speak with an actual EDD agent to request backdating. There's no clean online form for it. The agent will ask you questions about why you delayed filing and then document your reason. If approved, they'll adjust your claim start date and you'll be able to certify for those back weeks.

This is correct. Backdating requests are handled manually by EDD staff. It's one of those things that just has to go through a real person.

I went through almost the exact same thing last year - waited about six weeks before filing because I kept thinking I'd land something. When I finally called EDD to ask about backdating, the agent I reached was actually pretty helpful and approved my request going back to my separation date. The reason I gave was that I genuinely didn't know I could file while actively looking for work and thought I had to wait until I had a job offer lined up or something. They accepted that. So it's definitely worth trying. Getting through to EDD on the phone is the nightmare part though, I won't lie.

AuthorUgh yeah I've already tried calling twice and got the "we're experiencing high call volume" message and got cut off. So frustrating.

Yeah the phone lines are brutal. I actually ended up using a service called Claimyr (claimyr.com) to get through. It basically holds your place in the EDD phone queue and calls you when an agent is available. There's a demo video showing how it works at https://youtu.be/JmuwXR7HA10 - saved me a ton of time and that's how I finally got my backdating situation sorted out.

There's an important distinction to understand here. California EDD backdating policy allows you to request that your claim start date be moved back up to a maximum of one year before your application date, BUT only if you have a qualifying reason for the late filing. The key regulation is that you cannot simply say you forgot or were busy - you need a reason EDD considers valid. The most straightforward qualifying reasons that EDD agents will typically accept include: medical emergency preventing you from filing, caring for a seriously ill family member, being misinformed about your eligibility by your employer or another authority, or lacking reasonable access to file. Two months is well within the timeframe where backdating is possible. The harder part is documenting your reason convincingly when you speak with an agent.

Does it matter that my employer never told me I could file? Like they just handed us the layoff paperwork and didn't mention unemployment at all. Would that count as being misinformed?

Malik Thomas
That's actually a gray area. Not being informed is different from being misinformed - EDD typically requires that someone actively gave you wrong information rather than just didn't mention it. That said, individual agents do have some discretion. I'd frame it carefully when you speak to someone.

Yeah I've heard agents vary a lot on how they handle backdating requests. Some are really flexible, others go strictly by the book.

Okay wait I'm confused about something. When they say you can backdate, does that mean you get all that money at once or does it still take forever to process? I've been without income for two months and I'm already behind on everything. I can't handle waiting another two months for the backdated weeks to pay out

Once backdating is approved and you certify for all the back weeks, EDD typically processes those certifications relatively quickly compared to a new claim. You won't get it all in one lump sum exactly - EDD processes each week as you certify for it - but approved back weeks can often hit your payment method within a few days of certification. There can still be delays if any weeks go into adjudication though.

NeonNebula
What would make them go into adjudication? I don't want any more delays

Things like earnings reported during those weeks, separation issues that haven't been resolved, or just random sampling. If your layoff was clean with no disputes, you have a decent chance of the back weeks processing smoothly.

I work in HR and I can tell you that employers are supposed to hand employees a pamphlet about unemployment benefits at the time of layoff. It's actually required by California law. If your employer didn't do that, that could genuinely support your backdating reason since you weren't properly notified of your rights. Might be worth mentioning that when you call EDD.
0 coins
CosmicCowboy
AuthorOh wow I had no idea that was a requirement. They definitely did not give us anything like that. Just a separation agreement and a box for our stuff basically.
0 coins
Ravi Malhotra
Yeah it's pretty commonly ignored unfortunately. The pamphlet is called the "For Your Benefit" pamphlet, EDD form DE 2320. Your employer was legally supposed to provide it. That's a legitimate reason you can cite for not knowing you could file.

This is actually a really useful thing to know. I wonder how many people miss out on benefits just because employers don't do this properly.

i tried to backdate my claim a while back and honestly the whole thing was a mess. the first agent i talked to said they could approve it no problem then when i called back a week later to follow up a different agent said there was no record of the request and i had to start over. made sure to write down every agent's name and ID number after that. just a heads up to document everything when you call
0 coins
CosmicCowboy
AuthorThat's terrifying honestly. So they can just lose a request like that?

apparently yes. always ask the agent for their name and confirm they've submitted the request before you hang up

Something nobody mentioned yet - when you're certifying for backdated weeks, make sure you're answering the questions accurately for what was actually true during THOSE weeks, not current information. EDD will ask things like whether you were able and available to work, whether you actively looked for work, whether you had any earnings. Your answers need to reflect what was happening during those specific weeks. If you were actively job searching during the gap period, that actually helps your case because it shows you were meeting the general eligibility requirements even if you hadn't filed yet.

CosmicCowboy
AuthorYes I've been applying to probably 3-4 jobs per week this whole time so that's good at least. Do I need to have documentation of those applications?
0 coins
Isabella Costa
California EDD requires you to keep a job search record and you can be asked to provide it. It should include the employer name, contact info, date you applied, and method of contact for each application. If you haven't been keeping a formal log, try to reconstruct what you can from your email or LinkedIn activity.

wait we have to document all job searches?? nobody told me that when i filed

Jumping in here because I was literally in this exact position 4 months ago. Filed late, panicked about all the money I thought I'd lost. Called EDD about backdating, gave them the reason that I didn't receive the required DE 2320 pamphlet from my employer (someone on a forum like this told me about it - glad I found that info). The agent approved my backdating request going back to my separation date, I certified for all the missed weeks, and the payments came through within about a week and a half. It was stressful but it worked out. Don't give up - the money is potentially still there.

CosmicCowboy
AuthorThis is genuinely really reassuring to hear. How many times did it take you to actually get through to an agent?
0 coins
Freya Christensen
Honestly it took me probably 8 attempts over three days before I got through. I started calling right at 8am when they open and that seemed to help a little. Eventually I tried Claimyr which I saw mentioned somewhere - claimyr.com - and that's actually how I finally got connected. You let it navigate the EDD phone system and it calls you back when an agent picks up. Worth trying if you keep getting cut off.

CosmicCowboy
AuthorOkay I'm going to try that. The calling game is absolutely brutal.

EDD's phone system is DESIGNED to make you give up I swear. I've been hung up on mid-queue so many times. Had a backdating issue myself and it took me literally 3 weeks of daily calling attempts to actually get a human being. The system is broken and they know it.

Three weeks is unfortunately not even unusual. Some people go longer. It's genuinely absurd.

And the thing is every day you can't get through is potentially more money in limbo. There should be a better way to handle this stuff.

Let me also clarify something about the maximum lookback period since there seems to be some confusion in the thread. You can request backdating going back to the start of your current benefit year or up to one year before you filed, whichever is shorter. In practice for most people this means you can backdate to your actual last day of employment as long as it was within roughly the past year. If somehow someone waited more than a year to file, they'd lose those early weeks entirely. For the OP who waited about 2 months, the full period should be recoverable with an approved backdating request.
0 coins
NeonNebula
So theoretically if someone waited like 11 months they could still get backdating for almost the whole thing?
0 coins
Amina Diallo
Technically yes if they have an approved reason, but EDD scrutinizes longer delays much more carefully. The longer you waited, the stronger your reason for the delay needs to be.
0 coins
Isabella Costa
Also worth noting that waiting that long would likely create more complications with the separation itself - employer documentation harder to obtain, etc.

random question but does it matter if you had ANY income during those back weeks? like i picked up a couple of gigs during my gap period. does that disqualify me from claiming those weeks entirely or do they just reduce the payment
0 coins
Malik Thomas
Having earnings during a week doesn't automatically disqualify you - EDD uses a formula where they disregard the first 25% of your weekly benefit amount in earnings, then reduce your payment dollar for dollar beyond that. So if your weekly benefit amount is $400 and you earned $150, they'd disregard $100 and reduce your payment by $50. You'd still get $350 that week. You must report ALL earnings accurately though - underreporting is treated very seriously by EDD.

Omar Farouk
okay good to know. yeah i will absolutely report everything accurately, definitely not trying to mess with that

Emma Wilson
always report everything always always. the penalties for not reporting are really bad

One more thing OP should know - after you get the backdating approved and certify for all those back weeks, keep an eye on your UI Online account. Sometimes weeks from the backdated period will show as "pending" or even go into adjudication individually. If that happens, don't panic immediately but do follow up with EDD if they sit in pending status for more than a couple weeks. Had one week from my backdated period get stuck and needed a quick call to resolve it.
0 coins
CosmicCowboy
AuthorHow did you resolve it? Another phone call?
0 coins
Natasha Orlova
Yeah just called and asked the agent to look at that specific week and explain why it was pending. Turned out it was a minor flag from crossing a state line for a job interview that week which is totally fine and allowed - the agent cleared it right away.

honestly i didnt even know backdating was a thing. i filed super late after my layoff last spring and just assumed those weeks were gone forever. this thread is making me wonder if i left money on the table

If it was within the past year you could potentially still request it. Your claim is still active presumably? You could call EDD and ask specifically about backdating for those early weeks. It's worth at least asking.
0 coins
Chloe Davis
my claim is closed now bc my benefit year ended. is it still possible??
0 coins
Malik Thomas
Once your benefit year closes it's much harder to recover those early weeks. You'd essentially need to file a new claim and the old period becomes very difficult to reopen. Unfortunately there are real deadlines that can cut things off permanently.

okay update: i finally got through to california edd this morning!! used claimyr like a few people mentioned here and it actually worked - got a call back within like 2 hours. the agent was really helpful, i explained that my employer never gave me the DE 2320 pamphlet thing and she said that was a valid reason and approved backdating to my separation date. now i just have to certify for all the missed weeks through UI Online. if anyone else is stuck on the phone issue seriously just try claimyr.com it was way less painful than my previous attempts

AuthorOh wait you're in the same situation as me! That's awesome news. Did the agent say anything about how long the backdated payments would take?

For anyone reading this thread later with the same question - the short version of how far back you can claim unemployment in California: you can request backdating up to about one year before your application date, but you MUST have a valid reason why you didn't file sooner. The reason needs to be more than just forgetting or being busy. The DE 2320 pamphlet not being provided is one of the stronger reasons available since it's a documented legal requirement. Call EDD and ask specifically to have your claim start date backdated and be ready to explain your reason clearly.

Just want to add for completeness - when you certify for backdated weeks you'll be answering the same certification questions as regular weeks. One thing that trips people up: the question about being "able and available" to work. During the backdated period, if you were sick for any of those weeks or had some other reason you couldn't work, those specific weeks might not be payable even with approved backdating. Answer honestly for each individual week based on what was actually true.
0 coins
CosmicCowboy
AuthorYeah I was healthy and actively looking for work the whole time so that should be fine. No earnings either so hopefully clean sailing.

That's a good position to be in. Should process smoothly then.

Also make sure your payment method (EDD debit card or direct deposit) is active and set up correctly before those backdated payments start processing. If your debit card expired or direct deposit info changed you don't want that causing a delay.

Has anyone dealt with a situation where EDD approved the backdating verbally over the phone but then the weeks still show locked in UI Online? Currently waiting to see if my request actually went through or if it was another case of a request disappearing into the void
0 coins
Amina Diallo
Give it 3-5 business days for the system to update after a verbal approval. EDD's internal system and UI Online don't always sync immediately. If after a week the weeks are still locked, call back and reference the date of your original call.

okay will wait it out. just paranoid after hearing about requests getting lost
