Can you get partial unemployment through California EDD if you're still working reduced hours?
So my employer cut my hours pretty drastically about three weeks ago - went from full time (40 hrs/week) to barely 20 hours. I'm in the restaurant industry and they said it's because of slow season but honestly who knows if my hours ever come back. A coworker mentioned offhand that I might be able to collect some unemployment even though I'm technically still employed. I had no idea this was even a thing. Can you get partial unemployment through California EDD when you're still working but your hours got slashed? I don't want to do anything wrong or get flagged for fraud but I also really need help covering my bills. Has anyone actually done this? How does it work exactly?

Yes, partial unemployment is absolutely a real thing with California EDD and it sounds like your situation qualifies. It's called a partial claim, and it's designed exactly for people whose hours were cut by their employer. You're not doing anything wrong by filing - it's a legitimate benefit you've paid into through your paycheck deductions. Here's the basic idea: California EDD will look at what you're currently earning versus what your weekly benefit amount (WBA) would be if you were fully unemployed. They use a formula where you can earn up to 25% of your WBA before your benefits start getting reduced dollar for dollar. So you'd still collect something meaningful even while working part time. You do need to report ALL wages you earn each week when you certify - this is non-negotiable. Under-reporting earnings is one of the most common ways people end up with overpayment notices later.

AuthorOk this is really helpful. So I still have to do the weekly certification thing even though I'm working? And I have to report my hours each time?

Exactly right. Every week you certify you'll answer questions about how many hours you worked and how much you earned. California EDD uses that info to calculate what you're owed for that week. Just be accurate and you'll be fine.

Same thing happened to my wife last year after her retail job cut her to like 15 hours. She got partial benefits for almost 4 months while she looked for better work. The weekly certification is pretty quick once you get the hang of it.

To add some detail to what was already said - when you file your initial claim, make sure you select that your hours were reduced (not that you were fully laid off). California EDD's UI Online system will walk you through it. You'll need your employer's info, your recent earnings history, and your last day working full hours. The system is mostly straightforward but the wage reporting part on weekly certifications trips people up. Your weekly earnings get reported as gross pay (before taxes), not what hits your bank account. That mistake causes SO many issues down the line.

AuthorGross pay not net, got it. That's a detail I definitely would have messed up without knowing.

wait does this work if ur employer already reduced ur hours like 3 weeks ago or do u have to file right when it happens
0 coins
Everett Tutum
You can still file even if the reduction happened a few weeks back. California EDD generally allows backdating to the week your hours were cut, but you should file as soon as possible. The longer you wait the more certification weeks you have to catch up on and that gets complicated fast.

I went through this exact situation last year - reduced hours at my warehouse job and had no clue partial unemployment was an option. Honestly the hardest part wasn't the paperwork, it was actually getting through to California EDD when I had questions during my claim. I spent like 3 days redialing and never got a live person. Someone on a thread like this actually suggested Claimyr (claimyr.com) and it genuinely saved me. They connect you to a real California EDD agent without you sitting on hold forever. There's even a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. I was skeptical but I got through to an agent within the same day and they confirmed my partial claim was set up correctly. Worth knowing about if you run into issues.

I've heard of Claimyr but never tried it. Good to know it actually works for partial claim questions not just full unemployment situations.

ok but just to be real with you - partial unemployment through EDD is kind of confusing at first and a lot of people mess it up. my cousin tried to do it and accidentally marked himself as not available for work on his certification which basically paused his benefits for like 2 weeks. the questions on the weekly cert can be worded weird. just read everything twice before you hit submit

Statiia Aarssizan
AuthorThat's a good warning. What does 'available for work' even mean if you're already working part time?
0 coins
Lydia Santiago
it means you're willing to accept additional work / full time work if offered. since you're still working and open to more hours you'd answer yes. EDD wants to know you're not turning down opportunities
0 coins
Reginald Blackwell
This is correct. 'Available for work' on the certification means available for full or additional employment, not that you're currently unemployed. Answering no when you're actually available can tank your claim.

I'm so confused by all of this. Does California EDD know automatically what your wages are or do you just have to self report and hope it matches? I'm always paranoid about saying the wrong number. My hours change week to week at my job so it's never the same amount.
0 coins
Reginald Blackwell
EDD does eventually cross-reference wages against employer records and tax filings, but during the claim itself you're self-reporting each week. For variable hours jobs, you report the actual gross earnings from that specific week, whatever you worked. It doesn't need to match a fixed number because EDD expects it to vary.
0 coins
Romeo Quest
Ok that makes more sense. I thought they needed like a consistent number and I'd have to average it out or something. Weekly reporting of actual earnings is doable.

Everett Tutum
Variable income is actually very common with partial claims - EDD's system is built to handle it. Just keep your pay stubs or any record of hours worked each week so if there's ever a discrepancy you can show your math.

The job search requirement thing tripped me up when I did partial unemployment. I assumed since I was still employed I didn't need to do job searches. Wrong. California EDD typically still requires you to be actively looking for work and logging job search activities unless your employer puts you on an approved standby status. If your restaurant hasn't filed for standby with EDD, you're probably expected to job search.
0 coins
Statiia Aarssizan
AuthorWait what's standby status? My employer definitely never mentioned anything like that.
0 coins
Aria Khan
Standby is when your employer officially tells EDD the reduced hours are temporary and they expect to bring you back to full time. If EDD approves standby for your claim, they waive the job search requirement for a limited period - usually up to 8 weeks. If your employer doesn't do this, you have to do the job search activities yourself.

This is a really important distinction that most people don't know about until they get a notice. Partial claims and standby status are related but different things. Definitely worth a call to California EDD to clarify which applies to your situation - which circles back to why having a reliable way to reach them matters.

just gonna say it - california edd partial claims are lowkey a lifesaver. went thru a slow period at my construction gig two winters ago and partial UI kept me from completely drowning. the benefit amount wasn't huge but combined with my reduced paycheck it was enough. don't sleep on this if ur eligible

I have a question that's slightly different - what if your hours got cut but your HOURLY RATE also went up slightly at the same time? Like they cut my time but gave me a small raise so technically my total earnings dropped but not as much. Does EDD look at hours or total earnings when calculating partial benefits?
0 coins
Everett Tutum
EDD calculates based on your weekly gross earnings, not hours worked directly. So if your total weekly earnings dropped enough below your WBA threshold, you'd still qualify for partial benefits regardless of the hourly rate change. The key number is what you actually earned that week.
0 coins
Melissa Lin
ok that's actually helpful. so even with the small raise i might still qualify because my overall paycheck is still way less than before
0 coins
Reginald Blackwell
Exactly. EDD isn't looking at whether you got a raise, they're comparing your weekly earnings to your established WBA. As long as your current earnings are below a certain threshold relative to that WBA, you're potentially eligible. Every situation is different though so getting specific confirmation from EDD directly for your numbers is always smart.

Has anyone dealt with their employer being weird about it when they find out you filed for partial unemployment? My manager kind of implied it was 'disloyal' when I mentioned it once. That stressed me out a lot.
0 coins
Reginald Blackwell
Employers cannot legally retaliate against you for filing for unemployment benefits. It's your right as an employee who has had wages reduced. The employer actually FUNDS the unemployment system through their payroll taxes, so you're not taking anything from them directly when you collect benefits.
0 coins
Eve Freeman
That's reassuring. I didn't know it was funded through their payroll taxes. Makes it feel less like I'm going behind their back.
0 coins
Lydia Santiago
yeah a lot of employers make you feel guilty about it to discourage you from filing. don't let them. it's literally what the system is there for
0 coins
Aria Khan
Worth noting - employers do get notified when you file a claim. They can contest it if they believe you don't qualify, but for a legitimate hour reduction situation their options to block you are pretty limited.

how long does it take for partial unemployment to get approved and start getting paid? my bills aren't gonna wait around lol

Processing time varies but typically 3-5 weeks for initial determination on a partial claim, sometimes longer if anything flags for adjudication. The sooner you file the sooner that clock starts. And if you need to follow up on your claim status, being able to actually reach someone at California EDD makes a huge difference - Claimyr (claimyr.com) is what I used to get through when I needed updates without spending days redialing.

3-5 weeks is rough but ok. better to know upfront i guess

You can also check UI Online for claim status updates which is faster than waiting for mail. Once your claim is approved, payments often go back to cover the waiting period weeks retroactively so don't panic if nothing shows up right away.

I got confused reading this thread - is partial unemployment the same as getting your employer to file a mass layoff claim or are those totally different? I keep seeing both mentioned on EDD's website
0 coins
Reginald Blackwell
These are different things. A partial claim is typically for an individual worker whose hours were reduced. Mass layoff or employer-filed claims are when an employer proactively initiates claims for a group of workers simultaneously through EDD's employer portal. Both result in unemployment benefits but they go through different processes. Individual partial claims are what most single workers dealing with hour cuts would use.

Effie Alexander
Ok that clears it up. I was going down a rabbit hole on EDD's site trying to figure out if I needed my employer to do something or if I could just file myself.

Effie Alexander
For the record - you CAN file your own partial claim without your employer initiating anything. You just need your employment info and earnings history.

Does the partial unemployment claim affect your taxes at the end of the year? I'm already in a complicated tax situation and don't want surprises in April
0 coins
Aria Khan
Yes - unemployment benefits including partial benefits are taxable income at the federal level and in California. EDD will send you a 1099-G form at the start of the year showing what you received. You can choose to have taxes withheld from your benefit payments (EDD gives you that option) which makes tax season less painful.

Romeo Quest
I didn't even think about the 1099-G. Good thing someone mentioned it. I'll definitely elect withholding if that's an option.

UPDATE: I went ahead and filed my partial claim two days after reading this thread. The UI Online process was actually not terrible? It took maybe 30 minutes. They asked for my employer info, my earnings over the last 18 months (which I could look up on my pay stubs), and confirmation that my hours were reduced involuntarily. Now I'm just waiting for the determination letter. Will report back.

Random question - if I pick up a second part time job while on partial unemployment do I have to report BOTH jobs' earnings? Or just the one my claim is based on?
0 coins
Reginald Blackwell
You must report ALL earnings from ALL sources every week you certify. This is absolutely non-negotiable. EDD asks for total weekly earnings, not job-specific earnings. Failing to report income from a second job while collecting benefits is considered fraud and can result in disqualification, repayment of benefits, and penalties.
0 coins
Eve Freeman
Yikes ok. I wasn't trying to hide it I genuinely didn't know if the second job was relevant. Definitely reporting everything.
0 coins
Everett Tutum
It's a common honest mistake people almost make. The good news is reporting additional income doesn't necessarily zero out your benefits - EDD's formula accounts for it. You might get less than if you only had the one job but you'd likely still get something depending on the amounts.
0 coins
Lydia Santiago
Does anyone know if there's an income limit where you make TOO much in your part time hours to qualify for any partial benefit? Like what's the cutoff?
0 coins
Reginald Blackwell
Generally speaking, if your weekly earnings from work exceed your weekly benefit amount (WBA), you won't receive benefits for that week. But California's formula is a bit more nuanced - the 25% earnings disregard means you can actually earn slightly above your WBA before hitting zero. Your specific WBA depends on your prior earnings history. EDD calculates it when you file. Once you have that number you can work backward to understand your limit.
0 coins
Lydia Santiago
so i need to know my WBA first before i can figure out if im even going to get anything. makes sense
0 coins
Aria Khan
Your WBA will be in your determination notice once California EDD processes your claim. A lot of people also use EDD's online benefit calculator to get an estimate before they file - it's not exact but gives you a ballpark so you're not waiting in suspense.

For anyone still dealing with the phone access problem - I want to circle back to the Claimyr recommendation. I know a few people in this thread mentioned struggling to reach California EDD agents and I really can't overstate how much less stressful my partial claim experience was once I found a reliable way to get through. Check out claimyr.com or the demo at https://youtu.be/JmuwXR7HA10 before you give up on getting your questions answered by a real person. Partial claims have enough moving parts that sometimes you really need to talk to someone rather than just hope the online system handles everything correctly.

one thing nobody mentioned - make sure you keep your UI Online contact info updated. I missed a notice once because my email was slightly wrong and my claim went into this limbo where EDD needed additional info and I had no idea for three weeks. It delayed my payments significantly.

Original poster here with an update for anyone following this thread. I filed my partial unemployment claim about 10 days ago. My claim is showing as 'pending' in UI Online which I've read can mean a few things. I've been completing my weekly certifications and reporting my hours accurately. Called EDD once and obviously couldn't get through. Going to try the Claimyr option that a few people mentioned since I have a specific question about my standby status that I want clarified before I answer it wrong on my next certification. Will update when I hear something definitive. Thanks everyone - this thread was genuinely more useful than anything I found on the actual EDD website.

' Pending at 10 days is normal,'don t panic yet. Getting your standby question clarified before answering it on your cert is absolutely the right call. Wrong answers on certifications are much harder to fix after the fact thanbefore.
