EDD benefits confusion - fired day before SDI, now going on PFL, can I reactivate UI after?

Hey everyone, I'm in a really complicated situation with my benefits and hope someone can help me sort this out. I was terminated from my job of 3 years (they said restructuring but the timing seems suspicious) exactly ONE DAY before my scheduled disability leave was supposed to start. I had already submitted all my medical certification paperwork for my SDI claim because I needed surgery. I went ahead with my medical leave/SDI as planned since I was already approved. Now I'm about to transition to Paid Family Leave to care for my mother who is recovering from a stroke. Here's where I'm confused - once my PFL ends in about 6 weeks, can I reopen or file for unemployment benefits since I was actually terminated? Or does the fact that I went on disability and then PFL make me ineligible? I have no job to return to obviously. I'm getting really anxious about what happens when my PFL runs out. Has anyone dealt with something like this before? Thanks in advance for any advice!

I think u can get unemployment after pfl ends but not 100% sure. my cousin had somthing like this happen but she quit not fired.

Thanks for responding! Was your cousin able to get unemployment after her PFL ended even though she quit? My situation is slightly different since I was fired, which usually qualifies for UI (as long as it wasn't for misconduct).

Yes, you absolutely can file for UI after your PFL ends. The key issue is that you were terminated before your disability began - this preserves your UI eligibility. Had you been terminated while on disability, it would be more complicated. Make sure to specify in your UI application that you were terminated before starting disability/PFL and that you're now able and available for work. You might need to explain the sequence of events clearly since it's unusual. Also, since your termination timing seems suspicious (right before medical leave), you might want to consult with an employment attorney about possible wrongful termination, especially if your employer knew about your upcoming medical needs.

Thank you so much for this detailed explanation! This makes me feel a lot better. I've been documenting everything just in case I need to pursue the wrongful termination angle, but right now I'm just focused on making sure I have income after my PFL ends. I'll definitely make sure to be clear about the sequence of events when I apply for UI.

the same thing happened to me!!! Except I had a baby and was going on pregnancy disability. The timing is SO SKETCH when they fire you right before medical leave!! Anyway, my PFL ended in January and I DID get approved for unemployment after. But they took FOREVER to process my claim - like 7 weeks with no income. Make sure you have some savings to get through the gap!!

Oh wow, I'm sorry that happened to you too but relieved to hear you eventually got approved! 7 weeks is a long time with no income though - that's really stressful. I'll definitely try to put aside whatever I can from my PFL payments to prepare for that gap. Thanks for the heads up!

I went thru something similar and when I called EDD about my UI claim after PFL they kept transferring me and putting me on hold for HOURS and then disconnecting me. I almost gave up because I couldn't get through to anyone! So frustrating when you need answers about your benefits.

Hey, if you're having trouble getting through to an EDD agent, I'd recommend trying Claimyr. It's a service that gets you connected to an actual EDD representative usually within 5-10 minutes instead of spending hours on hold or getting disconnected. I used it when I had a complex benefits situation similar to this. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/1X-mEsLtbmQ?si=1hcSq3KFtCr4oAmd Totally saved my sanity when I was dealing with transitioning between different EDD benefits and had specific questions about my eligibility.

Are you SURE you were technically fired? Check your separation paperwork carefully. Sometimes companies will code it as a temporary layoff or leave of absence which affects your UI eligibility differently than termination. Also MAKE SURE youve been paying into SDI through your paychecks or you might get denied!!!!

Good point! I just double-checked my paperwork and it definitely says "termination" not layoff. And yes, I've been paying into SDI - I already received approval for my disability claim and have been getting payments, now transitioning to PFL. But I appreciate you mentioning these details because they're definitely important distinctions!

I had a different experience than what some people are saying here. When I tried to file UI after my disability ended (different situation, but still relevant), EDD initially denied me saying I wasn't able and available for work during my base period because I was on disability. I had to appeal and show them that I was able to work NOW even though I had been on disability BEFORE. My advice is to be very clear in your application that your termination was BEFORE your disability started, and that you are now fully recovered and able to work after your PFL ends. Also, if your termination was retaliatory because they knew you were about to go on medical leave, that could be illegal under FMLA/CFRA protections, depending on your company size and how long you worked there.

Thank you for sharing your experience! That's really helpful to know about the potential denial and appeal process. I'll make sure to be extremely clear about the timeline and my current ability to work when I apply. And yes, I'm definitely considering whether there were FMLA violations with the timing of my termination. I had worked there for 3 years and it's a company with over 100 employees, so I should have been protected.

u mite also get backpay from when u were fired if ur approved for UI! my friend got like 6weeks of backpay when her claim finally went thru

That's actually not correct in this specific situation. Since OP received SDI and PFL benefits, they cannot receive UI backpay for the same period - that would be considered double-dipping. UI can only begin after the PFL ends, and there's no backpay to the termination date if they were receiving other benefits during that time. This is why it's important to speak directly with EDD about your specific situation rather than relying solely on others' experiences, as each case has unique factors.

The REAL problem here is how complicated our benefits system is!!! Why should someone need a PhD just to figure out what benefits they're entitled to after working and paying taxes for years? The EDD system is BROKEN and designed to be confusing on purpose so people give up trying to get their benefits. Sorry for the rant but this makes me so mad every time I see posts like this.

PREACH!!! 👏👏👏 I spent literally DAYS of my life on hold with EDD trying to figure out my benefits. It's ridiculous that we need forums like this just to understand our basic rights as workers who've paid into these systems.

To summarize for anyone in a similar situation: 1. You CAN file for UI after SDI/PFL if you were terminated before your disability began 2. You must be able and available for work when you apply for UI 3. The timing of your termination (right before medical leave) could potentially be illegal retaliation or FMLA violation 4. You cannot receive UI backpay for periods when you received SDI or PFL 5. Document everything carefully and be prepared to clearly explain your timeline to EDD 6. Expect possible processing delays, so have financial backup if possible 7. If denied, remember you have appeal rights Hope this helps clarify things for you and others!

Thank you so much for this clear summary! This is incredibly helpful and I'm saving it to reference when my PFL ends. I appreciate everyone who took the time to respond with advice and share their experiences. I feel much more prepared now!
