CalWORKs appeal approved by judge but worker refusing to restore benefits - 2 weeks past deadline
I'm at my wit's end trying to get our CalWORKs benefits reinstated after winning our appeal hearing. Here's what happened: Our benefits got cut off in September because they claimed we didn't submit our SAR7. I filed an appeal on October 2nd with solid proof that we never received the SAR7 form AND it wasn't even showing up in my BenefitsCal account (I have screenshots of everything). The judge completely agreed with us at the hearing on November 2nd and ruled in our favor. Here's where it gets ridiculous - the judge said the ruling would be finalized in about a week, but it wasn't actually completed until December 4th. At that point, the judge ordered our caseworker (Paul Johnson) to process our benefits within 10 days. It's now been over TWO WEEKS since that deadline passed, and nothing has happened! I've called Riverside County multiple times, tried contacting supervisors, emailed the regional office, and even reached out to the compliance unit. Nobody calls back. I've been extremely polite and just stick to the facts about the missed deadline and the judge's order. Our worker is blatantly defying a judge's order and there seem to be zero consequences. Has anyone dealt with a worker literally refusing to comply with an appeal decision? Who can I contact when even the compliance unit won't help? We're really struggling without our Cash Aid.

This is absolutely wrong but unfortunately not uncommon with Riverside County. When a judge rules in your favor, the county has to comply - it's not optional! You need to go above the compliance unit since they're clearly not doing their job. Contact the CDSS State Hearings Division that handled your appeal and tell them the county is refusing to implement the judge's decision. They have the authority to force compliance. Also, there's the Civil Rights/Civil Liberties office: (866) 741-6241. Make sure to tell them you have a Conditional Withdrawal Agreement from the judge, the date it was signed, and that the worker is non-compliant with the timeline. Keep calling EVERY day and documenting everything. Names, dates, times of calls - create a paper trail. You might even consider reaching out to your County Board of Supervisors or local legal aid organization.

•Thank you so much for this info! I didn't know I could go back to the State Hearings Division directly. Would I just call the main number that was on my hearing paperwork? And is the Conditional Withdrawal Agreement the same as the judge's final decision document? (Sorry if that's a dumb question - this is my first time dealing with the appeal process.

omg i went thru something similar last yr but in san bernardino!! judge ruled for me but took 3 whole months to get my money!!! the caseworkers do NOT care about court orders they think there above the law i swear. keep calling but also go in person if u can, harder for them to ignore u when ur standing there

•3 months?! That's ridiculous! Did you end up getting back pay for all the months they didn't pay you? I was thinking about going in person but our office requires appointments and they won't give me one. Maybe I'll just show up anyway.

You need to contact the Presiding Administrative Law Judge for your region. This is someone who oversees all the ALJs in your area. When a county fails to comply with a hearing decision, this is actually a pretty serious violation. I would also suggest filing a formal complaint with: 1. The CDSS State Hearings Division at (800) 743-8525 2. Your county's Civil Rights Coordinator (every county has one) 3. The Welfare Rights Organization in your area And yes, document EVERYTHING. Every call, every email, every conversation. Make sure you note specific promises made about callbacks that didn't happen. Also, have you tried using Claimyr? It's a service that can help you get through to actual workers much faster than waiting on hold for hours. •Thank you for all these specific contacts! I didn't know about the Presiding ALJ - I'll definitely try to find that contact info. I've been keeping a journal of all my calls but it's just getting so frustrating. I'll check out that Claimyr service - at this point I'm willing to try anything if it helps me actually talk to a real person who can help.

the workers HATE when they lose appeals, my friend works at the county and says some workers get really petty and will drag their feet on purpose after losing. its total BS but they know most people will just give up fighting

•This is 100% true. I used to work for LA County (not Riverside) and certain workers would take appeal decisions as personal insults. They'd comply eventually but would push it to the absolute limit. It's unprofessional and cruel, but it happens. Keep fighting - they're counting on you giving up.

Contact ur state representative!!! Thats what i did when my benifits got cut off for no reason. I emailed my assembly person and they have staff who deal with state agency problems. They contacted calworks for me and suddenly evrything got fixed in 2 days after 3 weeks of getting nowhere!! Google 'california assembly member (your city)' to find yours

Quick question - have you tried contacting the Appeals Case Manager directly? Every county has someone who specifically manages appeals cases and makes sure workers implement decisions. They might be different from the regular compliance unit. Also, when you call, are you specifically saying "I need to report non-compliance with a judge's order"? Sometimes using those exact words gets you transferred to the right person. Also, I hate to ask the obvious, but have you checked BenefitsCal to see if maybe they processed it but didn't notify you? Sometimes they restore benefits but the notification gets lost.

•I have checked BenefitsCal every single day and there's no change to our case status. Still shows discontinued. I didn't know about an Appeals Case Manager specifically - I'll ask for that person next time. And no, I haven't been using those exact words about non-compliance with a judge's order. THIS IS Y I RECORD EVRYTHING!!! I had a supervisor lie 2 my face about sum paperwork so now i record all phone calls (california is 2 party consent so u gotta tell them). but soon as they know ur recording suddenly they start following the rules funny how that works lol

Just checking back - have you had any success with any of these approaches? If nothing else has worked, I wanted to add one more suggestion: file for a rehearing based on the county's failure to comply. This is an official process where you tell the State Hearings Division that the county hasn't implemented the decision. They can then issue an order compelling compliance and potentially even imposing sanctions on the county. The rehearing request form is here: https://cdss.ca.gov/cdssweb/entres/forms/English/DPA531.pdf Make sure you include all the documentation showing your attempts to get the county to comply. This creates a formal record of their non-compliance.

•Update: I finally got somewhere! I tried several of the suggestions here - I contacted the State Hearings Division AND my assembly member's office on the same day. Not sure which one did the trick, but I got a call yesterday from a supervisor who apologized and said they're processing our benefits immediately. They're also giving us back pay from September when this mess started. Thank you all so much for your help - I would have kept hitting dead ends without these suggestions!
