EBT card drained to 1¢ overnight - when will CalFresh refund stolen benefits?

I just checked my EBT balance this morning and someone completely emptied my account!!! They left me with literally ONE PENNY. I had over $425 in benefits that were supposed to last my family the rest of the month. I immediately went to the county office and reported it stolen. They deactivated my old card and gave me a new one, but the worker couldn't tell me when I'd get my benefits back. She just had me fill out some form and said someone would 'review' it. Has this happened to anyone else? How long does it take to get stolen benefits refunded? I have two kids and we seriously rely on CalFresh for groceries. I'm completely panicking right now because we have almost no food in the house and I won't get paid for another week.

omg this happened to me last year!! took them 3 weeks to give me my money back 😡 such bs

3 WEEKS?!! We can't wait that long! Did you have to keep calling them or did they just automatically put the money back?

I'm sorry you're going through this. EBT theft has unfortunately become more common. The form you filled out is probably the EBT-2259 benefit theft claim. By law, they have 10 business days to investigate and restore benefits after you submit a claim, but it often takes the full 10 days. Make sure you get a copy of your claim with a date stamp on it. In the meantime, you should immediately contact local food banks for emergency assistance. Many counties also have emergency food vouchers available while theft claims are being processed. Ask your county worker specifically about 'expedited emergency food assistance' while your claim is pending.

Thank you so much for this info! I didn't get any copy with a date stamp - should I go back and ask for one? The worker seemed really rushed and basically just handed me a new card and had me sign something.

Yes, definitely go back and ask for a copy with the date stamped. That's your proof of when you submitted the claim, which starts the 10-day clock. Without it, they could claim delays in processing. Also ask specifically if your county has emergency food assistance while theft claims are being processed - not all workers will volunteer this information unless you specifically ask.

check ur transactions on the EBT website... u can see exactly when and where they used it. print that out too to show the fraud ppl

Good idea! I just looked and they drained it at an ATM in another city at 3am!!! I've never even been to that city. Definitely taking screenshots.

This is happening way too often now with skimmers on card readers. For anyone reading this - always check the card slot before swiping your EBT card and cover the keypad when entering your PIN. As for getting your benefits back faster, try calling your county office directly. However, it's extremely difficult to get through on their phone lines. I recently discovered a service called Claimyr (claimyr.com) that actually connects you with a live CalFresh worker instead of waiting on hold for hours. They have a video showing how it works: https://youtu.be/eZ19FHRETv8?si=_CXnXqNXbLl26WB8 It helped me resolve an issue when my benefits were incorrectly calculated. Might be worth trying to speed up your claim process.

Thank you!!! I'll try anything at this point. Their phone system is the worst - I tried calling this morning and gave up after 45 minutes on hold.

Be careful with those services though. I used something similar once (not Claimyr) and they charged me way more than they said they would. Just make sure you read everything before you sign up.

That's definitely good advice. I had a good experience with Claimyr specifically, but always good to be cautious with any service. In my case, it was worth it because I was missing over $300 in benefits that were eventually corrected.

this is y i always transfer my calfresh to my bank account as soon as it hits!!! u can do that now with the connectEBT app... then nobody can steal it!!!

This is partially correct but needs clarification. You can transfer CASH benefits (CalWORKs) to a bank account, but not CalFresh food benefits. CalFresh benefits can only be used for food purchases directly with the EBT card. It's important not to confuse the two programs as they have different rules.

oh shoot ur right... i get both so i get confused. My bad!!

I had $340 stolen last November, and it took exactly 10 business days to get it back. The day I reported it, I asked about emergency food assistance and was referred to a local food bank partnered with CalFresh. They were able to provide me with emergency groceries the same day. One tip: I had to be very specific about what was purchased fraudulently. Looking at your EBT transaction history online will show exactly when, where, and how much was taken. Print this out or take screenshots and bring it with you when you follow up. This speeds up the verification process considerably.

Thank you for sharing your experience! I'm going to call tomorrow and specifically ask about emergency food assistance. Did they put the money back automatically after 10 days or did you have to keep calling them?

They put it back automatically on day 10. I did call on day 8 to check status though, and they confirmed it was being processed. Definitely ask about emergency assistance - not all county workers will automatically tell you about it.

Something similar happened to me but I think it was because of a system glitch not theft? My balance showed $0.01 for like two days then suddenly all my benefits were back. Maybe check again tomorrow before panicking? The EBT system has been really glitchy lately with all their updates.

I wish it was just a glitch! But I checked the transaction history and someone definitely used my benefits at 3am at some store I've never been to. The county confirmed it looks like theft. But thanks for the suggestion.

idk if anyone said this yet but you should also file a police report!! my cousin had this happen and they wouldn't refund her until she brought in a police report number

This varies by county. Some counties require a police report for EBT theft claims over a certain amount (usually $400+), while others don't. It never hurts to file one though, as it creates an official record of the theft. You can usually file non-emergency police reports online now in most California cities.

UPDATE: I called the county office using that Claimyr service someone mentioned, and actually got through to a real person! They confirmed my claim is in process and should be resolved within 10 business days. The worker also referred me to two local food banks that can help with emergency food assistance while I'm waiting. One of them has a special program for families with CalFresh theft issues. Going there tomorrow morning. Still super stressed but at least we won't go hungry while waiting for the refund. Thanks everyone for your help!
