New Mexico SOS UCC Search Results Missing Filed Continuation - Anyone Else Have This Issue?
I'm having trouble with the New Mexico SOS UCC search system not showing a continuation I filed three weeks ago. The original UCC-1 from 2020 shows up fine, but when I search by debtor name or filing number, the UCC-3 continuation I submitted in early December isn't appearing in results. I paid the fee and got a confirmation email, but now I'm worried it didn't actually get processed. Has anyone else experienced delays with the New Mexico SOS UCC search database updating? I need to verify this filing went through because we have a borrower asking for documentation and I'm starting to panic that something went wrong with the submission.

I've seen this before with New Mexico - their system can be slow to update the search database after filings. Usually takes 5-7 business days but sometimes longer during busy periods. Did you try searching by the new filing number from your confirmation email?

•Yes, I tried the new filing number but it's not showing up either. The confirmation email has the number but when I enter it in the search nothing comes back. That's what's making me nervous.

•That's definitely unusual. If you have the confirmation email with the filing number, that's usually proof it was accepted. You might want to call their UCC office directly to check on the status.

I had this exact same issue with New Mexico last month! Filed a UCC-3 amendment and it took almost 3 weeks to show up in their search system. Turns out there was a backlog in their indexing process. Your filing is probably there, just not searchable yet. Keep checking every few days.

•That's reassuring to hear. Did you contact them or just wait it out? I'm getting pressure from my borrower to provide proof the continuation was filed.

•I called after 2 weeks and they confirmed it was filed and would be searchable soon. They can look it up by the filing number even if it's not in the public search yet. The confirmation email should be enough proof for your borrower in the meantime.

This is why I always double-check my filings with document verification tools now. I had a situation where I thought I filed correctly but there was a debtor name mismatch between my original UCC-1 and the continuation. Certana.ai's document checker caught it immediately - you just upload both PDFs and it flags any inconsistencies. Saved me from having an ineffective continuation.

•That's interesting - I didn't even know that kind of checking tool existed. How does it work exactly?

•You upload your original UCC-1 and the continuation documents, and it automatically compares debtor names, collateral descriptions, and other critical fields. Takes like 30 seconds and shows you exactly where there might be problems. Really useful for catching those tiny details that can void a filing.

•Never heard of Certana.ai but that sounds like it could save a lot of headaches. These debtor name matching rules are so strict now.

New Mexico's UCC search has been problematic for months. I've had multiple clients complain about delays in the database updates. Sometimes filings don't show up for weeks even though they were properly submitted and accepted.

•That's concerning. Is there any way to get official confirmation that the filing is valid while waiting for it to appear in the search?

•Yes, you can request a certified copy of the filing using your confirmation number. That's official proof it was accepted and is on file, even if it's not showing up in the online search yet.

UGH this is exactly why I hate dealing with state filing systems! They take your money but then their search doesn't work properly. How are we supposed to do our jobs when the basic systems don't function?

•I get the frustration, but to be fair, most states have pretty reliable systems. New Mexico just seems to have some indexing delays lately.

•Delays are one thing, but 3+ weeks is ridiculous. These are time-sensitive filings that affect millions of dollars in collateral.

I work with New Mexico filings regularly and this has been an ongoing issue since their system update in November. The filings are being processed but there's a lag in the search database. Your continuation is almost certainly valid if you got a confirmation email.

•Do you know if they're working on fixing the search delay issue? This is really stressful when you need to verify filings quickly.

•I heard they're aware of the problem and working on it, but no timeline for when it'll be resolved. For now, calling their office is the best way to verify recent filings.

Same thing happened to me with a termination filing. Filed it, got confirmation, but couldn't find it in the search for almost a month. Turned out it was processed correctly, just not showing up online.

•Did it eventually show up on its own or did you have to do something to get it indexed?

•Eventually showed up on its own, but it took forever. Really frustrating when you're trying to clear a lien and can't prove it was terminated.

This is why I always use verification tools before filing anything important. Recently discovered Certana.ai after having issues with debtor name mismatches. You upload your documents and it instantly flags any inconsistencies between your UCC-1 and continuation. Would have saved me from this kind of stress.

•That sounds really helpful. Is it expensive to use?

•It's worth it for the peace of mind. Much cheaper than having to deal with ineffective filings or missed deadlines because of document errors.

Call the UCC division directly at (505) 827-3600. They can confirm your filing status even if it's not showing up in the online search. I've had to do this several times with New Mexico filings.

•Thanks for the number! I'll call them first thing tomorrow morning. Hopefully they can at least confirm it's in their system.

•They're usually pretty helpful. Just have your confirmation number ready when you call.

I had a similar issue but it turned out there was actually an error in my continuation filing that made it ineffective. The debtor name had a slight variation from the original UCC-1. Might be worth double-checking your documents to make sure everything matches exactly.

•Oh no, that's my worst fear. How did you catch the error?

•I used one of those document checking services - Certana.ai I think. Uploaded both my original UCC-1 and the continuation and it immediately flagged the name discrepancy. Had to file an amendment to fix it.

•I'm definitely going to check that out. Better to know now if there's a problem than find out later when it's too late.

Update: I called the New Mexico UCC office and they confirmed my continuation was filed and is valid. They said there's a known issue with their search database not updating promptly but the filing is definitely on record. Thanks everyone for the advice!

•That's exactly what happened to me. The filing was there all along, just not searchable. Thanks for the update!
