ESD overpayment waiver approval time + getting unpaid weekly claims?
Hi everyone, I've got an overpayment waiver that's been sitting in 'pending' status for what feels like forever. For those who had their overpayment waivers approved - how long did yours take to go from 'pending' to actually getting a decision? I'm starting to get nervous. Also, I have a somewhat complicated situation. There were 13 weeks where I properly filed my weekly claims but never received payment on them. If my overpayment waiver gets approved, will I also get back-payment for those 13 unpaid weeks? Or are those considered separate issues? My overpayment amount is around $7,800 and I really can't afford to pay it back. The unpaid weeks would be worth about $5,200 that I never received but was eligible for. Any insights from those who've been through something similar would be incredibly helpful. Thanks!

The 13 unpaid weeks and your overpayment waiver are separate issues. Even if your waiver is approved, it doesn't automatically trigger payment for those unpaid weeks. You need to contact ESD specifically about those unpaid weeks and find out why they weren't processed. I went through something similar last year. My overpayment waiver took EXACTLY 9 weeks from when it showed 'pending' until I got a determination letter. The letter came by mail first, then my eServices account updated a few days later. For your unpaid weeks, you really need to talk to an actual agent. Those weeks might be stuck in adjudication for some unresolved issue that isn't obvious from your account view. THEY ARE THE WORST!!! my waiver was "pending" for 12 freakin weeks and then they DENIED it even tho i cant pay rent now!!! appealed it 2 months ago and STILL waiting for a hearing date. ESD is a nightmare. good luck getting those 13 weeks, I had 6 weeks they never paid me and im stil fighting for them!!!!!

i had a waiver take like 2 months then got approved. but my friend had hers done in like 3 weeks so i guess it depends? for your unpaid weeks you gotta call them direct cuz thats a different problem

My bro-in-law works at ESD (not in claims dept tho). He says they're SUPER backed up right now due to staff shortages and some new computer system they're implementing. Said wait times on everything are like 30% longer than normal. Just a heads up that you might need extra patience right now.

btw one more thing i just remembered - if you submitted any documents with your waiver request you should double check and make sure they got uploaded correctly. my friend had her waiver denied because she thought shed uploaded her bank statements but they never actually went through the system for some reason
