Do notary public training & application count as ESD job search activities?
I've been on unemployment since my accounting job was eliminated last month. I'm thinking of becoming a mobile notary public as either a side gig or possibly full-time work. Would activities related to setting up as a sole proprietor count toward my three required job search activities per week? Specifically: - Applying for my notary public commission through the WA Secretary of State - Taking the required notary training courses online - Setting up my business license through the state I'm still applying for regular accounting positions, but I want to make sure I'm meeting all the ESD requirements while I pursue this potential opportunity. Has anyone had experience counting self-employment preparation activities for their weekly claim? I don't want to get hit with an overpayment notice later if I'm doing this wrong.

Yes, activities toward self-employment can count for job search requirements! According to ESD guidelines, if you're taking concrete steps toward establishing self-employment, these can count as job search activities. The key is documenting everything properly in your job search log. Make sure you write detailed descriptions for each activity including: - The specific action taken (application submitted, training completed) - Date and time spent - How it directly relates to establishing your business I successfully used activities related to starting my freelance business last year while on UI. ESD approved them without issues.

•That's really helpful, thank you! Did you have to provide any additional documentation when you logged these activities? I'm worried about getting flagged for review if my activities don't look like traditional job applications.

idk i tried to count some online courses for my side hustle and got a letter saying they didn't qualify. something about how they weren't "employer directed" whatever that means. ended up having to do more applications that week to catch up

•That's because there's a difference between random skill-building courses and specific steps toward establishing self-employment. For self-employment to count, you need to be taking concrete business establishment steps, not just general training. The notary commission application and business license setup should definitely count as they're specific legal requirements for establishing the business.

I was in a similar situation last year - started a bookkeeping business while on UI. Here's my experience: activities directly related to establishing your business DO count, but only if you document them properly! ESD actually has a Self-Employment Assistance Program (SEAP) for people looking to start their own businesses while on unemployment. You might want to look into that as well - it waives the job search requirements entirely if you're approved. BUT be careful - if you start making money from your notary work, you MUST report it on your weekly claims. Even small amounts can reduce your benefits, and not reporting income is the fastest way to get hit with an overpayment notice.

•I hadn't heard about SEAP! That sounds like it might be perfect for my situation. Do you know if it's hard to get approved for that program? I'll definitely look into it right away.

•It's not super easy to get into SEAP - you need a solid business plan and to meet eligibility requirements. But definitely worth exploring! Here's the link: https://esd.wa.gov/jobs-and-training/self-employment-assistance

I'd actually recommend calling ESD directly to confirm this. You don't want to risk your benefits based on forum advice. Unfortunately, getting through to ESD is notoriously difficult right now. I recently used Claimyr (claimyr.com) to get through to an ESD agent quickly after spending days trying to reach someone. They have a system that connects you with an ESD agent usually within 2 hours versus the days of redialing on your own. They have a video that shows how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The agent I spoke with was really helpful and clarified exactly what self-employment activities would qualify for my situation. Worth getting the official word so you don't have issues down the road.

•That's good advice - I'd feel better having official confirmation. I've been trying to call for days without getting through. I'll check out that service, thanks!

•I second this. I used Claimyr last month when I had questions about my standby status and got through to ESD in about 45 minutes after trying for a week on my own. The peace of mind from getting an official answer directly from ESD was totally worth it.

WATCH OUT with self-employment!! My cousin tried starting a lawn care biz on unemployment and ESD came after him SIX MONTHS LATER saying he wasn't "available for work" because he was "self-employed" even though he was still applying for jobs!!! They made him pay back $6,400!!! The whole system is designed to SCREW YOU OVER!!!

•That's not typically how it works if you're doing things correctly. Your cousin likely either didn't report income properly or wasn't actually available for traditional employment. As long as you remain available for regular work and properly report any self-employment activities and income, you should be fine. This is why documenting everything clearly and getting official guidance is so important.

•Maybe, but they NEVER made it clear to him what the rules were. They just expected him to somehow KNOW everything. These govt agencies just make up rules as they go!!!

I became a notary last year! Totally off topic but if u need advice on getting started let me know. Mobile notary can be good money especially if u do loan signings. I didn't try to count it as job search stuff when i was on UI tho so cant help with that part sorry!

•I'd love some advice on getting started as a notary! Did you take any specific training courses you'd recommend? How long did the whole process take from application to being able to accept clients?

•I took the NNA certification course, cost about $189 but worth it. Whole process took about 6 weeks from submitting my application to getting my stamp and being ready to work. I recommend joining some notary groups on Facebook - that's where I get most of my signing gigs now!

One more thing to be aware of - ESD has specific requirements about what counts as a "job search activity" for self-employment. According to their guidelines, these typically need to be: 1. Specific actions that directly establish your business (like your notary application, getting business licenses, etc.) 2. Activities that would reasonably lead to income-producing opportunities 3. Properly documented with dates, time spent, and outcomes General research probably won't count, but completing required notary training, submitting your application to become commissioned, and setting up your business license should all qualify as concrete steps toward establishing self-employment. Also look into WorkSource's self-employment resources - attending one of their small business workshops definitely counts as a job search activity and they can give you additional guidance.

•This is incredibly helpful - thank you! I'll check out the WorkSource workshops too. I think I'm on the right track with focusing on the application, licensing, and required training as my activities. I'll make sure to document everything meticulously.

•Yes, potentially! Activities specifically related to establishing and expanding your Etsy business could count - things like business license applications, creating wholesale accounts with suppliers, setting up business banking, developing your product line, etc. But again, best to confirm with ESD directly what would count in your specific situation.
