Can you collect unemployment after long-term disability runs out in Washington?
My long-term disability benefits through my employer are ending next month after 2 years. I'm still dealing with some health issues but my doctor says I can work part-time or maybe full-time with accommodations. I haven't worked since 2022 when I went on disability. Can I file for Washington ESD unemployment benefits once my LTD runs out? I'm worried about the gap between when disability ends and when I find a new job. Has anyone been in this situation before?

Yes, you can potentially qualify for unemployment benefits after LTD ends, but you'll need to meet Washington ESD's requirements. The key is that you must be able and available for work. Since your doctor cleared you for work with accommodations, that's a good sign. You'll need to register with WorkSource and actively search for jobs that match your current abilities.

•That's helpful, thank you. Do I need to wait until my LTD officially ends to apply, or can I file ahead of time?

•You should file as soon as your LTD benefits end. Don't file before then because you need to be immediately available for work when you submit your claim.

I went through this exact situation last year. The tricky part is proving you're able and available for work after being on disability. Washington ESD might question whether you can actually work. Make sure you have documentation from your doctor about your work capacity.

•What kind of documentation did you need? Just a note from your doctor or something more detailed?

•I had to get a detailed letter from my doctor explaining exactly what I could and couldn't do, and that I was cleared to return to work with specific accommodations. Washington ESD asked for it during my eligibility review.

The biggest hurdle you'll face is getting through to Washington ESD to discuss your specific situation. I spent weeks trying to reach them when I had questions about my claim status. If you run into phone issues, there's a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•Thanks for the tip! I'll definitely need to talk to someone there about my situation since it's complicated.

•Never heard of that service but might be worth it if the phone lines are still as bad as they were last year.

One thing to be aware of - if you received any severance or continuation of benefits from your employer, that might affect your unemployment eligibility timing. Washington ESD has specific rules about when you can start collecting if you received certain types of payments.

Kevin Bell
•I didn't get severance but my employer did continue my health insurance. Would that count?

•Health insurance continuation usually doesn't affect UI eligibility, but definitely mention it when you file your claim to be safe.

ugh the whole system is so confusing when you have health issues. I tried to file after my short term disability ended and they made me jump through so many hoops to prove I could work. It took forever to get approved.

•How long did it take for you to get approved? I'm worried about the financial gap.

•About 6 weeks total because they had to do an adjudication review. Make sure you have ALL your medical paperwork ready when you file.

Also remember that your benefit amount will be based on your earnings from your base period, which for 2025 would be looking at your wages from 2023. Since you were on disability in 2022-2024, your benefit calculation might be affected if you didn't have enough qualifying wages.

Kevin Bell
•Oh no, I was working full time in 2023 before going on disability, so hopefully that helps with my benefit amount.

•That should work in your favor then. As long as you had sufficient wages in your base period, you should qualify for a decent benefit amount.

Make sure you understand the job search requirements too. Washington ESD requires you to make a certain number of job contacts each week and keep a log. With your health restrictions, you'll want to focus your search on employers who are ADA compliant.

Kevin Bell
•Good point about the ADA compliance. I'll need to be strategic about where I apply.

•Exactly. And document everything - every application, every accommodation request, every response. Washington ESD can audit your job search activities.

just wanted to say good luck with this process. going from disability to unemployment is tough but you can do it. the key is having all your paperwork organized before you start.

•Thank you! I'm trying to get everything together now so I'm ready when my LTD ends.

One more thing - if Washington ESD denies your claim initially, don't panic. You have the right to appeal and many people win their appeals, especially in situations like yours where there's a transition from disability to work-ready status. The appeals process can take time but it's worth pursuing if you believe you qualify.

Kevin Bell
•That's reassuring to know. Hopefully it won't come to that but good to know I have options.

•The key is acting quickly if you do get denied. You only have 30 days to file an appeal after the determination is mailed to you.

I work in HR and see this situation fairly often. The biggest mistake people make is not getting proper medical documentation upfront. Your doctor's clearance needs to be very specific about your capabilities and limitations. Vague statements won't cut it with Washington ESD.

Kevin Bell
•What should I ask my doctor to include in the letter?
0 coins
Ryder Everingham
•Ask for a detailed work capacity evaluation that specifies things like hours you can work, physical limitations, accommodation needs, and a clear statement that you're medically cleared to return to work.

Also be prepared for them to potentially schedule you for a phone interview or ask for additional documentation. When I filed, they wanted to verify that I was genuinely able to work and not just trying to get benefits while still disabled. Having that doctor's letter was crucial.

Kevin Bell
•Did they ask you specific questions about your limitations during the interview?
0 coins
Felix Grigori
•Yes, they asked about my daily activities, what types of jobs I could do, and how my condition might affect my work. Be honest but emphasize your abilities, not just your limitations.

this whole process is stressful enough without having to worry about whether you'll get approved. i wish washington esd made it clearer what they need from people transitioning off disability.

•It really is confusing. I feel like I'm flying blind here.

•That's why it's so important to get professional advice, whether from a lawyer who specializes in unemployment law or by actually speaking to Washington ESD directly about your specific situation.

Speaking of getting through to Washington ESD, I mentioned Claimyr earlier but wanted to emphasize how much it helped me. I was on hold for literally hours trying to reach them about my claim complications. The service got me through to an actual person who could answer my questions. Definitely worth considering if you need to discuss your specific disability-to-unemployment transition.

Kevin Bell
•I'll definitely look into that. Getting actual answers from a real person would be so helpful.

•Bookmarking that site for future reference. The phone system there is impossible otherwise.

Don't forget about the waiting week requirement. Even if you're approved for benefits, there's typically a one-week waiting period before you start receiving payments. Plan your finances accordingly since you'll already have a gap between LTD ending and potentially getting your first UI payment.
0 coins
Kevin Bell
•Good point about the waiting week. I need to budget for that gap period.
0 coins
Lilly Curtis
•Exactly. And make sure you file your weekly claims on time every week, even during the waiting period. Missing a week can cause delays in your benefits.

Another consideration - if you find part-time work while on unemployment, you can potentially still receive partial benefits. Given your health situation, part-time work might be a good transition back to full-time employment. Washington ESD has specific rules about working while on UI, so make sure you report any earnings correctly.
0 coins
Kevin Bell
•That's actually perfect because my doctor thinks I should start with part-time work anyway. How do I report part-time earnings?
0 coins
Mikayla Davison
•You report all earnings when you file your weekly claim. They'll reduce your benefits based on how much you earned, but you can still receive partial payments if you're working less than full-time.

Make sure you register with WorkSource Washington as soon as you file your claim. They have resources specifically for people with disabilities who are looking for work, including job placement assistance and employer connections that are disability-friendly.

Kevin Bell
•I didn't know WorkSource had disability-specific services. That could be really helpful.

•Yes, they have vocational rehabilitation services and can help you find employers who are experienced with accommodating workers with health conditions.

just remember to keep copies of everything you submit to washington esd. medical records, applications, correspondence, everything. if there are any issues with your claim, you'll need that documentation.

Kevin Bell
•Good advice. I've learned to keep copies of everything after dealing with the disability insurance company for two years.

One final tip - be patient with the process but persistent in following up. Transitioning from disability to unemployment benefits isn't the most common situation, so it might take longer than a typical claim to process. Don't be discouraged if it takes a few weeks to get everything sorted out.

•Thank you all for the advice. This has been incredibly helpful in preparing for this transition.

I went through something similar but with workers comp instead of LTD. The key thing Washington ESD cares about is that you're genuinely able to work and actively looking for employment. Having medical clearance helps but they'll also look at your job search efforts to make sure you're serious about finding work.
0 coins
Kevin Bell
•That makes sense. I'm definitely serious about getting back to work, just need to find the right fit for my situation.

•That attitude will serve you well. Document your job search efforts carefully and apply to positions that match your abilities. Washington ESD wants to see that you're making a genuine effort.

Just wanted to circle back on the Claimyr service since a few people asked about it. It's basically a callback service that gets you through Washington ESD's phone queue automatically. You give them your number and they call you back when an agent is available. Saved me hours of waiting on hold when I needed to resolve an issue with my claim status. The demo video explains it better than I can.
