which of the following individuals is eligible for unemployment benefits - NYS Department of Labor question help
I'm studying for a test and got confused about NYS Department of Labor eligibility rules. The question asks which individuals qualify for unemployment benefits but I can't figure out the right answer. Does anyone know the basic requirements for UI eligibility in New York? I know you have to be able and available for work but what else? Really need help understanding this before my exam tomorrow.

For NYS Department of Labor unemployment eligibility, you need to meet several key requirements: 1) Lost employment through no fault of your own (laid off, not fired for misconduct), 2) Have sufficient work history and earnings in your base period, 3) Be physically able and available for work, 4) Actively seeking employment, and 5) Register with the job search system. You also can't be receiving other benefits like workers comp at the same time.

•Thank you! So someone who quit their job wouldn't qualify right? What about if they were fired for poor performance vs misconduct?

the work history part is important too - you need to have worked and earned wages in at least 2 quarters of your base period. I think its like $2800 total but dont quote me on that exact number

•It's actually higher now - you need at least $3,300 in total wages during your base period for 2025, with wages in at least two different quarters. The NYS Department of Labor updates these amounts annually based on the state average wage.

I had to deal with NYS Department of Labor eligibility issues last year when my claim got stuck in adjudication for weeks. The able and available requirement is stricter than people think - you have to prove you're genuinely looking for work and can accept a job if offered. If you have medical restrictions or transportation issues that limit your availability, it can affect your eligibility.

•That's really helpful context. How do they verify that you're actively seeking work? Is it just the job contacts you log or do they check other things?

•The NYS Department of Labor requires you to make at least 3 job contacts per week and keep a detailed log. They can audit your job search activities at any time, so you need to maintain records of where you applied, when, and what type of position. Some people get disqualified for insufficient job search efforts.

Getting through to someone at NYS Department of Labor to clarify eligibility questions used to be impossible until I found claimyr.com. They help you actually reach a real agent who can explain your specific situation. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Way better than spending hours on hold or getting hung up on.

Don't forget about the voluntary quit rules! If you quit for certain reasons like unsafe working conditions, domestic violence, or significant changes to your job terms, you might still be eligible. But the burden of proof is on you to show it was for good cause.
