What is the worst type of unemployment situation with NYS Department of Labor claims?
I've been dealing with different unemployment situations over the past few years and I'm curious what others think is the absolute worst scenario when it comes to NYS Department of Labor claims. Is it being stuck in adjudication limbo for months? Getting hit with an overpayment notice? Having your claim denied after waiting weeks? Or maybe it's something else entirely like getting disqualified right before your benefits run out? I'm asking because I feel like I've experienced most of these nightmares and wondering if there's something even worse I haven't encountered yet.

In my experience helping people with NYS Department of Labor issues, the worst scenario is definitely getting an overpayment notice after you've already spent the money on necessities. The appeal process can take months, and during that time you're not only without new benefits but also facing the stress of having to pay back thousands of dollars. At least with adjudication delays, you eventually get paid retroactively if approved.

for me its definitely the endless adjudication with no communication. at least with overpayments you know whats happening even if its bad news. i've been waiting 8 weeks for them to review my case and my account just says 'adjudication in progress' with zero explanation of what theyre even looking at

•Have you tried reaching out through the my.ny.gov message system? Sometimes that gets faster responses than calling. Though honestly, getting through to anyone at NYS Department of Labor is a nightmare regardless of the method.

I think the worst is when you get disqualified and then have to navigate the appeals process while having zero income. The hearing process can take 2-3 months, and if you lose that you have to go to the next level which takes even longer. During all this time you can't file new claims and you're basically left with nothing while fighting to prove you deserve benefits you should have gotten in the first place.

The WORST is definitely when you're on standby status and your employer keeps jerking you around with callback dates. You can't look for other work because you're supposed to be available for recall, but they keep pushing back the date. Then if you do take another job, they might call you back the next week and you lose both opportunities. It's like being in employment purgatory.

idk all these sound pretty bad but at least you guys qualified for unemployment in the first place. i got denied because i was a contractor and apparently didnt pay into the system enough. now im trying to figure out if i can appeal that but the whole process is confusing as hell
