What does it mean to be disqualified from unemployment - NYS Department of Labor sent notice

I just got a letter from NYS Department of Labor saying my claim has been disqualified and I'm confused about what this actually means. I was working at a retail store for 8 months and got laid off due to slow business. I thought I did everything right when I filed my claim but now they're saying I'm disqualified. Does this mean I can never get unemployment? Can I fix this somehow? The letter mentions something about an appeal but I don't understand what I supposedly did wrong in the first place.

Disqualification doesn't mean you're permanently banned from unemployment benefits. It usually means NYS Department of Labor determined you don't meet the eligibility requirements for some reason. Common causes include quitting voluntarily, being fired for misconduct, not being able and available to work, or not meeting the job search requirements. Check your determination letter carefully - it should explain the specific reason for disqualification.

The letter is really confusing but it mentions something about 'separation from employment.' I definitely didn't quit though, they laid me off because they were cutting hours for everyone.

You have the right to appeal any disqualification decision. You typically have 30 days from the date on the determination letter to file an appeal. During the appeal process, you can present evidence and explain your side of the story. If you were truly laid off due to lack of work, that should qualify you for benefits assuming you meet all other requirements.

Do I need a lawyer for the appeal or can I handle it myself? I'm worried about making things worse.

You can definitely handle it yourself. Many people do. Just gather any documentation you have about your layoff - final paycheck stub, any written notice from your employer, etc. Be clear and factual in your appeal letter.

had the same thing happen to me last year, turned out my former employer told NYS Department of Labor I was fired for attendance issues when I was actually laid off. took 6 weeks to get it sorted out but I eventually got all my back benefits

How did you prove what really happened? I'm worried it's just my word against theirs.

I had trouble reaching NYS Department of Labor to get clarification on my disqualification. The phone lines are always busy and online messages take forever. I ended up using this service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and redialing.

Never heard of that before. Does it actually work or is it just another scam?

It's legit. They basically handle the calling for you and connect you when an agent is available. Really helpful when you need to talk to someone at NYS Department of Labor about your specific case.

The whole system is ridiculous honestly. They disqualify people left and right for the smallest reasons then make you jump through hoops to prove you deserve benefits you already paid into through your taxes!!

I feel you on this. The bureaucracy is insane sometimes.
