What are the qualifications for unemployment benefits in New York - NYS Department of Labor requirements?
I just got laid off from my job at a marketing firm after working there for 8 months. This is my first time dealing with unemployment and I'm completely lost about whether I even qualify. I've been reading the NYS Department of Labor website but it's confusing with all the technical language. Can someone break down what the actual qualifications are for getting unemployment benefits? I made about $45,000 last year and worked full-time. Do I need to have worked for a certain amount of time? What if I quit my previous job before this one?

The basic qualifications for NYS unemployment benefits are: 1) You must have worked and earned wages in at least two calendar quarters during your base period (usually the first 4 of the last 5 completed calendar quarters), 2) You must have earned at least $2,600 in your highest quarter, 3) Your total base period wages must be at least 1.5 times your highest quarter earnings, 4) You must be unemployed through no fault of your own (layoffs qualify, quitting usually doesn't), 5) You must be able and available to work, and 6) You must actively search for work. Since you were laid off and worked 8 months, you should definitely qualify if you meet the wage requirements.

•Thank you! That's really helpful. I think I meet the wage requirements since I worked full-time. How do they calculate the base period exactly? I'm confused about the calendar quarters part.

The base period is key - it's the first four of the last five completed calendar quarters before you file your claim. So if you file in January 2025, your base period would be January-December 2024. The NYS Department of Labor looks at your wages during those quarters to determine if you qualify and how much you'll get. You can check your wage history on the my.ny.gov portal once you create an account.

•wait so if i quit my last job before getting laid off from this one does that mess up my qualification?? i left my previous job in march because my boss was terrible

•No, quitting a previous job won't disqualify you as long as your most recent separation was due to a layoff. The NYS Department of Labor looks at your most recent work separation to determine if you're eligible. However, if there was a gap between jobs, make sure you have enough qualifying wages in your base period.

I had so much trouble getting through to NYS Department of Labor when I needed to verify my qualification status last year. The phone lines are always busy and their online chat never works. I ended up using this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Made the whole process so much easier than sitting on hold for hours.

•That sounds useful! I'm worried I'll have questions after I file and won't be able to get answers. How much does something like that cost?

•They focus more on the value of actually reaching someone rather than the cost. Honestly after spending entire days trying to call NYS Department of Labor myself, it was worth it just to get my questions answered quickly.

Just file already! The NYS Department of Labor system is designed to be confusing on purpose so people give up. You worked, you got laid off, you probably qualify. The worst they can say is no and then you appeal. I've been through this process three times and each time they try to make it seem more complicated than it is.

•This is true, the system is unnecessarily complex but don't let that stop you from applying. Even if there are issues with your claim, you can usually resolve them during the adjudication process.

•I feel you on the website confusion! What helped me was breaking it down into simple steps: 1) Check if you have enough work history (sounds like you do if you worked full-time), 2) Make sure your job loss wasn't your fault (layoffs count), and 3) Just start the application online. The system will actually tell you if you qualify or not once you input your work history. Don't overthink it - if you worked and got laid off through no fault of your own, you probably qualify. The NYS Department of Labor representatives can help clarify any specific questions during the process.
