NYS Department of Labor disqualification - which action would disqualify an applicant from receiving unemployment compensation?

I'm worried about maintaining my unemployment benefits and want to make sure I don't accidentally do something that would get me disqualified. I've been receiving UI payments for about 6 weeks now but I'm getting conflicting advice from friends about what could cause NYS Department of Labor to cut me off. Some say missing one weekly claim filing will disqualify me, others say only quitting a job offer matters. Can someone clarify which specific actions would actually disqualify an applicant from receiving unemployment compensation? I don't want to mess this up.

The main disqualifying actions are: refusing suitable work without good cause, quitting a job without good cause, being fired for misconduct, not being able and available for work, and failing to actively search for employment. Missing weekly claim certifications won't immediately disqualify you but can delay payments. The key is 'suitable work' - it has to match your skills and pay at least 80% of your previous wage during the first 10 weeks of benefits.

What counts as 'good cause' for refusing a job? I had an interview last week for something that seemed sketchy and I'm worried about saying no to the wrong opportunity.

You also get disqualified if you're not reporting work or earnings correctly on your weekly claims. Even small cash jobs need to be reported to NYS Department of Labor. I learned this the hard way when they caught an unreported day of work from 2 months prior and hit me with an overpayment notice.

How did they find out about your unreported work? This makes me nervous about some odd jobs I did.

dont worry too much about one missed filing, they give you like 7 days to make it up or something. the real problem is if you turn down jobs that are actually good matches for your experience

I had trouble reaching someone at NYS Department of Labor to clarify my specific situation when I was worried about potential disqualification. Ended up using this service called Claimyr (claimyr.com) that got me through to an actual agent in like 10 minutes instead of hours on hold. There's a demo video at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped me understand my job search requirements before I made any mistakes.

That sounds helpful! Did they charge you a lot for getting through to NYS Department of Labor?

It was worth it for the peace of mind. Much easier than trying to get through on my own and worrying about whether I was doing everything right.

I'm in the same boat - so stressed about accidentally messing up my claim! The unemployment system makes everything sound so complicated. What if I get sick and can't look for work for a few days? Does that disqualify me too??

Being temporarily unable to work due to illness typically doesn't disqualify you as long as you report it properly and you're generally able and available. The key is being honest in your weekly claim about your availability.

The whole system is designed to trip you up! They make the rules so confusing that half the people end up disqualified for technicalities. I swear NYS Department of Labor wants people to mess up so they don't have to pay benefits.

Just keep doing your job searches and be honest on your weekly claims. Most disqualifications happen because people try to game the system or don't understand the work search requirements.
