NY unemployment back pay forms never filed - how long until they contact me?

Hey guys. I finally called the NY unemployment line to ask about an update for my back pay (been waiting since February 2025) and they dropped a bombshell - they said nobody ever filled out the proper forms for me! Apparently my initial claim processor missed a step. So supposedly now the proper form (I think it was a TC-12.3) was filled out while I was on the call and I was told to wait until I'm contacted by either the online message portal or via phone. Has anyone been through this step? How long does it take to get contacted back after the back pay form is finally submitted? I've already waited 3 months thinking everything was processing, so I'm getting really frustrated with the whole system. Thanks!

Unfortunately this happens a lot with NY unemployment backpay requests. The TC-12.3 form (Request for Retroactive Payment Determination) needs to be explicitly filed, even though logically it should have been part of your initial claim processing. Based on my experience earlier this year, you should get contacted within 2-3 weeks through your message portal. If you don't hear anything after 3 weeks, call again and ask for a 'status check on pending retroactive payment request.' They need to assign a specialized processor to review your case.

Thanks for the info! That's super helpful. I'll mark my calendar for 3 weeks from now. Did they end up approving your back pay request? I'm getting worried they're just going to deny it after all this time.

7 weeks?! That's ridiculous. Did you try calling them again after that long? I'm already at my wit's end dealing with this.

OMG the exact same thing happened to me last month!!! They said my TC-12.3 never got filed even though I specifically asked about it during my initial claim interview. I waited for 5 weeks after they "fixed it" and got NOTHING. No calls, no messages, NOTHING!!! Had to call back AGAIN and spend FOUR HOURS trying to get through to a human being. They told me "oh we see the form but it wasn't properly routed to a processor" whatever THAT means!! They're just making excuses for their broken system!!

That's exactly what I'm afraid of happening. Did they at least fix it the second time you called?

I went through this exact situation in March 2025. Here's what I learned through the process: 1. The TC-12.3 form is actually processed by a specific backpay unit, not regular claims processors 2. The standard processing time is supposed to be 14 business days (so about 3 weeks real time) 3. You should receive a specific confirmation in your online message center when the form is properly submitted If you didn't get a confirmation message within 2-3 days of your call, it likely wasn't actually submitted properly. I recommend logging into your NY.gov account and checking your message center. If you don't see a message with the subject line "Retroactive Payment Request Received" or something similar, you should call back as soon as possible. In my case, I had to call multiple times because the form was never actually submitted despite what I was told.

This is incredibly helpful, thank you! I'm going to check my message center right now. I definitely don't remember seeing any kind of confirmation message.

Let us know what you find. If there's no confirmation message, you'll need to call back. Make sure to specifically ask them to confirm submission while you're on the phone with them.

After dealing with similar backpay issues a few months ago (January 2025), I finally found a way to get through to someone who could actually help. I was stuck in the same loop as you - forms supposedly filed but no confirmation, no callbacks, nothing. I was getting desperate after trying for weeks to reach someone when a friend told me about Claimyr.com. It's this service that helps you get through to an actual agent instead of waiting on hold forever. They have this system that holds your place in line and calls you when an agent is available. I was skeptical but their video demo (https://youtu.be/Rdqa1gKtxuE) shows exactly how it works. Within a couple hours, I got through to a senior claims specialist who found my backpay forms were sitting in a queue with nobody assigned to them. She processed everything while I was on the call and I got my backpay two weeks later. Might be worth checking out if you keep hitting walls with the regular phone system.

I hadn't heard of this service before. Might be worth trying since I've already wasted so much time. Thanks for sharing your experience!

@profile5 Yes, it worked for me and two other people I know. Just make sure you have your claim info ready when they connect you with an agent so you don't waste time once you get through.

Anyone else notice how they always blame "the system" or "the computer" for their own mistakes? When I was dealing with backpay issues I kept getting told "the system didn't process your form correctly" like the computer is some kind of sentient being making decisions lol. It's just their way of avoiding responsibility for bad customer service.

OMG THIS!!!! Exactly what they told me too! "The system didn't route your form properly" - like hello, YOU are the system! Just admit you messed up!

That's so true - the guy I talked to literally said "looks like the system never generated your TC-12.3" as if it's supposed to happen automatically without a human doing anything.

Just to add some factual information that might help others: The backpay process for NY unemployment in 2025 involves several steps: 1. Filing the TC-12.3 form (Request for Retroactive Payment) 2. Assignment to a specialized backpay processor (not a regular claims examiner) 3. Review of your work and earnings history for the backpay period 4. Determination of eligibility for each week claimed 5. Processing of payments if approved The official timeframe is 10-15 business days, but in reality, it often takes 3-6 weeks. The key is making sure step #1 and #2 actually happen. Many claims get stuck because the form is filled out but never properly submitted into the processing queue. One tip: When you call, ask them for a "confirmation number" for your TC-12.3 submission. If they can't provide one, the form probably wasn't properly submitted.

This is so helpful, thank you! I definitely wasn't given any confirmation number. I'll specifically ask for one when I call back.

Just as a follow up - did you ever get this resolved? I'm curious whether you had to call back multiple times or if they actually processed your backpay claim after that first call where they completed the TC-12.3.

I actually just called back today after checking my message center and finding no confirmation as you suggested. Had to wait almost 2 hours, but finally got through to someone who admitted the form was still sitting in a pending status. They said they've submitted it "for real this time" and gave me a confirmation number (finally!). They said I should get a message in my portal within 48 hours and then the review process would take about 2-3 weeks. Fingers crossed this time it actually happens!
