NY unemployment account flagged for fraud - 3 weeks no payment despite direct deposit update
I'm in week 3 of waiting for my NY unemployment benefits and still nothing showing up in my account. Updated my direct deposit info on Monday so fingers crossed I'll receive something by next week. When I called NYSDOL, they told me my account was still flagged for fraud, but mentioned they actually attempted to deposit money last week (which I never received). I've been out of work for over a month now, and my Benefit Year Ending date is 4/15/2025. I'm also still owed several weeks of back pay at this point. Has anyone else dealt with fraud flags on their account? If so, how long did the resolution process take? The agents on the phone couldn't give me any estimate of when this might be fixed or when I'll start receiving my benefits. Starting to get really worried about bills piling up.

Same thing happened to me in January!!! Been through this EXACT situation. The fraud dept is SO SLOW!! Took them almost 7 weeks to clear my account 😡

Nope just waited and kept certifying every week even tho I wasnt getting paid. Then one day BOOM all the backpay hit my account at once. Keep calling them every few days tho just to stay on their radar!!

Those documents are a good start. If you have a previous W-2 or recent pay stub from your last employer, that would also help strengthen your case. As for calling, Tuesday-Thursday between 1-3pm tends to have slightly shorter wait times than other periods. Avoid Mondays completely if possible.

Listen, I was stuck in fraud verification hell for 5 weeks last year. Calling the regular number is USELESS - you need to specifically reach someone in the fraud department. I wasted so much time until I found out about Claimyr.com which got me connected to an actual agent in under 10 minutes! They have this system that basically waits on hold for you and calls you back when an agent is ready to talk. The agent I got connected with was able to escalate my fraud case directly, and my account was cleared within 8 days after that call. Definitely worth checking out if you're hitting a wall with the regular channels.

Make sure you have TRUE direct deposit set up and not that Key Bank debit card. They tried sending my payment to the debit card even after I updated to direct deposit. When I finally got someone helpful on the phone, they had to completely delete the debit card info from my account before the direct deposit would actually work. Their system is STUPID.

My cousins boyfriends account was flagged for fraud back in February and he got all his back pay in like 2 weeks so i dont think its always taking months for everyone

I'm going through this RIGHT NOW too and it's a NIGHTMARE!!! Been 4 weeks for me and every time I call I get a different answer. First they said I needed to verify my identity (did that), then they said my employer disputed my claim (they didn't), then they said there was a "system flag" that needed clearing. I'm literally about to be evicted because of this bureaucratic MESS. How is it legal for them to just withhold money we're entitled to with no timeline for fixing it??? The entire system is broken beyond belief and NOBODY is held accountable!! Anyone know if contacting our state representatives ever actually helps with this stuff? I'm at my wits end here.

Contacting your state representative can actually help in some cases. Their constituent services offices often have dedicated contacts at NYSDOL who can investigate and sometimes expedite cases. Send them a detailed email with your full name, last 4 of SSN, contact info, and a timeline of your claim issues. Some representatives even have specific staff members who handle unemployment issues.

If you've been waiting more than 3 weeks with a fraud flag, request a "formal case review" the next time you call. This is different than just asking for a status update. A formal case review requires them to pull your file within 48 hours and provide you with specific information about why your claim is held and what's being done to resolve it. Many agents won't mention this option unless you specifically ask for it.

The whole fraud thing is out of control right now. My neighbor works for NYSDOL (not in fraud dept tho) and she said they're completely overwhelmed with all the identity verification backlogs. There was some massive data breach earlier this year and now they're being super cautious with everything. Annoying for us but I guess better than paying out to scammers.

UPDATE: Just saw that all my backpay finally came through! It took exactly 32 days from when my account was flagged until resolution. Hang in there everyone - keep certifying weekly and eventually it should resolve.

The thing that seemed to finally work was directly asking for a supervisor when I called last week. Regular agents kept giving me the runaround, but the supervisor actually looked deeper into my account and saw that my identity had already been verified but the system flag hadn't been removed. She manually cleared it right then.
