If I don't qualify for FMLA can I get NYS Department of Labor unemployment benefits?
My employer denied my FMLA request because I haven't been there long enough (only 8 months). Now they're saying if I take time off for my medical situation they'll consider it job abandonment. I need about 6 weeks off for surgery and recovery. If I end up losing my job because I can't get FMLA protection, would I be able to collect unemployment from NYS Department of Labor? I'm really stressed about this whole situation and don't know what my options are.

i went through something similar last year, employer wouldn't give me time off for my back surgery and when i took it anyway they fired me for attendance. initially got denied for UI but won on appeal when i showed them all my medical documentation

honestly the whole system is messed up, you work your butt off and when you actually need help there's always some technicality why you don't qualify for anything. employers know exactly how to screw you over while staying within the law
