How old can you be to file for unemployment benefits with NYS Department of Labor?
I'm turning 67 next month and just got laid off from my warehouse job after 8 years. My coworker said there might be an age limit for filing unemployment claims but I can't find anything clear on the NYS Department of Labor website. I've been working and paying into the system my whole life - can I still file for UI benefits at my age? I'm not ready to retire yet and need the income while I look for another job.

There's no maximum age limit for filing unemployment benefits in New York! As long as you're able and available to work and actively seeking employment, your age doesn't disqualify you. The NYS Department of Labor doesn't discriminate based on age - if you meet the other eligibility requirements (sufficient work history, not at fault for job separation, etc.), you can absolutely file a claim.

•That's such a relief! I was worried I'd be stuck without any income. Do I need to prove I'm actively looking for work at my age?

Your coworker was definitely wrong about the age thing. I know people in their 70s who have filed successful UI claims through NYS Department of Labor. The key is that you have to be genuinely looking for work - you can't just collect benefits while planning to retire. Make sure you keep your job search log updated because they can ask for it during your weekly claims.

•He should definitely look into it if he's still within the filing deadline! NYS Department of Labor gives you up to one year from your separation date to file an initial claim.

Had the same worry when I got downsized at 64. The application process was exactly the same as when I filed 15 years earlier. Age never came up once during the whole process with NYS Department of Labor. Just make sure you can honestly answer yes to being able and available for work each week.

If you're having trouble getting through to NYS Department of Labor to ask questions about your specific situation, I used a service called Claimyr recently that helped me reach an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Really saved me hours of trying to call the regular number.

•How much does something like that cost? I'm already worried about money

•I found it worth it just to get my questions answered quickly instead of spending days trying to get through. The peace of mind was valuable to me.

The whole system is so confusing no matter what age you are!! I'm 45 and still get overwhelmed by all the requirements and forms. At least being older means you probably have more work history to qualify with higher benefit amounts.

I'm glad you asked this question - it's a common misconception that there's an age limit! I work with a lot of folks in career transitions and can confirm that New York State doesn't have any maximum age restrictions for unemployment benefits. What matters is that you're able and available to work, actively seeking employment, and meet the standard eligibility requirements. At 67 with 8 years at your last job, you likely have strong work history that should qualify you for benefits. Don't let anyone discourage you from filing - you've earned these benefits through your contributions to the system. File as soon as possible since there can be a waiting period, and make sure to document your job search activities from day one.

•This is really helpful information! I didn't realize that having 8 years at my last job would actually help with my benefit amount. Should I file online or is it better to call given my situation? I'm reasonably comfortable with computers but want to make sure I don't mess anything up.
