Does collecting NYS Department of Labor unemployment benefits affect citizenship application status?

I've been on unemployment for about 8 months after getting laid off from my warehouse job. My citizenship interview is coming up in 3 months and I'm really worried that collecting UI benefits might hurt my application. I've been following all the NYS Department of Labor requirements - doing my weekly claims, job searches, everything by the book. But now I'm panicking that immigration will see this as a negative. Has anyone been through this process while on unemployment? Did it come up during your interview?

Unemployment insurance is NOT considered a public charge for immigration purposes. You paid into this system through your payroll taxes, so you're entitled to these benefits. The public charge rule applies to programs like cash assistance and food stamps, not unemployment insurance. Keep all your NYS Department of Labor documentation showing you're actively job searching though.

Thank you so much! That's such a relief. I have been keeping all my job search logs and weekly claim confirmations just in case.

Did you mention it on any forms or did they find out some other way? I'm trying to figure out if I should bring it up myself.

I had the same worry when I was dealing with NYS Department of Labor adjudication issues during my green card renewal. Immigration attorney told me unemployment benefits are considered earned benefits, not welfare. You worked and paid taxes for these benefits. The fact that you're following all the job search requirements actually shows you're being responsible. Keep documenting everything with NYS Department of Labor - your weekly certifications, job contacts, any correspondence about your claim status.

wait this is making me nervous too... I thought ANY government benefits could be a problem?? I've been avoiding filing for unemployment even though I qualify because I was scared about my permanent residency

No, you're thinking of the old public charge rule interpretation. Unemployment insurance has never been considered in public charge determinations. You should file if you qualify - that's what the system is for.

The NYS Department of Labor phone lines are impossible to get through if you need to verify your claim history for immigration purposes. I spent weeks trying to get documentation. Finally used a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have this video demo thing that shows how it works - https://youtu.be/qyftW-mnTNI. Got my complete benefit history printed out same day I talked to someone.

That's really helpful! I might need official documentation for my interview. The regular NYS Department of Labor website only shows limited history.

just make sure ur not lying on any forms and ur fine!! the government already knows about ur unemployment anyway from tax stuff so its not like u can hide it even if u wanted to

This whole immigration system is so confusing! Why can't they just have clear guidelines about what counts and what doesn't? I've been stressed about this exact thing for months. Good luck with your interview!

Thanks! Yeah the uncertainty is the worst part. But these responses are making me feel way better about it.

I went through this exact same situation! Was on NYS Department of Labor unemployment for almost a year while waiting for my citizenship interview. Not only did it not hurt my application, but the immigration officer actually seemed impressed that I was actively looking for work and following all the requirements. She said it showed I was being a responsible member of society. Just make sure you have your tax documents showing you paid into the unemployment system - that really helps demonstrate it's not welfare but earned benefits. You've got this!
