Can u file unemployment if u quit your job in New York?

hey everyone so i quit my job last week because my boss was basically harassing me every day and making my life hell. now im wondering can u file unemployment if u quit? i know usually you have to get fired but i literally couldnt take it anymore. has anyone been in this situation with NYS Department of Labor? do i even have a chance or should i not bother applying?

You might be able to get benefits if you quit for "good cause." Harassment could qualify as constructive dismissal if you documented it properly. NYS Department of Labor looks at whether a reasonable person would have quit under those circumstances. Did you file any complaints with HR or document the harassment?

I went through something similar last year. You need to prove "good cause" which means the working conditions were so bad that any reasonable person would quit. When you file your claim, be very detailed about what happened and why you had no choice but to leave. NYS Department of Labor will review your case during adjudication.

how long did the adjudication take for you? and did you end up getting approved?

It took about 6 weeks for them to make a decision. I was approved because I had emails showing my supervisor's behavior. The key is having some kind of evidence.

Just apply honestly. Worst case they say no and you're in the same position. But if you can show the harassment made working conditions unbearable, you might qualify. Make sure to be completely honest on your application about why you quit.

The NYS Department of Labor considers several factors for good cause quits: workplace safety, harassment, significant changes to job duties, or failure to pay wages. You'll need to provide specific examples during your eligibility interview. Even without formal documentation, witness statements from coworkers can help support your case.

this is really helpful info! do you know if they contact the employer during this process?

Yes, they'll contact your former employer to get their side of the story. Your employer can dispute your claim, which is why having evidence or witnesses is so important.

ugh the whole system is so frustrating. i quit my job because of similar issues and NYS Department of Labor denied me. apparently my situation wasnt bad enough even though i was having panic attacks every morning. they make it nearly impossible to get benefits if you quit.

If you're having trouble reaching NYS Department of Labor to discuss your specific situation, I used this service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Really saved me time instead of calling for hours.
