Do I qualify for unemployment if I quit my job in New York?
I'm thinking about quitting my current job because my manager has been making my life miserable for months. But I need to know - do I qualify for unemployment if I quit? I've heard conflicting things about whether NYS Department of Labor will approve benefits if you voluntarily leave. I've been at this job for 2 years and really can't take the hostile work environment anymore. Has anyone successfully gotten unemployment after quitting? What do I need to prove to NYS Department of Labor?

You can potentially qualify for unemployment if you quit for 'good cause' according to NYS Department of Labor rules. Hostile work environment could qualify, but you'll need solid documentation. Save emails, write down incidents with dates and witnesses, and consider filing complaints with HR first. NYS Department of Labor will investigate your claim during adjudication to determine if your reason meets their criteria for good cause.

•What counts as good enough documentation? I have some emails but mostly it's been verbal harassment.

yeah i quit my job last year bc of a toxic boss and got approved for UI benefits. took like 6 weeks though bc they had to do a whole investigation. you gotta prove the workplace was unsafe or illegal basically

Before you quit, document everything and try internal remedies first. NYS Department of Labor wants to see you attempted to resolve the situation. File complaints with HR, request meetings about the hostile environment, and keep copies of all correspondence. If you can show you tried to fix things and the employer failed to address serious issues, you have a stronger case for good cause separation.

•What if the company doesn't have HR? It's a small business with like 15 employees.

I had to use Claimyr to actually get through to someone at NYS Department of Labor when I had questions about my quit situation. Their regular phone lines are impossible. Check out claimyr.com - there's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me weeks of trying to get answers about whether my resignation would disqualify me.

•How much does that cost? I'm already stressed about money.

Don't quit unless you absolutely have to! The system is rigged against workers who quit. Even with 'good cause' they'll find ways to deny you. Better to get fired honestly, then you're guaranteed benefits.

•That's not accurate advice. NYS Department of Labor has specific good cause provisions for voluntary separations. Getting fired on purpose could backfire if it's considered misconduct.
