Can teachers collect unemployment if their contract is not renewed - NYS Department of Labor eligibility?

My teaching contract wasn't renewed for next year and I'm wondering if I can file for unemployment benefits through NYS Department of Labor. I've been teaching at a public elementary school for 3 years but they decided not to renew due to budget cuts. I know teachers have weird rules about unemployment during summer months, but what about when your contract just ends permanently? Has anyone been through this situation? I'm really stressed about paying bills over the summer while I look for a new teaching position.

Yes, you can absolutely file for unemployment if your teaching contract wasn't renewed! The key difference is between voluntary resignation and involuntary separation. Since your contract ended due to budget cuts (not your choice), you should qualify. You'll need to file through my.ny.gov and report that your employment ended due to lack of work. Make sure you have documentation about the non-renewal.

Thank you! Do I need any special paperwork from the school district or just my last pay stub?

I went through this exact same thing 2 years ago when my district cut 15 teaching positions. NYS Department of Labor approved my claim pretty quickly once I explained it was a layoff situation, not me quitting. The tricky part is they might ask about reasonable assurance of returning to work - since you're not rehired, that shouldn't be an issue. Just be clear on your application that your position was eliminated.

That's so helpful to know! How long did the whole process take for you?

About 2-3 weeks from filing to getting my first payment. Make sure to keep filing your weekly claims even while it's processing.

That rule applies to teachers who have reasonable assurance of returning to work in the fall. Since OP's contract wasn't renewed, there's no reasonable assurance, so they can collect benefits.

If you're having trouble getting through to NYS Department of Labor by phone to ask questions about your specific situation, I had good luck using Claimyr (claimyr.com) last year. They have this video demo that shows how it works: https://youtu.be/qyftW-mnTNI. Basically they help you actually reach a real person at NYS Department of Labor instead of getting stuck in phone hell. Really saved me time when I needed to clarify something about my claim status.

Interesting, never heard of that service before. Might be worth checking out if I run into issues with my claim.

The whole system is so confusing for teachers! I'm in the same boat - got non-renewed last month and still trying to figure out if I qualify. Did you already submit your application?

Not yet, I was waiting to make sure I understood the rules first. Sounds like we both should be eligible though based on what others are saying here.

ugh the nysdol website is such a nightmare to navigate... spent an hour trying to find the right forms yesterday

I totally feel you on that! The website is so confusing. I found it easier to just go directly to my.ny.gov and look for the "File for Unemployment" button rather than trying to navigate through all the NYSDOL pages. Once you're in the actual application system it's a bit more straightforward. Still not great, but at least functional.

Just wanted to add that you should also gather any documentation about the budget cuts or layoffs from your school district if possible. When I filed after my position was eliminated, having an official letter from HR explaining the reason for non-renewal really helped speed up the process. Also, don't forget that you can start looking for work in other districts while collecting - unemployment benefits are meant to support you during your job search, not just sit around waiting. Good luck with your application!

That's really good advice about getting documentation from HR! I hadn't thought about asking for an official letter explaining the budget cuts. Do you think an email from the principal or superintendent would work just as well, or does it need to be something more formal from the district's HR department?

@b2f9961e4494 That's excellent advice about the documentation! I'm definitely going to reach out to our HR department tomorrow to get something official about the budget cuts. It makes sense that having that paperwork upfront would help avoid delays later. Thanks for sharing your experience - it's really reassuring to hear from someone who went through the same thing successfully.

I'm a substitute teacher who just got notified that my district won't be offering me a permanent position next year, so I'm in a similar situation. From what I've read on the NY Department of Labor website, the key factor is whether you have "reasonable assurance" of employment for the next school year. Since your contract wasn't renewed due to budget cuts, you definitely don't have that assurance, which should make you eligible. I'd recommend applying sooner rather than later since there can be a waiting period before benefits start. Also, make sure to keep detailed records of your job search efforts since they'll ask about that in your weekly certifications.

@43d5d2beb473 Thanks for mentioning the "reasonable assurance" factor - that's exactly what I was trying to understand! It sounds like since both of us don't have any guarantee of employment next year, we should be in good shape to qualify. I appreciate the tip about applying soon too. Did you already start your application, or are you still gathering information like me?
