Can someone reapply for NY unemployment after 26 weeks or is that it?

My cousin has been on unemployment since November 2023 after her company downsized and eliminated her department. She received benefits for 26 weeks which will be running out in May. She's been applying for jobs like crazy but the market is brutal right now especially in her field (marketing). She's wondering if there's any way to reapply or extend benefits after the 26 weeks run out? She's getting really worried because she's already had to downsize her apartment and cut expenses to the bone. Anyone know if NY unemployment offers extensions or if she can submit a new claim? She's worked consistently for the past 7 years before this layoff if that matters for eligibility.

Once you exhaust your 26 weeks, thats it unfortunately. NY unemployment doesnt have any extensions right now. Your cousin would need to find work and then earn enough wages in a new base period to qualify for a new claim in the future. The only exception would be if the govt establishes some kind of emergency extension program, but nothing like that exists at the moment.

She would need to work and earn enough in a new base period. Usually that means working for multiple quarters and earning at least $2,900 in one quarter plus a total of at least 1.5x her highest quarter across her base period. The system is complicated but basically she needs significant work history again.

this is mostly correct but the base period is actually the first 4 of the last 5 completed calendar quarters. So it takes awhile to build up enough work history to requalify.

After your 26 weeks are up, you have to earn 10x your weekly benefit rate to re-qualify. So if she was getting $500/week, she'd need to earn at least $5000 in covered employment and then lose that job through no fault of her own to be eligible again. It sux but thats how it works in NY.

Tell your cousin to look into food stamps, rental assistance, and heating bill help programs ASAP before her benefits run out. Also lots of temp agencies are hiring rn even if its not ideal work, something to bridge the gap at least.

Thanks, I'll definitely tell her to apply for those programs. She's been doing some gig work but it's not nearly enough to cover her expenses. Does anyone know if side gigs like DoorDash would disqualify her from those assistance programs?

Gig work income counts but doesn't automatically disqualify her. She should still apply and report whatever income she's making. Better to get partial benefits than nothing at all!

The unemployment system in this state is a JOKE. 26 weeks is nowhere near enough time to find a decent job in this economy. I'm in the same boat and it's terrifying. They expect us to just magically find jobs when there are 100+ people applying for every decent position. The system is designed to fail us 🤬

There's a MAJOR misconception here that I need to clear up. Under current NY unemployment laws, you CAN potentially qualify for a new benefit year after your 26 weeks expire, BUT only if you've had new employment after your original claim was filed AND earned enough qualifying wages. Here's what your cousin needs to know: - After benefits exhaust, she cannot simply "extend" the same claim - To qualify for a new claim, she must have worked and earned wages AFTER filing her initial claim - She needs to have earned at least 10x her previous weekly benefit amount in new work - The work must be in covered employment (meaning jobs where employer pays into UI system) - She must have lost this new job through no fault of her own Right now there are NO federal extensions in place like there were during COVID. If she's struggling to get someone on the phone about her specific situation (which is common), I'd recommend using claimyr.com - it's a service that calls unemployment for you and connects you when a rep answers. Saved me days of frustration when I was dealing with a complicated claim issue. Also, make sure she's working with her local career center - they offer free job search assistance, resume help, and sometimes have connections to employers that aren't advertising publicly.

all these comments and nobody mentioned the obvious - has ur cousin tried looking outside her field? marketing skills can transfer to sales, customer service, content creation, etc. not ideal but bills don't wait for the perfect job 🤷‍♀️

not to be that person but have u checked if she qualifys for ny safety net assistance? its seperate from unemployment and can help with basic expenses when unemployment runs out. theres also the 'Emergency Assistance for Adults' program

I just went thru this nightmare myself. After my benefits ran out I couldn't get ANYONE on the phone to answer basic questons about reapplying. Spent literally 4 days calling and waiting on hold. tell your cousin to check out staffing agencies like Robert Half, Creative Circle, or Aquent - they specialize in marketing roles and often have contract positions that can at least get some income flowing while looking for permanent work

The NY unemployment website says: "If you use all 26 weeks of benefits, you cannot file a new claim until your current benefit year expires, and you must have worked since filing your original claim and earned 10 times your weekly benefit rate." So she has to wait til her benefit year expires AND have worked enough at a new job. Double whammy.

i had a random question about this actually - if someone gets a job but gets laid off again BEFORE using all 26 weeks of their original claim, can they just resume the remaining weeks? or does the system make them file a whole new claim?

If it's within the same benefit year (52 weeks from when you first filed), you can usually just reopen your existing claim and collect your remaining weeks. At least that's how it worked for me.

That's correct. If you haven't exhausted your 26 weeks and it's still within your benefit year, you can typically reopen your claim to collect remaining weeks. The system will check if your new employment might qualify you for a higher benefit rate though.

Check if she qualifies for the 599 Training Program!!! If approved, she could get benefits WHILE taking approved training courses to build new skills. It's NY's best kept secret for extending benefits. Not everyone qualifies but worth looking into immediately before her benefits run out.

Yes - she'd need to find an approved training program (community colleges, vocational schools, etc). She'd need to apply through her NY.gov unemployment account ASAP though. It's under the 599 Training section. If approved, she could keep getting benefits while training for a new career.

One thing nobody mentioned is that your cousin should file for her FINAL WEEK of benefits even if she knows she's hit 26 weeks. The system sometimes miscalculates and people occasionally find they have an extra week. Worth a shot.
