Can I get ny unemployment backpay for part-time work since last November?
I lost my full-time job back in November and immediately started working part-time at a retail store to make ends meet. I was only getting about 15-20 hours a week, which wasn't nearly enough to cover my bills. I had no idea until my coworker told me yesterday that you can still collect unemployment benefits while working part-time! All these months I've been struggling to pay rent and racking up credit card debt when I could have been getting partial benefits. If I apply for unemployment now, is there any way to get backpay starting from November when I first started the part-time work? I'm kicking myself for not knowing this sooner and wondering if there's any way to recover those months of payments I could have been receiving.

You can definitely file now, but backpay is tricky. NY unemployment generally only pays from when you first file your claim, not from when you first became eligible. I tried getting backpay for 2 months when I didnt know I qualified and they denied it. Still worth trying though - the worst they can say is no.

same exact thing happened to me!!! worked part time at walmart for 6 months b4 my friend told me I could get partial UI. when I finally applied they only gave me benefits from the date I applied forward, nothing backward 😭

It's actually a myth that you can't get backdated payments. I had success getting 3 months of backdated benefits, BUT you need to get a sympathetic agent on the phone and be very clear about why you didn't know (like if the website was confusing, or if covid disrupted normal processes, etc). The key is documenting EVERYTHING and being persistent.

There's actually a specific form for backdating claims due to misinformation or confusion about eligibility. I think it's called Request for Reconsideration or something. Throwing my experience into the mix: I was in almost EXACTLY your situation. Lost my full-time job, worked part-time, didn't know I could get partial UI. I filed late (about 3 months) and after multiple calls and explaining my situation, they did approve some backdated payments - but not all of them. They gave me about half of what I requested. It's definitely case-by-case and depends entirely on who you talk to.

idk about NY specifically but in CA they will backdate if you have a "good cause" reason. not knowing the rules sometimes counts but you gotta be persistent. either way apply NOW dont wait another day!!!

u have 3 days (72 hrs) from when ur first eligible to file or u lose those benefits forever. thats the official rule. BUT sometimes they'll make exceptions for "good cause" - not knowing about partial UI benefits might count depending on the agent you talk to.
