Can I get NY unemployment after motorcycle accident from pothole? Temporarily disabled

I was riding my motorcycle yesterday and hit a massive pothole that shouldn't have been there. Ended up with a pretty bad leg injury (torn ligaments and possible fracture waiting on full diagnosis). Doctor says I won't be able to work for at least 6-8 weeks while I recover. I've never been in this situation before - can I file for unemployment benefits since I'm temporarily unable to work? Or is there some other type of benefit I should be applying for in New York? My job doesn't offer any paid medical leave and I'm really worried about paying bills during recovery.

No, unemployment is specifically for people who lost their job but are able and available to work. What you need is NY State Disability Benefits (DB), which covers off-the-job injuries. Your employer should have this insurance. Ask HR for DB-450 form to start your claim. You generally get 50% of your average weekly wage up to the maximum benefit amount.

Thank you! I had no idea about this DB thing. Will call HR tomorrow. Do you know how long it usually takes to get approved? And I'm guessing the benefit is way less than my normal paycheck?

u might also wanna look into suing the city for the pothole damage. My cousin hit one last yr and got $$$ for his medical + bike repair. Just sayin

Hadn't even thought about that! Do you know what the process was like for your cousin? I took pics of the pothole after the accident.

This is actually important advice. If you're pursuing a claim against the municipality, document everything: photos of the pothole with something showing scale, exact location, your injuries, medical reports, repair estimates. Many NY municipalities require a Notice of Claim within 90 days, so don't delay. Consider consulting with a personal injury attorney who handles municipal claims.

You definitely can't get unemployment, I tried that route after breaking my arm last year. The system is SO confusing!!!!! They rejected me because technically I still HAD a job, just couldn't DO the job. Makes no sense!!!! The NYS disability thing the other person mentioned is what you need, but warning: the forms are CONFUSING and it takes FOREVER to process. I was almost healed by the time I got my first payment. 😠

Oh great... that's not encouraging. How long did it take for you to receive benefits? I really can't afford to wait months.

It took like 5 weeks!!! They kept saying they needed more documentation from my doctor, but my doctor said they sent everything!!! The system is a total MESS. And yeah the benefit amount was WAY less than my regular pay. Maybe half? It sucked but better than nothing I guess.

To clarify some points: New York State Disability Benefits (DB) provides temporary cash benefits to eligible wage earners who become disabled by an OFF-THE-JOB injury or illness. The current maximum benefit is $170 per week for up to 26 weeks. You need to file form DB-450 within 30 days of becoming disabled. Your doctor must complete part of this form. Regarding the pothole claim: You'll need to file a Notice of Claim with the specific municipality (city, town, county) responsible for that road. There are strict deadlines - typically 90 days from the incident. This is completely separate from your disability claim.

Wait, only $170 a week maximum? That's nowhere near enough to cover my rent, let alone other expenses. Is there any way to get more assistance? This wasn't even my fault!

This happened to me too! Hit a pothole on my bike (bicycle in my case) and broke my wrist. The NYS disability process is awful, took forever to reach anyone when I had questions.

Did you try calling them? I'm guessing their phone lines are as bad as unemployment?

When I had to deal with NYS disability last year after surgery, I couldn't get through on their phone lines for days. Finally used this service called Claimyr (claimyr.com) that got me through to an actual human at the disability office in about 20 minutes instead of spending hours on hold. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Saved me a ton of frustration especially when I needed to check why my claim was delayed. For disability claims, you really need to talk to someone to make sure all your paperwork is being processed correctly.

Thanks for the tip! Their phone system is already driving me crazy and I've only tried calling twice. I'll check this out.

It worked for me - got through to an actual person who fixed my claim issue. Before that I spent 3 days trying to get through the normal way. For disability claims especially, you need to talk to someone directly or your paperwork just sits there.

dont forget to file a police report about the accident if u havent already!! you'll need that for the city claim thing

I did file a police report at the scene - officer was actually super helpful and noted the pothole in the report. Good to know that'll be useful for the claim.

Since your injury is from a pothole, you should pursue both tracks simultaneously: 1. NYS Disability Benefits for immediate income support (though limited) 2. Municipal liability claim for the dangerous road condition For the municipal claim, having a police report documenting the pothole is extremely valuable evidence. You should also consider whether you have any applicable coverage through your motorcycle insurance policy. Some policies include Personal Injury Protection or Medical Payments coverage that might apply even in single-vehicle accidents. Lastly, if your employer has more than 50 employees, you might qualify for unpaid leave under FMLA to protect your job while you recover, though this doesn't provide income.

Thank you for all this information! I'll definitely check my motorcycle insurance policy - didn't think about that angle. Our company definitely has more than 50 employees so I'll ask HR about FMLA tomorrow too. At least that would protect my job.

Update us on how it goes!! The disability system is SO broken in NY, I swear!!! Maybe your experience will be better than mine was. 🤞

Will do. Going to get all the paperwork started tomorrow and see what happens. Not feeling super optimistic based on what everyone's saying, but gotta try something.
