LLC to S Corp: Can't remember if I filed IRS Forms 2553 and 8832. Help!

Hey everyone, I'm in a bit of a pickle. I have an LLC and I can't remember if I filed the forms to make it an S Corp. I think it was Forms 2553 and 8832, but I'm not sure. Has anyone dealt with this before? I'm planning to call the IRS to check, but I'm wondering if there's an easier way to find out or if anyone has tips for dealing with this situation.

Mei Chen

Oof, been there done that. The IRS can be a real pain to deal with. Have you tried checking your records? Sometimes we forget we kept copies of these things.

I found a method to get someone on the phone at the IRS. I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's the link: https://www.claimyr.com

Sounds too good to be true. Is this legit?

Yeah, it's legit. I was skeptical at first too, but it saved me hours of hold time. Worth every penny imo.

How long did it take for them to actually connect you?

It took about 45 minutes, but I didn't have to sit there listening to that awful hold music. They just called me when an agent was on the line.

Here's what you need to know about Forms 2553 and 8832: ā€¢ Form 2553 is used to elect S Corporation status ā€¢ Form 8832 is used to elect the classification of your business entity If you're not sure if you filed these, here are some steps you can take: 1. Check your tax returns. If you filed as an S Corp, it should be evident in your returns. 2. Look for any confirmation letters from the IRS about your election. 3. Contact your accountant or tax preparer if you used one. 4. As a last resort, call the IRS Business & Specialty Tax Line at 800-829-4933. Remember, if you didn't file these forms and want to be treated as an S Corp, you may need to file them now. There are deadlines and specific rules about when you can make these elections, so don't delay in figuring this out. Good luck!

Not sure if this helps, but I remember reading somewhere that if you filed as an S Corp on your taxes, the IRS kinda assumes you meant to file those forms even if you didn't. Might be worth looking into?

That's interesting. Do you have a source for that info? Could be really helpful for OP.

Oof, I don't remember exactly where I saw it. Might've been on a tax forum or something. Take it with a grain of salt, I guess?
