Can I avoid 15 penalty weeks by backdating EDD claim to when I was laid off?

Hi everyone, I'm in a tricky situation with my unemployment claim and really need some advice. I was laid off from my warehouse position at the end of January, but I only filed for unemployment in late April (about 3 months late). When my claim was finally processed, I discovered I have 15 penalty weeks to serve from a previous overpayment issue from 2023. I'm thinking if I can backdate my claim to when I actually lost my job, I'd essentially have already served most or all of those penalty weeks. I called EDD yesterday and was told they'd schedule an eligibility interview to discuss backdating my claim. Has anyone successfully backdated their claim in a similar situation? Did the penalty weeks count from the original job loss date or only from when you filed? I'm stressed about not having any income for another 3+ months if these penalty weeks start now instead of from when I was laid off.

THEY ALWAYS DENY BACKDATING!!! The whole system is designed to make us jump through hoops. I tried to backdate my claim when I had surgery and couldn't file for 6 weeks - had doctor's notes and everything. They STILL denied me saying I "could have had someone file for me" or "called them" (like that's even possible lol). The penalty weeks are just another way they punish people. It's all RIDICULOUS bureaucracy!

Yes, you must continue your work search requirements during penalty weeks and certify as normal. The only difference is you won't receive payment for those weeks. my cousin got her claim backdated but she had proof her employer told her wrong info about filing. she showed edd the emails where HR told her to wait. without some kinda proof like that i think ur gonna have trouble
