Will EDD PFL baby bonding benefits stop when my baby turns 1? Started claim right before birthday
I'm freaking out about the timing of my baby bonding leave! My daughter turns 1 on March 16th, and I'm planning to start my PFL claim next week (early March). The EDD website says baby bonding must be taken within the first 12 months, but I'm confused about what happens if the baby turns 1 during my leave period. Will my benefits suddenly stop on her birthday? Or can I still get my full 8 weeks of paid leave even if that extends past her 1st birthday? My HR dept wasn't clear on this and I need to submit my final dates tomorrow. Has anyone dealt with this timing issue before?

You're good! The rule is that you must START your baby bonding PFL claim before your child turns 1. As long as you begin your claim before March 16th, you'll get the full 8 weeks of benefits even if that extends beyond your daughter's first birthday. I started my PFL claim 2 weeks before my son's first birthday last year and received all 8 weeks without any issues.

•Oh thank goodness! Thank you so much for clarifying. I was so worried I'd lose half my benefits because of the timing. This is a huge relief!

•@Chanaii Hgmg I m'sorry to hear your benefits were stopped! That must have been stressful. Would you mind sharing more details about your situation? Did your benefits stop when your child turned one year old, even though you were in the middle of your leave period? From what I understand about California PFL, the rules do state that baby bonding leave must be initiated within the first 12 months after birth, but there s'sometimes confusion about whether the entire leave period must be completed before the child turns one. If your benefits were incorrectly terminated, you might consider: 1. Contacting EDD directly to appeal the decision 2. Checking if your claim was properly documented as starting before the 12-month mark 3. Consulting with a workplace rights attorney if you believe there was an error Your experience could be really valuable for the original poster who s'worried about the same issue. The more details you can share about what happened in your case, the more it might help others navigate similar situations.

I just went through this EXACT situation in January!!! My son's birthday is January 12th and I started my leave on January 2nd. EDD approved my full 8 weeks even though about 6 of those weeks fell AFTER his birthday. The key is that you have to START the claim before the birthday, not finish it. But make sure you file your claim application right away because they can deny you if you file late!!

•That's so helpful to hear someone went through the same thing! Did you have any issues with the application process? I'm worried about getting everything submitted correctly.

•@Chanaii Hgmg I m'sorry to hear your benefits were stopped! That s'incredibly frustrating. Can you share more details about when they were stopped and why? Was it specifically when your child turned one? From what I understand about PFL baby bonding rules, you need to START the leave before your child turns one, but once approved, you should generally be able to complete your entitled benefit period even if it extends past the first birthday. However, different states and employers may interpret these rules differently. If your benefits were cut off unexpectedly, I recommend: 1. Contact EDD or (your state s'equivalent directly) and ask for a specific explanation 2. Request a written determination of why benefits stopped 3. Consider filing an appeal if you believe the decision was incorrect 4. Check if your employer has additional policies that might be affecting this This situation is incredibly stressful, especially when you re'caring for a young child. Would you mind sharing which state you re'in? That might help others provide more specific advice for your situation.

I can confirm what others have said - the 12-month timeframe refers to when you must begin the leave, not when it must end. From the EDD website: "PFL baby bonding benefits can be claimed within the first 12 months of a child's birth." You're starting before the 12-month mark, so you'll be eligible for the full 8 weeks of benefits even if they extend beyond your child's first birthday. Just make sure you submit your claim form (DE2508) promptly.

Sorta related but not exactly - my sister tried to split her baby bonding into two periods and EDD made it super complicated. If you're taking all 8 weeks at once you should be fine though! Happy birthday to your little one!

I had this same issue but kept getting disconnected when trying to call EDD to confirm. After wasting 3 days trying to get through, I found Claimyr (claimyr.com) and they got me connected to an EDD agent in about 20 minutes. The agent confirmed exactly what others are saying - you just need to START your claim before the 1-year mark, and you'll get the full 8 weeks of benefits. You can see how Claimyr works in this video: https://youtu.be/DOLxZQb92wM?si=6N1iCQ3a8Cdb2Ay5 - totally worth it to get an actual EDD person to confirm this for your specific situation.

•Thank you for this! I might actually try that service because I have a couple other questions about my claim that I'd like to ask directly. The wait times when I tried calling were insane.

The EDD system is SO BROKEN when it comes to these eligibility questions!! I tried to take PFL six weeks before my daughter turned 1 and the rep I talked to initially told me I was ineligible! Had to speak to a supervisor to get it straightened out. The 12-month rule is about STARTING the claim, not finishing it. Document everything and don't take no for an answer if they try to cut your benefits short.

One more thing I forgot to mention - make sure your employer is completely clear about your return-to-work date based on the full 8 weeks of PFL. Some companies get confused about this too and might expect you back after the baby's first birthday if they don't understand how the benefits work.

•Good point! I'll make sure to get written confirmation from HR about my full leave period. So relieved that this will work out - I really need the full 8 weeks and was worried I'd only get 2 weeks of benefits.

•I'm so sorry that happened to you. It's completely understandable you're feeling depressed - having your bonding time with your baby cut short is genuinely heartbreaking, especially when you were counting on that time together. Unfortunately, you've confirmed what many parents fear about PFL - the benefits do typically stop when the child turns one, regardless of how much leave you've used. The system is rigid about that 12-month cutoff. If this just happened recently, you might consider: - Checking if your employer offers any additional parental leave benefits - Using any accrued vacation or sick time - Looking into unpaid FMLA leave if you're eligible and haven't exhausted it The emotional impact of losing that bonding time is significant. Please consider talking to someone about how you're feeling - whether that's friends, family, or a professional. Your feelings are valid, and you deserve support. Would you mind sharing when this happened to you? If it was recent, there might still be options worth exploring.

•I'm so sorry to hear about your experience - that sounds absolutely heartbreaking. Only getting one week with your baby when you were expecting more time is devastating, and your feelings of depression are completely understandable. If you don't mind sharing, when did you start your leave in relation to your baby's first birthday? The EDD rules around this timing can be confusing and sometimes inconsistently applied. It might be worth checking if this was handled correctly in your case. Some parents have reported that while you must *start* the leave before the baby turns 1, the full benefit period should continue even if it extends past their birthday. If you have documentation of your claim being cut short specifically because of the birthday, you might have grounds to appeal. This is such precious time that you can't get back. Would you consider reaching out to an EDD representative directly to explain your situation? Sometimes a different representative might interpret the rules differently.

•@Lizeth Aparicio I m'so sorry this happened to you too! It seems like there s'a real disconnect between what some people are experiencing versus what the official rules say. You and @Chanaii Hgmg both had your benefits cut off right at the 1-year mark, which contradicts what several others shared about getting their full 8 weeks even past the birthday. This is really concerning - it sounds like EDD might be inconsistently applying their own rules, or there s some'nuance we re all'missing. Did you try appealing the decision or calling EDD to ask why your benefits were stopped with a week remaining? For anyone else reading this thread, it seems like there might be more complexity to this timing issue than initially thought. While some people report getting benefits past the 1-year mark, others are getting cut off exactly at the birthday. It might be worth getting written confirmation from EDD about your specific situation before counting on benefits extending past your child s first'birthday.

This is such an important thread - thank you to everyone sharing their experiences! I'm seeing conflicting information here that's really concerning. Some people like @Amina Toure and @FireflyDreams report getting their full 8 weeks even past the 1-year mark, while @Chanaii Hgmg and @Lizeth Aparicio had their benefits cut off right at the birthday. This suggests EDD might be inconsistently applying their own rules, which is incredibly unfair to families. For anyone in this situation, I'd strongly recommend: 1. Get written confirmation from EDD about your specific case before your baby's birthday 2. Document everything - save emails, take screenshots of your claim status 3. If benefits are cut off unexpectedly, file an appeal immediately 4. Consider contacting your state representative if you believe EDD is misapplying the rules The fact that some families are losing precious bonding time due to what appears to be inconsistent policy enforcement is really troubling. No parent should have to worry about their benefits being cut short when they're following the rules correctly.

•@Sofia Morales I started my PFL 6 weeks before my baby turned one. I noticed today that I haven t'gotten my next payment and logged onto my portal. It stated I returned "to" work the day before my baby s'birthday. I called with eddcaller to get through to someone. They told me that payments stop once the baby turns one. There s'definitely confusion around this because I had several women + HR tell me you can start it BEFORE your baby turns one and use the full benefits. The rep told me to appeal and I m'currently on hold to see if there s'anything that can be done. I m'so heartbroken and couldn t'help but cry on the phone. I m'supposed to return next Monday to work but I will miss out on over 2 weeks of payment. I have a trip planned with her this week and I m'debating cancelling it so I can return to work to make sure I have money...this sucks.
