Filed UI by mistake - need to switch to SDI disability claim but UI is pending
I think I just messed up BIG TIME and I'm freaking out. I got hurt at work last Friday (slipped disc that's left me unable to walk properly), but stupidly filed for unemployment instead of disability on Monday! I wasn't thinking clearly with all the pain meds. My doctor just told me yesterday that I need to file for SDI disability instead since I can't work for at least 6-8 weeks. The UI claim is still pending - hasn't been approved or denied yet and I haven't certified for any weeks or received any payments. Is there any way to cancel or withdraw the UI claim so I can apply for SDI? Or do I just file for SDI anyway? Will I get in trouble for having both claims in the system at once? I'm so confused and in too much pain to deal with this bureaucratic nightmare right now.

Don't panic! This happens more often than you'd think. You can't actually delete a UI claim once it's in the system, but you CAN file for SDI even with a pending UI claim. What's important is that you don't certify for any UI weeks while you're receiving SDI - that would be considered fraud. The systems do talk to each other, so EDD will eventually see you have both claims, but as long as you don't double-dip (receive payments from both programs for the same period), you should be fine. File your SDI claim right away since there's a 7-day waiting period before benefits kick in.

YOU CANT HAVE BOTH!!! I did this last year and it was a NIGHTMARE!!! The EDD flagged my account and froze EVERYTHING and I had to wait MONTHS to get it sorted out. You NEED to call them ASAP and explain the situation before they think youre committing fraud!!!

•After trying to reach EDD for two weeks about my disability claim, I finally used Claimyr (claimyr.com) and got through to a rep in under 30 minutes. They have this service that basically calls EDD for you and connects you when they get through. Saved me days of frustration. I had a similar situation back in 2022 - filed UI then got sick and needed SDI. The most important thing is DON'T CERTIFY FOR UI WHILE YOU'RE DISABLED. As long as you don't try to get paid from both programs at the same time, you'll be fine. I just let my UI claim sit there while I collected SDI. When I was better, I went back to UI (since I still didn't have a job). Just make sure your doctor properly fills out the medical certification form for your SDI claim with all the correct dates.

•No issues at all! When I certified for UI after recovering, there was a question asking if I was unable to work due to disability during the gap period, and I just answered honestly. The systems are actually designed to handle this situation - they know people can become temporarily disabled while unemployed. Just be truthful in all your responses and you'll be fine.

Thank you everyone for the advice! I just filed my SDI claim online and have NOT certified for any UI benefits. I'll try calling EDD tomorrow to explain the situation, but if I can't get through, I'll send a message through the UI portal as suggested. I'm feeling much less stressed about this now. Will update once I hear back about my SDI claim status.

UPDATE: I just got through to EDD! They said they'll put a note on my UI claim about the mistake and that I've filed for SDI instead. The rep confirmed I should not certify for any UI weeks and that there shouldn't be any issues as long as I don't try to collect both benefits for the same time period. SDI claim is processing now.
