EDD SDI appeal for overpayment during claim transition - will my new claim payments be held?

I'm in a frustrating situation with EDD and hoping someone has gone through something similar. I had knee replacement surgery back in February and properly transitioned from UI to SDI. I notified UI to stop my payments before my surgery date, and my disability payments began after my UI ended - with zero overlap between the two. Now, 3 months later, EDD is claiming I was overpaid by $2,450 during that transition period! Here's my concern: my original SDI claim just ended, and I started a brand new claim two weeks ago for ongoing recovery complications. The representative said I should be able to certify and receive payments on this new claim despite the pending appeal on my old claim, but she couldn't guarantee it. Has anyone dealt with an overpayment appeal while starting a new claim? Did your payments come through normally, or did EDD hold them until after the appeal hearing? I'm worried about bills piling up if they withhold payments until my appeal date in July.

In my experience working with disability claims, EDD typically processes new claims separately from appeals on previous claims. i had a simillar thing happen BUT they did hold my payments for like 3 weeks while they did some kind of review?? eventually they released everything and i got paid but there was definitely a delay. might depend on who processes your claim tbh

no notification at all! i just noticed i wasnt getting paid after certifying. had to call like 20 times before i got thru and they were like "oh yeah we're reviewing your account because of the other issue" so frustrating

There's actually a big difference between SDI and UI overpayments when it comes to new claims. For UI, they definitely hold new payments while appeals are pending, but SDI usually processes them separately as long as your new claim is for a different benefit period. I've been through this three times with my chronic condition, and they only held my new payments once - that was during COVID when everything was messed up. Your assembly member is right that you should get paid, but EDD's systems are unpredictable sometimes. IMPORTANT: Make sure you respond to EVERY piece of mail you get from EDD about the overpayment while waiting for your appeal hearing! I ignored some of their notices thinking "well, I've already appealed this" and it almost resulted in them denying my appeal on a technicality. You need to respond to everything, even if it's just writing "UNDER APPEAL - CASE #12345" on their forms and sending them back. This keeps your appeal active in their system.

Just to follow up on my earlier comment - in addition to getting your new claim payments during the appeal process, make sure you gather these specific documents for your appeal hearing: 1. Official notification showing when your UI claim ended 2. Your SDI approval notice showing the start date 3. Bank statements showing the payment dates (to prove no double payments) 4. Any communications you had with EDD about stopping your UI claim I presented all of these at my hearing, and the judge ruled in my favor within minutes. The EDD representative at the hearing actually acknowledged their error right away once they saw the documentation.

I brought physical copies AND submitted everything electronically before the hearing. The judge appreciated having the paper copies during the actual hearing. If your hearing is by phone (mine was), make sure to email everything at least 5 days before. Be super organized - I created a simple timeline document that listed each important date with the corresponding proof attached. Made it really easy for the judge to follow.

Yes, it's definitely a new claim. My original benefit year ended completely (it was for the knee replacement) and this new claim is for a different condition that developed during my recovery. I had to submit a completely new application with new medical certification from my doctor.
