Can I apply for CA SDI with an EDD overpayment penalty? Broke my wrist!

I injured my wrist pretty badly at a construction site last week (complete fracture, requires surgery) and my doctor says I'll be out of work for at least 8 weeks. I need to apply for disability benefits ASAP since I won't be getting paid, but I'm worried about something from my past UI claim. Back in 2020-2021, I collected unemployment during the pandemic. In early 2024, EDD sent me a notice saying I had an overpayment and that I'm not eligible for "EDD benefits" for 3 YEARS! The letter wasn't clear if this penalty applies just to unemployment or ALL types of EDD benefits including disability. Does anyone know if an unemployment overpayment disqualification affects SDI claims too? The penalty period wasn't clear - does it start from when I got the notice (2024) or from when I had the UI claim (2020-2021)? I'm stressed because I really need the income while I recover from this wrist surgery. Any advice would be REALLY appreciated!

Good news - your UI overpayment penalty generally doesn't affect your eligibility for SDI! They're completely separate programs with different funding sources. UI comes from employer contributions while SDI comes from deductions from your paycheck. As long as you've paid into SDI through payroll deductions during your base period, you should be able to file a claim for your wrist injury regardless of what happened with your UI claim. The 3-year penalty typically applies only to future unemployment claims, not disability. I went through something similar last year and was able to get SDI despite having an unresolved UI issue.

Not 100% sure but I think SDI is different from UI so ur probably ok??? I had a friend who got UI overpayment but still got pregnancy disability later. The systems don't seem connected at all lol

Actually, they ARE connected - it's all EDD! But the programs have different eligibility requirements. The 3-year penalty is specifically for fraudulent UI claims. If you were penalized for fraud (not just a simple overpayment), it COULD affect other benefits. The letter should specify what type of overpayment it was.

I'll definitely check out that Claimyr service if I need to call! The notice was confusing but I *think* it was a regular overpayment, not fraud. They said something about me reporting my income incorrectly during those Covid months, but it was honestly just confusion about how to report the partial hours I was working. Apply for SDI RIGHT NOW!!! Don't wait! Even if there's an issue, you need to get your claim in the system ASAP because the clock is ticking. SDI has a 7-day waiting period before benefits start, and they won't backdate claims if you delay filing. Your doctor also needs to submit their certification within 49 days of your disability start. The sooner you get everything filed, the better.

👆 This! And make sure your doctor is familiar with filling out the medical provider form correctly. My claim was delayed for weeks because my doctor missed some sections on the form. The stress made my recovery so much worse lol

I had EXACTLY the same situation last year!!! Got an overpayment notice for pandemic unemployment and then needed disability three months later for back surgery. I was so worried they'd deny me but guess what? My SDI claim went through totally fine! The EDD is completely disorganized - their UI department barely talks to their DI department. I actually think the overpayment stuff only applies to future unemployment claims, not disability or paid family leave. The SDI folks never even mentioned my UI overpayment when I filed. BUT be super careful filling out your disability application - make sure all your employment info is 100% accurate because they're extra suspicious of people who've had issues before!!!!

I filed online - WAY faster! Just make sure you have your employment history for the past 18 months ready (company names, addresses, phone numbers). And don't forget to follow up with your doctor to make sure they submit their part. My doc almost forgot and I had to keep bugging them!

the whole system is rigged anyway. they make everything confusing ON PURPOSE so they can deny benefits to people who actually need them. i had a legitimate injury last year and they still tried to deny my claim saying i didnt provide enough medical evidence even though my doctor sent in all the forms twice!!

UPDATE: I just submitted my SDI application online! It was actually much easier than I expected. My doctor already submitted his certification (I confirmed with his office). I carefully reviewed that old overpayment letter and it doesn't mention anything about fraud - it just says there was an overpayment because I "received benefits I wasn't eligible for" during certain weeks when I had partial income. So I'm hopeful this won't affect my disability claim. Thanks everyone for the helpful advice! I'll update again once I hear back from EDD about my claim status.

Good job getting it submitted! Just keep an eye on your SDI Online account - that's where updates will appear first. If your claim shows "pending" for more than 14 days, that's when you might want to consider calling them to check why.
