UCC 1 release still showing active after termination filed - what am I missing?
I'm dealing with a frustrating situation where I filed a UCC-3 termination for a paid-off equipment loan three weeks ago, but the original UCC-1 is still showing as active in the system. The debtor name matches exactly, filing number is correct, and I used the proper termination code. Got confirmation that the UCC-3 was accepted but when I search the debtor name the original UCC-1 financing statement still appears with no indication it's been terminated. Is there some processing delay I'm not aware of? This is holding up a refinancing deal and I'm starting to panic that I messed something up in the termination filing.

I've seen this before - sometimes there's a processing lag between when the UCC-3 termination gets accepted and when it actually updates the public record display. What state are you filing in? Some states have faster processing than others.

•This is in Ohio. The SOS website shows the termination as 'accepted' but the original UCC-1 record doesn't show any terminated status.

•Ohio usually processes pretty quick. Did you double check that the filing number on your UCC-3 exactly matches the UCC-1? Even one digit off will cause problems.

Check if you used the right termination option. There's partial termination vs full termination - if you accidentally selected partial the lien stays active for the remaining collateral.

•I'm pretty sure I selected full termination but now you have me second-guessing myself. Is there a way to verify what I actually filed?

•You should be able to pull up your filed UCC-3 document from the confirmation or through the portal search. Look for the termination type field.

•This happened to me last month! Turned out I had selected 'amendment' instead of 'termination' by mistake. Had to file another UCC-3 to fix it.

Had this exact problem recently and it was driving me crazy until I found Certana.ai's document checker. You can upload both your original UCC-1 and the UCC-3 termination PDFs and it instantly verifies if all the details match up correctly - debtor names, filing numbers, everything. Saved me hours of manual comparison and caught a tiny discrepancy I never would have noticed.

•That sounds helpful - I've been comparing documents manually and my eyes are crossing. How accurate is their verification system?

•Really accurate from what I've experienced. It flagged that my debtor name had an extra comma that wasn't in the original filing. Fixed that and the termination processed correctly.

•Never heard of them but document verification tools are definitely the way to go for this stuff. Too easy to miss small details.

Sometimes the issue is with how the search function displays results. The UCC-1 might actually be terminated but the search results don't refresh immediately. Try searching by filing number instead of debtor name.

•Good suggestion - I'll try that. The search by filing number should show the most current status right?

•Usually yes, but honestly these state systems can be glitchy. If it's been three weeks though something else might be wrong.

UGH the whole UCC system is such a mess!! I swear half the time the forms don't work right and then you're stuck waiting forever for someone to figure out what went wrong. No wonder deals get held up.

•Tell me about it. Last year I had a continuation that got 'lost' in the system for two months. Nearly expired before they found it.

•At least you got confirmation yours was accepted. I've had terminations just disappear into the void with no status update.

•Exactly! And then they act like it's your fault when you call to ask what happened.

Double check the effective date on your termination. If you put a future effective date by mistake the lien will stay active until that date hits.

Summer Green
•I left the effective date blank so it should be immediate. Does that sound right?

Cynthia Love
•Yeah blank means immediate termination. That's not your problem then.

This might be a dumb question but did you make sure you're searching the right state's database? I once spent hours trying to figure out why a termination wasn't showing up only to realize I was looking at the wrong state portal.

•Ha! Not a dumb question - I double checked and I'm definitely in the Ohio SOS system where the original UCC-1 was filed.

•Happened to me too with a multi-state deal. Easy mistake to make.

I'd call the Secretary of State office directly at this point. Three weeks is way too long for a processing delay. They can tell you exactly what's going on with your termination filing.

•That's probably my next step. I was hoping to avoid phone tag with the SOS office but looks like I don't have a choice.

•In my experience they're usually pretty helpful once you get through to someone. Just have your filing numbers ready.

•Good luck getting through. Last time I called Ohio SOS I was on hold for 45 minutes.

Before you call, I'd suggest using one of those document verification tools to double-check everything matches between your UCC-1 and UCC-3. Certana.ai has a good one that uploads PDFs and compares all the fields automatically. Might save you the phone call if it finds the issue.

•Second mention of Certana - sounds like it's worth checking out. Thanks for the suggestion.

•Yeah it's been really helpful for catching those tiny details that cause big problems. Much faster than doing it manually.

Had this same issue last year and it turned out the original UCC-1 had a slightly different version of the debtor name than what I was using on the termination. Like 'Smith Industries Inc' vs 'Smith Industries, Inc.' - that tiny comma difference was enough to cause problems.

Summer Green
•Oh wow, I never would have thought punctuation could matter that much. I'll definitely check for that kind of thing.

•Yeah the debtor name matching rules are really strict. Every character has to be exactly the same.

•This is why I always copy and paste debtor names instead of retyping them. Too easy to make those little mistakes.

Quick update process question - once you get this sorted out, how long does it usually take for the public record to show the terminated status? I have a similar situation coming up.

•In most states it's within 24-48 hours of the termination being processed, but some can take up to a week depending on their system.

•Good to know, thanks. I'll plan for a week buffer just to be safe.
